Public Report To: From: Report Number: Finance Committee Nicole Pincombe, Director of Finance/Treasurer, City Manager s Office FIN-14-57 Date of Report: June 5, 2014 Date of Meeting: June 19, 2014 Subject: 2014 General Fees and Charges By-law Update File: C-2600 1.0 Purpose The purpose of this report is to obtain Council approval for the amendments to the City s General Fees and Charges By-law ( By-law ). 2.0 Recommendation That the Finance Committee recommends to City Council: That the changes to the General Fees and Charges By-law as outlined in Report FIN-14-57 dated June 5, 2014 be approved and the amending General Fees and Charges Bylaw be approved. 3.0 Executive Summary The General Fees and Charges By-law is subject to periodic reviews to ensure the City of Oshawa s ( City ) fees are responsible and reasonable based on the cost to deliver the City s programs and services as well as ensuring the City s fees are in line with our comparator municipalities. The last comprehensive review of the General Fees and Charges By-law was undertaken in December 2011 through Report CM-11-56 2011 Update to the General Fees and Charges By-law and Amending Traffic By-law. Council as part of this review approved changes to City Clerk Services Fees, Municipal Law Enforcement and Licensing Fees, Cemetery Fees, Road Operations Fees and Airport Fees. 2

Report to Finance Committee Meeting Date: June 19, 2014 Page 2 In January 2013, Council reviewed Report CM-13-12 Recreation and Parks Fees 2013 Update and approved changes to Parks and Recreation Fees and implemented an annual indexing of the majority of the Parks and Recreation Fees. In November 2013, Council reviewed Report DS-13-242 Proposed Amendments to the General Fees and Charge By-law Related to Certain Planning Application Fees and authorized changes to various planning application fees. Staff have completed a comprehensive review of the City s General Fees and Charges By-law. This report includes recommended changes to the General Fees and Charges By-law to ensure that the By-law is current and accurately reflects the services being provided, and the fees more closely reflect the cost to provide these services. 4.0 Input from Other Sources The information in the fee schedules has been provided by the respective departments. Legal Services was consulted in the preparation of this report and has reviewed the attached amending By-law. 5.0 Analysis Section 391 of the Ontario Municipal Act, 2001 permits a municipality to pass By-laws imposing fees or charges on persons, (a) for services or activities provided or done by or on behalf of it; (b) for costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and (c) for the use of its property including property under its control. On February 24, 2003, Council approved By-law 13-2003 and attached Schedules A, B, C and D to establish and require payment of various fees and charges. These Schedules detailed user fees for specific city services. Council has approved amending by-laws since February 2003 to update some of the fees included in the By-law. Staff have completed a comprehensive review of the City s General Fees and Charges By-law. This report includes recommended changes to the General Fees and Charges By-law to ensure that the By-law is current and accurately reflects the services being provided, and the fees more closely reflect the cost to provide these services, and the fees being charged by the City. The recommended changes to the City s General Fees and Charge By-law outlined in this report are aligned with the City s guiding principles of financial stewardship including: Being proactive and innovative in providing cost effective core programs, services and facilities responsive to community needs while living within our means; Focusing attention on critical areas; Making informed decisions that support sustainability; 3

Attachment 1 is the proposed amending General Fees and Charges By-law that reflects the recommended fee changes outlined in this report. 5.1 Public Notification The Notice to the Public By-Law 147-2007 states The Notice to the Public shall be posted on the Notices Pages of the City s Web Site for at least the two-week period immediately preceding the Council or Standing Committee meeting at which the matter will be considered and an opportunity is provided for members of the public to speak to the matter. In accordance with the City s Notice to the Public By-law, notices were placed on the City Page of the June 4, 2014 edition of the Oshawa this Week and Oshawa Express. A copy of the ad, report and draft amending by-law were posted on the City s website on June 5, 2014. 5.2 Administrative Changes to By-law Article 1 (i) of the General Fees and Charges By-law includes a listing of all the schedules included in the By-law. In January 2013, Council approved the transfer of certain Park and Recreation Fees from Schedule B to Schedule B.1 to facilitate a different indexing schedule. Schedule B.1 needs to be added to Article 1 (i) of the General Fees and Charges By-law so that the list of Schedules is comprehensive. As part of the January 2013 review of the Parks and Recreation Fees, the General Fees and Charges By-law was amended to include Article 5.2 (b) which provided rounding parameters for the annual indexing of Admission Rates, Level 1 Memberships and Level 2 Memberships fees to eliminate the need to deal with pennies. In early 2013, the federal government began to phase out the penny from the Canadian coinage system. In response, Council endorsed a policy to round down cash transactions to the nearest five-cent increment effective April 1, 2013. As a result of adopting this policy, Article 5.2 (b) of the General Fees and Charges By-law is redundant and it is recommended that it be deleted. 5.3 City Clerk Services Fees Table 1 outlines the recommended changes to City Clerk Services fees. Justification for the changes is reflected in the table. 4

It is recommended that this fee be included in the amending General Fees and Charges By-law to reflect current practice. Charging for Council and Committee audio recordings ensures the City recovers the costs to provide this service to members of the public. Voters List (Paper Copy) Election Maps The first copy is distributed free of charge. Each subsequent paper copy is $10.00 per ward. The first copy is distributed free of charge. No paper copies will be provided unless requested by a candidate and will be subject to the proposed fees outlined above which reflect the City s cost to provide the lists and maps. Freedom of Information Requests $5.00 As established by the Municipal Freedom of Information and Protection of Privacy Act and regulations thereunder The fee for Freedom of Information Requests is established by the Municipal Freedom of Information and Protection of Privacy Act. The recommended change ensures that the By-law is consistent with the Act. It is recommended that the amendments outlined in Table 1 be included in the amending General Fees and Charges By-law. 5

Based on this review, staff are recommending two changes to the fees as outlined in Table 2. Justification for the changes is reflected in the table. These fees are comparable or below fees charged by Durham lakeshore municipalities. It is recommended that the amendments outlined in Table 2 be included in the amending General Fees and Charges By-law. 5.5 Legal Services Legal Services completed a comprehensive review of the fees included in the current General Fees and Charges By-law. Based on this review, it is recommended that the fees be updated to reflect the cost to provide the service and fee descriptions be modified to provide clarification of fees based on current practices. Table 3 outlines Legal Services Fees in the current General Fees and Charges By-law and Table 4 outlines the proposed changes. 6

Grandview Special Needs - Private Lessons $33.98 (per hour) 8

Council on January 31, 2013, through Report CM-13-12 Recreation and Parks Fees 2013 Update directed amendments be made to Schedules B and B.1 of the General Fees and Charges By-law be made. As part of this review, the fees outlined in Table 6 were erroneously removed from the General Fees and Charges By-law. It is recommended that the fees in Table 6 be included in the amending General Fees and Charges By-law to reflect current practice. Consistent with this direction it is recommended that the following fee outlined in Table 7 be included in the amending General Fees and Charges By-law. Adult Hockey League $5,489.90 (per Team per Season) Table 8 $219.60 (per Team per Game) Adult Hockey League fee adjusted to reflect impact of fluctuation in number of games per season. Rates within Durham Region offered by other municipalities and private organizations range from $200-$250 per game. The Recreation Access Membership Program (RAMP) was introduced in 2006 to provide subsidy to adults with permanent disabilities for access to recreation programs. In 2008, Council approved through Report CS-08-69 Recreation Access Membership Program (RAMP) Proposed Family Membership, the expansion of the program to include Family Memberships. The program allows Oshawa residents who meet the eligibility criteria free access to a Level 1 Membership (leisure swim, leisure skate, walk/run) and a 35% discount on Level 2 Membership (Fitness Centre) and instructional recreation programs. The RAMP fees outlined in the current General Fees and Charges By-law do not calculate exactly to a 35% discount on Level 2 Memberships. It is recommended that the amendments outlined in Table 9 be included in the amending General Fees and Charges By-law. These changes are based on a review of fees charged by comparator cemeteries and reflect the cost to provide the service. Cemetery fees have not been increased since January 2012. It is recommended that the amendments outlined in Attachment 2 be included in the amending General Fees and Charges By-law. 5.8 Municipal Parking System Fees Council on September 28, 2013, through Report CS-09-122 Municipal Parking System- Parking Rates approved amendments to the General Fees and Charges By-law to increase McMillan Parkade monthly fees by 10% annually until the rate charged was identical to the rate charged at the other municipal parkades. Based on the annual indexing of 10%, the McMillan Parkade fee is now equal to the fee charged at the other parkades. The increase to the McMillan Parkade fee is not reflected in the current General Fees and Charges By-law. Consistent with Council s previous direction it is recommended that the fee outlined in Table 12 be included in the General Fees and Charges Amending By-law. The proposed fees reflect the cost to provide fire services. It is recommended that the proposed fee increases outlined in Attachment 3 be included in the amending General Fees and Charges By-law. As part of the fee review, Fire Services identified a new service that is not currently in the General Fees and Charges By-Law. Schedule D.1 is not subject to annual indexing. The City has however been indexing these fees annually and therefore it is recommended that the City s General Fees and Charges By-law be updated to reflect the indexed fees that are currently being charged, and further, that the fees outlined in Table 20 be moved to Schedule D, from Schedule D.1 and therefore, subject to annual indexing.
