C. M. RECOMMENDATIONS: 1. Approve the attached Deed of Easement, Temporary Construction Easement and Construction Agreement ( Deed of Easement ) and all the terms therein for Parcel "A", Hurley's Addition to Columbia Forest, 5200 Columbia Pike, RPC# 28-004-008 ( Property ), relating to the Columbia Pike Multi-Modal Utility Undergrounding and Street Improvement Project; and 2. Authorize the Real Estate Bureau Chief, Department of Environmental Services, or his designee, to accept the attached Deed of Easement and all the and any other associated documents, subject to approval as to form by the County Attorney. ISSUES: There are no known issues associated with the approval and acceptance of the Deed of Easement. SUMMARY: The Deed of Easement conveys property interests to the County that are needed to construct the Columbia Pike Multi-Modal Utilities Undergrounding & Street Improvements: Four Mile Run to Arlington/Fairfax County Line (Segment H/I) ( Multi-Modal Project ). The Property is part of the Ali-Mobil Gas Station located at 5200 Columbia Pike. County staff recommends payment of $15,000.00 to the owners of the Property for the Deed of Easement, as compensation for conveyance to the County, by the Deed of Easement, of the Temporary Construction Easements and the Easement for Public Sidewalk, Utilities and Drainage Purposes (collectively, Easements ). BACKGROUND: The Easements are required for the construction of the Multi-Modal Project. The Multi-Modal Project, in its entirety, is planned to transform the full length of Columbia Pike County Manager: ##### County Attorney: ***** 29. into a Complete Street, making it a safer, more accessible route for all users. In addition to the visible street improvements along Columbia Pike, which include wider sidewalks, upgraded traffic signals, new street lights, street trees, bus shelters and intersection improvements, extensive work is occurring below the roadway to replace aging and leak-prone water and sewer pipes and to bury existing overhead utilities underground. The portion of the Multi-Modal Project in front of the Property will underground the public utilities along the frontage of the Property and construct new sidewalk, curb and gutter adjacent to Columbia Pike. DISCUSSION: In exchange for the sum of $15,000.00 in compensation from the County, the owners of the Property have agreed to grant and convey to the County Board, by the attached Deed of Easement, two temporary construction easements designated as: 1) Temporary Construction Easement Area = 661 Sq. Ft.; and 2) Temporary Construction Easement Area = 15 Sq. Ft. on a plat entitled Plat Showing Various Easements on Part of Parcel A Hurley s Addition to Columbia Forest, D.B. 1307, Pg. 34, Arlington County, Virginia, drafted and certified by Nathan A. Orr, Arlington, Virginia, Department of Environmental Services, Engineering Bureau Survey Section and approved by the Subdivision & Bond Administrator on May 19, 2016 ( Plat ), attached to the Deed of Easement. In addition, the owners have agreed to grant and convey to the County Board, by the attached Deed of Easement, an easement designated as Easement for Public Sidewalk, Utilities and Drainage Purposes Area = 156 Sq. Ft. on the Plat. The $15,000.00 is consistent with the value established by appraisals for similar easements in the area. The owners are the owners of the Property by virtue of a deed recorded in Deed Book 2749 at Page 2066 among the land records of Arlington County, Virginia. The Deed of Easement is attached hereto as Exhibit A and the Plat is attached hereto as Exhibit B. FISCAL IMPACT: The $15,000.00 cost for the acquisition of the Deed of Easement is available from the Multi-Modal Project Fund, Account 331.43513.D07S.CT00.0000. - 2 -
