Attachment 5 TOWN OF LOS ALTOS HLLS Policy Re: Acceptance ofroads into the Town's System ofpublic Roadways Code Sections: There is no Municipal Code reference that stipulates requirements for accepting an existing road into the Town's System ofpublic Roadways (Town's Road System). The Circulation Element ofthe Town's General Plan states the following: Circulation in Los Altos Hills The Town's Goal (page 2) The Town's goal is to maintain our quiet residential roads: >- To assume responsibility for private roads only when they have met Town standards. Goal C-2 (page 9) Obectives The policies and implementation measures should result in:.:. The dedication of private roadways to public ownership when requested by affected property owners, when they have been upgraded to current Town standards and where all necessary dedications have been offered by adacent property owners. Policies Dedication will be considered only when the road is maintained and, if necessary improved to a level acceptable to the Town. The Town also has an unwritten policy requiring roads to meet current Town and Fire Department Standards prior to being eligible for acceptance into the Town's Road System. Per the California Streets and Highway Code Section 1806, the Town is not responsible for maintenance unless there has been an acceptance by an official resolution adopted by the Town, which accepts the road into the Town's Road System.

Policy: Acceptance of Roads into the Town's System of Public Roadways Page 2 ntent: The purpose of this policy is to formalize an unwritten policy for accepting an existing road into the Town's Road System. Policy: 1. Roads shall meet current Town and Fire Department Standards prior to being eligible for acceptance into the Town's Road System. 2. A plan shall be prepared by a registered civil engineer showing the exlstmg conditions of the road, Right-Of-Way, and all necessary proposed improvements to meet current Town and Fire Department Standards. 3. Roads that have future pathways indicated on the Town's Pathway Master Plan shall have the pathway constructed as part ofthe improvements necessary to bring the road up to current Town Standards. 4. Bridges on the road shall also comply with the current Town and Fire Department standards. 5. The cost for all necessary improvements and fees to bring the road up to current standards shall be paid by the residents who own the road in a manner that is determined by the residents involved. 6. mprovement work shall be inspected by the Town and approved by the City Engineer. 7. Roads will be added to the Town's Road System following acceptance by the City Council and recordation of necessary documents with the County Recorders Office. NOW, THEREFORE, the City Council ofthe Town of Los Altos Hills does ORDAN as follows: 1. AMENDMENT OF ZONNG MAP. BACKGROUND On May 2,2011 the City received a letter from the Local Agency Formation Commission outlining five island areas remaining to be annexed into the City. On September 22,2011 the City Council authorized staff to respond with a five year plan for annexation of the remaining island pockets and immediately begin the process of pre-zoning the La Lorna #3 and Olive Tree Hill #1 island pockets. (Attachment 3) Per the Cortese-Knox-Hertzberg Act of 2000 (California Government Code Section 56000, et seq.), the detachment and annexation ofterritory from one agency's urisdiction to another falls within the purview oflafco. LAFCO's mission is to encourage orderly growth and development, ensure efficient delivery of services, discourage urban sprawl, and preserve agricultural and open space lands. Prior to annexation, an unincorporated area must be prezoned. Prezoning will establish the zoning district which will apply in the event of annexation to the Town. The proect area is proposed to be prezoned "R-A" (Residential-Agricultural). The zoning classification established through the prezoning procedure will become effective and enforceable when annexation is approved, it will have no force or effect on the subect properties until that time.

StaffReport to the City Council March 14,2012 Page 2 of4 The area subect to this prezoning is located along Stonebrook Drive, Olive Tree Lane and Northcrest Lane. Each parcel maintains a single family home with associated structures and paving. See Attachment #4 for a list of the parcels included within this annexation along with information regarding each parcel. A map of the proect area is included as Attachment #5. Roads within the proect area include Olive Tree Lane and Northcrest Lane both ofwhich are private. Stonebrook Drive also serves as access to several parcels however this portion of Stonebrook Drive is already within the Town limits and is considered a private road. An emergency access easement connects Stonebrook Drive to Laura Court. Tax Equity Allocation (TEA) Funding On February 28, 2006, the Santa Clara County Board of Supervisors passed two measures in support of Tax Equity Allocation (TEA) which involves the return of annual property tax revenue from the County to the Town. The TEA accounts for a significant additional property tax revenue per year for the Town. For fiscal year 2010-2011, the additional tax revenue was approximately $594,000.00. The Board of Supervisors' support on TEA was clearly predicated on the Town's continuous commitment to pursue annexation of unincorporated lands in the County within the Town's Sphere of nfluence. On August 29, 2006, the California State Assembly passed AB 117 (Tax Equity Allocation formula: County of Santa Clara), which shifted County tax revenues to four cities in Santa Clara County including the Town of Los Altos Hills. Planning Commission Recommendation At the Planning Commission hearing on March 1, 2012, three property owners addressed the Commission. Mr. Jasbir Walia, 10921 Stonebrook Drive, expressed his suppoli of the annexation. Two other residents Ted Wuerthner, 24874 Olive Tree Lane and Farouk Arani, 24892 Olive Tree Lane expressed concern regarding the pathway gate at the end of Olive Tree Lane. They are very concerned about the potential for unlocking this gate for people to gain access to the Chamise Trail located on the Mid Peninsula Open Space preserve. They are worried about their street becoming a trail head with people parking on the narrow road. n the past when the gate was open they had considerable problems with teens leaving trash and making loud noises around their properties. On several occasions the police were called to handle the disturbances. The Planning Commission noted their position regarding the pathway and voted 4-1 (Abraham - No) to forward a recommendation to City Council to move forward with the prezone of the Olive Tree Hill area, and to recommend approval of the Negative Declaration and nitial Study.

" The proposal is also consistent with Los Altos Hills Municipal Code Section 10-1.306 (Prezoning adoining unincorporated lands and zoning annexed lands): "Adoining lands in unincorporated territory may be prezoned by amending the zoning map to include such land in a zoning district category. n the event any prezoned lands are subsequently annexed to the Town, the zoning indicated on the map shall become effective at the time ofannexation. All other lands annexed to the Town shall be in the Open Space Reserve (OSR) District until otherwise classified. " sland Annexation ncentives The Santa Clara County Local Agency Formation Commission (LAFCO) encourages the annexation ofunincorporated County pockets. ncentives for annexation ofthese pockets include the waiving of LAFCO fees, preparation of all required legal descriptions and maps by the County, preparation ofthe assessor's report, and payment ofthe State Board of Equalization Fee. The law streamlining the annexation process for qualified unincorporated islands sunsets on January 1, 2014. However, for these incentives to apply the entire pocket or island must be annexed. CEQAREVEW n conformance with CEQA requirements, staff prepared an nitial Study and Negative Declaration. A Notice of ntent to adopt a Negative Declaration was published in the Town Crier on February 8, 2012. The notice was also submitted to the Santa Clara County Clerks Office for a 20 day public review period which began on February 10, 2012 and ended on March 1, 2012. PUBLC COMMENTS As of this date, the Town has received written correspondence from one property owner Jasbir Walia, 10921 Stonebrook Drive, who is in support of the annexation (Attachment #7). Attachment 9 Policies Applicable to All Residential Annexation Applications General Requirements and Policies: The Town of Los Altos Hills Sphere of nfluence shows both Town territory and the unincorporated County territory that may be considered for annexation to the Town. The applicants requesting annexation shall be responsible for the payment of all applicable Town staffand consultant charges and deposits and any LAFCO. County, and State Board of Equalization application fees. Required fees and deposits shall be submitted to the Town prior to staffreview ofthe request n evaluating a proposed annexation, staff shall present a report to the City Council which shall include the following information: A. A Statistical Summary. All relevant data such as land area, population, dwelling units, street miles, park and open space acreage, and assessed valuation, to provide a summary of the area's characteristics. B. Land Use and Planning. Boundaries, topography and natural features, existing land use and development, general plans, and zoning to provide a detailed overview of the existing and planned physical characteristics of the area and to provide a comparison to areas within the Town. All territories proposed for annexation shall substantially comply with the minimum lot size standards and slope density requirements of the City's Subdivision Ordinance or provisions shall have been made to achieve compliance. The Town may impose such reasonable conditions or restrictions as it deems necessary to secure the purpose of the Town's General Plan and Municipal Code and to assure operation of the use in a manner compatible with existing and potential uses of adoining properties and in the general vicinity, and may require guarantees and evidencethatsuch conditions are being, orwill be, compliedwith. C. A Plan of Services. Administration and facilities for public services such as law enforcement, fire, sewers, water, and schools, that exist today or are planned for the future. The Plan should also show the level of services to be provided compared to levels provided within the Town. D. Public Services and Facilities. Prior to annexation of parcels, public services and facilities meeting Town standards shall be installed or provisions for their installation shall have been made to the satisfaction ofthe City Engineer.

City Council 2005 Annexation Policy July 21, 2005 Page 2 Public services and facilities include the following: Sanitary Sewer Facilities: Parcels to be annexed must be connected to the Town's sanitary sewer system or be capable ofconnection to the Town's sewer to the satisfaction of the City Engineer. All costs of installation of new sewer systems and laterals shall be at the homeowner's expense including inspection, plan check fees, other city fees and annual sewer service charges. The Town will not initiate annexations unless the Town has a sufficient number of sewer capacity rights under its control to first serve existing residents and then all parcels proposed for annexation. Streets: Public streets must be constructed to Town standards and meet Town right ofway standards (60-foot width typical). Private streets and facilities that are satisfactory to the City Engineer with adequate provision for their maintenance may be acceptable in lieu of public streets and facilities, Drainage: All new development shall include provision for management of storm drainage in a manner which maintains runoff quantities equal to or less than the runoff quantity in its pre-developed conditions. Pathways, Recreational Facilities and Open Space Easements: The annexation.proposal shall be subect to review and recommendation by the Town Pathways Committee, Parks and Recreation Committee and the Open Space Committee. Open space easements, pathway easements and! or in-lieu fees may be required as conditions ofannexation. Geologic Hazards: The annexation application documents and physical territory shall be subect to review and recommendation by the Town Geologist. The applicant shall be responsible for any cost required to update the Town's Geologic Hazard Map to include the tenitory to be annexed. E. A Fiscal mpact Analysis. The analysis shall include initial start-up costs, other one-time costs, and continuing annual expenses to the Town by each Department to serve the area. t shall also include one-time and continuing additional revenues by each budget account to be received by the Town as a result of annexation. The Analysis shall show the costs and benefits associated with the proposed annexation. F. Boundaries. Opportunity to realign boundaries that more closely approximate logicalman-made or natural physical barriers.
