Mosselbaai Munisipaliteit GRASIE VIR VOLDOENING VAN ADVERTENSIETEKENS Die Stadsraad het n grasietydperk van 1 Julie 2015 tot 31 Desember 2015 aan besighede toegestaan om hulle die geleentheid te bied om te voldoen aan die bepalings van die Verordening insake Buitelugreklame en Advertensietekens ten opsigte van die goedkeuring van advertensieborde. Die gewysigde Verordeninge insake Buitelugreklame en Advertensietekens is op 8 November 2013 in Provinsiale Koerant No 7195 afgekondig. n Grasietydperk is tot 30 Junie 2014 verleen om besighede die geleentheid te gee om te sorg dat alle advertensieborde wat voor die geldigheidsdatum van die Verordening op geboue of persele aangebring is, aan die Verordening voldoen. Ingevolge Art 5 van die Verordeninge mag geen teken, behalwe tekens soos omskryf in Art 20(3) en Art 20(15) (hierby aangeheg), vertoon word sonder dat skriftelik toestemming eers by die Munisipaliteit verkry is nie. n Tarief van vier maal die gewone aansoekfooi is in die 2014/2015-tarieflys ingesluit vir versuim om na afloop van die grasietydperk aan die verordening te voldoen ten opsigte van alle advertensietekens wat opgerig is sonder skriftelike goedkeuring deur die Munisipaliteit. Inspeksies het getoon dat verskeie besighede versuim het om die vereiste skriftelike goedkeuring te kry tydens die oorspronklike grasietydperk. Hulle moes dus die viervoudige aansoektarief ten opsigte van elke advertensieborde op die betrokke eiendomme betaal. Na aanleiding van vertoë wat deur die Munisipaliteit ontvang is, is besluit om n verdere grasietydperk van 1 Julie 2015 tot 31 Desember 2015 aan besighede toe te staan ten opsigte van sekere tariewe om aansoek te doen om skriftelike goedkeuring te verkry ten einde aan die Verordening te voldoen. Tydens hierdie grasietydperk sal die viervoudige aansoekfooi nie gehef word nie. n Verdere vergunning is ook deur die Stadsraad aan besighede toegestaan ingevolge waarvan aansoekers tydens die nuwe grasietydperk vanaf 1 Julie tot 31 Desember 2015 net n enkele aansoekfooi vir al die advertensieborde per besigheid, per perseel, hoef te betaal op sekere tekens, pleks van vir elke advertensieteken. Inligting oor die soorte advertensietekens waarop dit van toepassing is, kan by die Munisipaliteit se Afdeling Boubeheer, Munisipale Eiendomme en Buitelugreklame verkry word. Die genoemde tarief per besigheid, per perseel sal na afloop van die grasietydperk streng toegepas word en die normale aansoekfooie per advertensieteken, soos in die Munisipaliteit se 2015/2016-tarieflys, sal geld. Die viervoudige aansoekfooi sal ook gehef word vir alle tekens wat sonder skriftelike goedkeuring opgerig is. Die Raad het ook goedgekeur dat aansoekfooie wat addisioneel gehef is ten opsigte van aansoeke wat in die tydperk 1 Julie 2014 tot 30 Junie 2015 ontvang is, terugbetaal sal word. n Gedeelte van die aansoekfooie sal terugbetaal word aan besighede of persone wat reeds gepenaliseer is deur middel van viervoudige aansoekfooie, asook die aansoekfooi wat gehef is per advertensieteken, per besigheid per perseel, gedurende hierdie tydperk. Art: 20. Vrygestelde Tekens (waarvoor die Munisipaliteit se goedkeuring nie benodig word nie) (1) Indien enige teken wat nie aan die voorwaardes met betrekking tot elke teken tipe wat hieronder gelys word, voldoen nie, word n aansoek ingevolge artikel 5 vereis. (2) Onderhewig aan die voorwaardes met betrekking tot elke tipe teken wat in sub-artikels (3) tot (15) gelys word, en enige ander toepaslike wetgewing, of voor-waarde wat deur die Munisipaliteit opgelê word, word geen aansoek om goedkeuring ingevolge hierdie Verordening ten opsigte van die tekens genoem in sub-artikels (3) tot (15) benodig nie. (3) Te Huur/Te Koop/Verkoop - tekens (c) (d) (e) (f) (g) (h) (i) (j) (k) (l) (m) Die eienaar van n eiendom mag op sy/haar perseel, maksimum twee Te Koop of Te huur tekens binne die grense van die eiendom vertoon. Beide of een van die tekens mag die van n eiendomsagent wees. Te Koop of Te huur tekens mag slegs indien dit nie moontlik is om die teken binne die grense van die eiendom op te rig nie, die teken plat teen die grensmuur bevestig. Dit moet op so wyse opgerig word dat dit veilig en netjies vertoon. n Teken mag bestaan uit n enkele bord, of twee duplikaatborde, slegs wanneer sodanige twee borde met hulle rugkante teen mekaar gevestig is. Teken(s) mag slegs vertoon word vir die primêre doel om die eiendom te verkoop of te verhuur. n Teken vir residensiële eiendom mag nie, 0,3m² in totale oppervlakte en 1m in hoogte oorskry nie. n Teken vir n kommersiële eiendom, of n teken in landbou mag nie 2m² in totale oppervlak, en 3 m in hoogte oorskry nie. Te koop teken mag vertoon word, op voorwaarde dat die teken binne 7 (sewe) dae verwyder word, nadat al alle opskortende voorwaardes van koopooreenkoms nagekom is.. Maksimum een verkoop teken, met die eiendomsagentskap se naam en besonderhede daarop, mag vertoon word vanaf die datum van verkoop tot met registrasie van eiendom slegs nadat die Te Koop- teken(s) verwyder is. Teken(s) mag slegs vertoon word op toepaslike perseel wat Te Koop of Te Huur of Verkoop is Moet vertoon word by, of bevestig word, teen, die toepaslike gebou. Moet vertoon word binne die erfgrens van sodanige perseel. Teken mag nie vertoon word binne die padreserwe of enige gedeeltes van sypaadjies of middel eilande nie. Geen tekens mag n padverkeersteken belemmer of gevaar inhou nie. (4) Besigheidstekens op die perseel Hierdie teken sluit enige onverligte teken in, wat nie oor n openbare pad uitsteek, binne die grense van die perseel en nie 0,5m² in totale oppervlakte oorskry nie, en slegs die soort handel, besigheid, nywerheid of beroep wat wettig onderneem word deur enige okkupeerder of permanente inwoner van die perseel waarop dit aangebring word, die naam van sodanige bewoner, die soort aktiwiteit, die adres en telefoonnommer van sodanige perseel, en die diensure (indien enige) bekend maak, met dien verstande dat slegs een sodanige teken per okkupeerder vertoon mag word. (5) Venstertekens Hierdie tekens sluit enige liggingsgebonde tekens in, wat tydelik of permanent op die vensterglas van n gebou wat vir kommersiële, kantoor-, nywerheids- of vermaaklikheidsdoeleiendes gebruik word, geverf of bevestig is, of enige ander tydelike of permanente teken wat binne 2 meter van enige venster of eksterne opening vertoon word, waardeur dit van die buitekant van sodanige gebou sigbaar is, op voorwaarde dat geen venster teken 4,5m² in n gebied van maksimum beheer mag oorskry nie. (6) Tekens wat integrale deel vorm van die gebou Enige teken wat n integrale deel van die materiaal van n gebou vorm (met uitsluiting van n geverfde teken of n teken wat op enige manier aan die gebou bevestig is) op voorwaarde dat geen sodanig teken 0,2m² in totale oppervlakte mag oorskry nie. (7) Tekens op sportvelde Enige teken binne n sportstadion, wat nie van buite die stadion sigbaar is nie, tot n maksimum grootte van 2m² elk.

(8) Sekuriteitstekens Enige sekuriteitsteken, wat nie oor n openbare pad uitsteek nie, en nie 0,2m² in totale oppervlakte oorskry nie en wat aandui dat n sekuriteitswagskema in werking is of dat n sekuriteitsmaatskappy gekontrakteer is om die perseel, waarop die teken vertoon word, te beskerm, op voorwaarde dat- Maksimum twee onverligte teken per perseel sal toegelaat word, bevestig word teen die gebou, grensmuur, grensheining of hek en mag slegs binne die grense van die perseel vertoon word. Genoemde tekens mag slegs die naam, logo, adres en telefoonnommer van n sekuriteitsmaatskappy vertoon wat gekontrakteer is om die perseel, waarop die teken vertoon word, te beskerm. (9) Kommersieel geborgde tekens en tekens van nie-winsgewende liggame, minder as 4.5m² (10) Advertensies op voertuie (c) (d) (11) Nasionale vlae. Enige onverligte kommersieel geborgde teken of teken van n nie-winsgewende liggaam, wat nie 4,5m² in totale oppervlakte oorskry nie, op voorwaarde dat nie meer as 5% van die totale oppervlakte van die teken vir derdepartyreklame gebruik word nie, en die teken nie verlig is nie en verder op voorwaarde dat slegs een sodanige teken per erf toegelaat word. Advertensies wat aan die bepalings van sub-artikel voldoen moet, wanneer dit op munisipale grond opgerig word, eers opgerig word nadat n ooreenkoms met die Munisipaliteit aangegaan is waarin oor die omvang van die gemeenskaps- of openbare voordeel daarvan en oor die voorwaardes rakende die oprigting van die teken ooreengekom is. Advertensies moet regstreeks op die bak van n gemotoriseerde voertuig geverf of bevestig word. Teken mag nie uitsteek oor die kante van die voertuig of uitsteek aan die bo-kant van voertuig nie. Die primêre doel van die voertuig, mag nie reklame wees nie. Voertuig mag nie geparkeer word vir derdepartyreklame nie Nasionale vlae, so lank as wat niks aan die ontwerp van die vlag bygevoeg word en geen reklamemateriaal op die vlagpaal gehys word nie. (Maksimum: 3 (drie) op n enkel residensiële erf en 6 (ses) of besigheidsperseel) Tekens mag nie binne die padreserwe of sypaadjie opgerig word nie, slegs binne die grense van die betrokke perseel. (12) Veerbaniere Die maksimum hoeveelheid veerbaniere waarvoor goedkeuring nie benodig word nie, is ses. Tekens mag nie binne die padreserwe of sypaadjie opgerig word nie, slegs binne die grense van die betrokke perseel. (13) Advertensies in arkade Enige teken wat vertoon word in n arkade wat nie gemik is op padgebruikers. Dit is tekens wat nie sigbaar is vanaf n openbare straat nie. (14) Tekens wat deur die Munisipaliteit vertoon word Enige teken wat deur die Munisipaliteit vertoon word. (15) Tekens wat deel is van n optog Enige teken wat deur die strate as deel van n optog gedra word.

Mossel Bay Municipality GRACE PERIOD FOR ADVERTISING APPROVALS The Town Council has approved a grace period from 1 July 2015 to 31 December 2015 to afford businesses the opportunity to comply with the Municipality s By-Law on Outdoor Advertising and Advertising Signs in respect of the approval of advertising signs. The amended By-Law on Outdoor Advertising and Advertising Signs was published in Provincial Gazette No 7195. A grace period was given until 30 June 2014 to give businesses the opportunity to ensure that all advertising boards displayed on buildings and properties comply with the By-Law. In terms of Sec 5 of the By-Law, no signs, except for signs described in Sec 20 (3) and Sec 20 (15) (attached) may be displayed without the prior written approval of the Municipality. A tariff of four times the normal application fee was included in the 2014/2015 tariff list for failure to comply with the By-Law after the expiry of the grace period in respect of advertising signs that were put up without the written approval of the Municipality. Inspections have shown that several businesses have failed to obtain written approval by the Municipality during the original grace period. They therefore had to pay the quadruple application fee in respect of every advertising board on the property concerned. Following representations that were made to the Municipality in this regard, it was decided to allow a further grace period from 1 July 2015 to 31 December 2015 in respect of tariffs for businesses to apply for written approval of their signs so that they can comply with the By-Law. During the grace period they will not have to pay the quadruple application fee. Council made a further concession in terms of which applicants will during the new grace period from 1 July to 31 December 2015 just have to pay a single application fee applicable to certain type of advertising signs, per business, per site, instead of for each advertising sign. Information on the types of signs to which this is applicable can be obtained from the Municipality s Building Control, Municipal Properties and Outdoor Advertising Department. The tariff per business, per site will be enforced strictly after the grace period has expired, and the normal application fee per advertising sign as included in the Municipality s 2015/2106 tariff list will apply. The quadruple application fee will also be levied in respect of all signs that were erected without the prior written approval. Council also gave approval for the refunding of application fees that were levied in addition to the normal fee in respect of applications that were received in the period 1 July 2014 to 30 June 2015. A portion of the application fees will be refunded to businesses or persons who have been penalised by way of the quadruple tariff as well as the application fee that was levied per advertising sign per business per site. During the new grace period businesses will also only have to pay a single application fee per business, per site, and not for every sign. Sec. 20. Exempted Signs (for which the approval of the Municipality is not needed) (1) Should any sign not comply with the conditions relative to each sign type listed here below, an application in terms of section 5 is required. (2) Subject to compliance with the conditions relative to each sign provided for in sub-sections (3) to (15), and any other applicable legislation, or condition imposed by the Municipality, no application for approval is required in terms of this By-Law in respect of signs provided in sub-sections (3) to (15). (3) To Let/For Sale/Sold - signs (c) (d) (e) (f) (g) (h) (i) (j) (k) (l) (m) The owner of a property may display maximum two For Sale or To Let signs within the boundaries of the property. Both or only one of such sign may be an estate agent sign. The For Sale or To Let sign may only be attached flat onto the boundary wall, if it is not possible to be erected within the boundaries of the property. It must be affixed in such a manner that it is safe en neat. A sign may consist of a single board, or two duplicate boards, when such two boards are affixed back to back. Signs may only be displayed for the primary purpose to sell or lease property. A sign displayed on residential property may not exceed 0.3m² in total area and 1m in height. A sign displayed on commercial property or in an agricultural area may not exceed 2m² in total area and 3 m in height. A For Sale sign may be displayed on condition that sign is removed within 7 days after all the suspended conditions of the purchase agreement has been conformed. Maximum one Sold sign may be displayed within the boundaries of the property with the name and details of the estate agency, from date of sale to registration of property, with condition that For Sale sign(s) has been removed. Sign(s) may only be displayed on and relate to the property that is For Sale, To Let or Sold. Must be displayed at or affixed against the applicable building. Must be displayed within the boundaries of such premises. Sign may not be displayed in a road reserve or any portions of pavement or road islands. No signs may obscure a road traffic sign, or impose any danger. (4) Business signs on the premises This sign includes any unilluminated sign, not projecting over a public road, not exceeding 0, 5 m² in total area. Only the type of business, industry or profession that lawfully conducted by any occupant or permanent resident of the premises to which it is affixed, the name of such occupant, type of activity, address, telephone number of such business, and service hours (if any); with the understanding that only one such sign per occupant may be displayed within the boundaries of premises concerned. (5) Window Signs These signs include any locality bound signs that are temporarily or permanently painted of affixed to the window glass of a building used for commercial, offices, entertainment or any other temporary or permanent sign which is displayed within 2 meters of any window or external opening from where it is visible from the outside of such building, on condition that no window sign may exceed 4.5m² in an area of maximum control. (6) Signs Incorporated in the building Any sign that forms an integral part of the material of a building (with exclusion of a painted sign or a sign which is affixed to the building in any manner), on condition that no such sign may exceed 0,2 m² in total surface. (7) Signs on sports fields Any sign displayed inside a sports stadium which is not visible from the outside of the stadium, not exceeding 2 m² each. (8) Security signs Any security sign not projecting over a public road, not exceeding 0,2 m² in total area, which indicates that a security guard scheme is in operation, or that a security company that is contracted to protect premises on which the sign is displayed, on condition that- Maximum two unilluminated signs per premises will be allowed, affixed against the building, boundary wall or gate within the boundaries of such premises.

Such signs may only display the name, logo, address and telephone number of a security company that is contracted to protect the premises on which the sign is displayed. (9) Commercially sponsored signs and signs of non-profit bodies, less than 4,5m² Any unilluminated commercially sponsored sign or sign of a non-profit body, not exceeding 4.5 m² in total area, on condition that it does not use more than 5% of the total area of the sign for third party advertising, provided that maximum one such will be allowed per erf/ premises. Advertisements that comply with the provisions of sub-section, may only be erected once an agreement is entered into, with the Municipality wherein agreement is reached regarding the extent of the community or public benefit thereof, and the terms and conditions of erection of the sign have been agreed upon (10) Advertisements on vehicles (e) (f) (g) (h) (11) National flags. Advertisements must be painted or affixed directly on the body of a motorised vehicle. Sign may not protrude above the sides of the vehicle or protrude at the top side of the vehicle. The primary purpose of the vehicle may not be advertising. Vehicle may not be parked for third party advertising. Maximum of three flags per residential property and six flags per commercial property may be displayed for which approval by the Municipality is not required, provided nothing is added to the design of the flag and no advertisement material is added. Flags may only be displayed within the boundaries of premises concerned, not in a road reserve or pavement. (12) Teardrops Maximum of six Teardrops may be displayed for which approval by the Municipality is not required. Teardrops may only be displayed within the boundaries of the premises not inside a road reserve or pavement (13) Advertisements in arcade Any sign that is displayed in an arcade not aimed at road users, which are not visible from a public street. (14) Sign which is displayed by the Municipality. Any sign displayed by the Municipality. (15) Signs that are part of a procession. Any sign carried through the streets as part of a procession.
