Attachment 1 R15-279 BACKGROUND REPORT The property in question consists of three parcels, Tax Map Parcel Nos. 45-78A, 53-5 and 53-5C (Property). The Board is asked to consider revoking a conditional use permit (CUP) which authorizes operation of an auto sales facility located at 239 and 235 Warrenton Road. Tax Map Parcel No. 45-78A is zoned B-2, Urban Commercial, along the frontage of Warrenton Road and M-1, Light Industrial, in the rear. Tax Map Parcel Nos. 53-5 and 53-5C are zoned M-1. Approval of a CUP is required for auto sales in B-2 and M-1 zoning districts. The Board approved application CUP95-02, with conditions, on April 18, 1995 for Tax Map Parcel No. 45-78A (Attachment 3) and application CUP990433, with conditions, on June 1, 1999 for Tax Map Parcel Nos. 53-5 and 53-5C (Attachment 4). Currently, the Property is occupied by an auto sales business operating as the Fredericksburg Public Auto Auction, and has been owned by Navraj Gupta (Property Owner) since 1999. Since September 1999, staff has received ten complaints concerning the Property. The complaints consist of displaying vehicles in the Virginia Department of Transportation (VDOT) right-of-way, working on vehicles outside an enclosed building, and storing junk vehicles on the Property. Inspections were conducted and notices of violation were issued. The violations were abated only to later return. The most recent complaint, received on December, 2014, is a repeat violation of displaying vehicles in the VDOT right-of-way. The conditions also specifically prohibit the parking of automobiles within any VDOT right-of-way. This violation has not been abated and is the reason for requesting that the Board consider revoking CUP95-02 and CUP990433. The conditions of the CUPs state that the CUPs may be revoked by the Board if violations of the conditions occur. The Property Owner has repeatedly violated these conditions. Proposed Resolution R15-279 authorizes the County Administrator to advertise a public hearing to consider revocation of the two CUPs. Virginia Code Section 15.2-2309 requires the Board to hold a public hearing prior to revoking any CUP. Staff recommends approval.
