Pay the agreed amounts for the interest in the land and/or the mortgage to be insured. b. Pay the premiums, fees and charges for the policy. c. Documents satisfactory to us creating the interest in the land and/or the mortgage to be insured must be signed, delivered and recorded: 1. Mortgage from TBD and, if any, to TBD conveying the subject property described in Schedule A and attached in Exhibit A. d. Disclose to us in writing the name of anyone not referred to in this Commitment who will get an interest in the land or who will make a loan on the land. The Policy will not insure against loss or damage resulting from the terms and provisions of any lease or easement identified in Schedule A, and will include the following Exceptions unless cleared to the satisfaction of the Company: 1. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public records or attaching subsequent to the effective date hereof but prior to the date of proposed insured acquires, for value of record, the estate or interest or mortgage thereon covered by this commitment. 2. Rights or claims of parties in possession not shown by the public record. 3. Policy Covered Risk 2(c) is hereby deleted. This policy does not indemnify the Insured against any of the following: (a) a dispute over the proper location of a boundary line for the Land; (b) a claim that there is an overlap between the descriptions of the Land and another parcel; (c) a claim of adverse possession or prescriptive easement in the Land; (d) the encroachment of a structure owned by another onto the Land, or of a structure attached to the Land that encroaches onto adjoining land; or (e) a dispute over the area or acreage of the Land, including any dispute about whether or not the Land contains the area, acreage or distances recited in Schedule A of this policy or in any conveyance, survey or map of the Land. 4. Any encroachment, encumbrance, violation, or adverse circumstance affecting the Title that would be disclosed by an accurate and complete land survey of the land. 5. Any lien, or right to a lien, for services, labor or material heretofore or hereafter furnished, imposed by law and not shown by the public record. 6.
