BRG Gibson Auctions - CONDITIONS OF SALE 1. The highest bidder shall be the Purchaser, and no person shall retract any bids. The advance on each lot shall be determined by the Auctioneer who reserves the right of refusing any bidding and/or altering, adding to, dividing, consolidating, bidding himself or withdrawing any lot, or lots at the sale. 2. All lots are accepted at the Vendors risk and the Auctioneers shall be under no liability to notify the Vendors of lots not sold. 3. (a) Goods unsold or purchased cannot be removed from the sales yard/hall without a pass for same which can be obtained from the office. All goods must be paid within 24 hours of purchase unless otherwise stated. (b) All goods must be cleared from the premises within 24 Hours of purchase unless otherwise stated. Any goods that are left after the collection deadline shall be charged at 10 plus vat per lot per day and shall be sold without reserve to clear after 5 working days has elapsed without notifying the owner. 4. Vendors and Purchasers are reminded that all goods sold and bought privately in the sale yard must be booked through the Auctioneers Office. All goods sold privately whilst in the sale yard or where it can be proved where seller meets buyer in the sale yard. These transactions must be reported to the office and are subject to the same terms of sale as if sold by auction. 5. The purchaser is required to give their name and address and preregister for the auction depositing any required moneys for a buyers number in order to be able to bid in the auction. Online bidders must be registered 24hrs before the auction begins. (a) Upon failure to comply with these conditions, the money deposited in part payment shall be forfeited, the defaulter paying there out all just expenses and the lot shall be resold by public or private sale and the deficiency (if any) arising upon the resale together with the expenses thereof shall be made good by the defaulter at this sale. 6. All lots are at the risk of the owner and all lots are the sole risk of the purchaser at the fall of the hammer and such lots are to be taken away with all faults, defects and errors of description of whatsoever nature, sort or kind, without power of dispute at risk, and at the expense of the purchaser. At all times the purchase price and commission must be paid on or before delivery and no person shall remove or be entitled to remove any lot until he or she has paid for the whole of the lots purchased by him or her. 7. The Auctioneers shall not be responsible for the corrections, the description or measurement or weight or genuineness or authenticity of any article or lot. Vehicle Odometer readings - the odometer (or the total mileage of a Vehicle if stated to be different from the odometer) if noted as unwarranted for all vehicles, this means that no guarantee is given that the reading is true or accurate. The Auctioneer acts as the agent in any transaction that takes place and shall not be responsible for the correctness or errors in any lots sold. 8. If goods are sold with any form of guarantee it shall be clearly stated at the time of sale, and no guarantee shall extend beyond this. 9. We take no responsibility for loss or damage to any machine, implement, vehicle, equipment or stock in our custody or control. 10. Payment All lots must be paid in full within one working day of purchase NO ACCEPTIONS - We accept the following means of payment Cash Transactions over 1000 carry a 0.7%(plus Vat Sur Charge) Due to anti money laundering regulations we do not accept cash amounts over 5000 - Debit Card No Transaction charge for UK registered cards 3%(Plus Vat Transaction Charge for Non UK - Registered Debit Cards Credit Card 3%(Plus Vat) Transaction Charge - Electronic Bank Transfer No Transaction Charge amounts must be transferred in Pounds Sterling - Bankers Draft No Transaction Charge - WE DO NOT ACCEPT CHEQUES 11.Collection of Lots It is up to the buyer to arrange the collection of any purchased lots. We do not pack or make safe goods for transport this again is up to the buyer. 12. We do not accept any responsibility or liability for any damage or loss to any vehicle, equipment, asset or stock whether entered for sale or not, or any other property which is lost on the premises or to any person who is injured however occasioned. The persons on such premises being deemed to have willingly accepted as theirs all and any risks incidental to being thereon. 13. Since all lots are available for inspection prior to purchase all lots are strictly sold as seen with all faults. 14. The auctioneers can not be held responsible for internet speeds or connections that may affect a bidders ability to bid online. 15. All goods are available for inspection prior to any auction. 16. These conditions of sale apply on any premises on which we may be holding a sale. 17. All purchased lots are subject to auctioneers commission rates will be detailed in the auction catalogue 18. Each sale/auction will have specific terms, conditions unique to that sale these will be detailed in the auction catalogue and must be adhered to. 19. Buyers and/or their agents are responsible for the safe removal of purchased lots. Any damage caused to premises, property or equipment will be repaired or replaced by the person(s) or company responsible. 20. Any persons or their agent who intend to use machinery or equipment for the removal or delivery of any lots must hold the appropriate licence to do so. 21. Persons or their agents must adhere to Health and Safety regulations at all times. ALL PERSON(S) BIDDING OR BUYING IN ANY OF OUR AUCTIONS ARE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO ALL TERMS AND CONDITIONS STATED ABOVE.
