Ordinance No. 18578 was amended by Ordinance No. 21478, passed by the Dallas City Council on November 11, 1992. (Ord. Nos. 10962; 18578; 21478; 24826) SEC. 51P-183.102. PROPERTY LOCATION AND SIZE. PD 183 is established on property generally located on the east side of North Central Expressway, south of Haskell Avenue. The size of PD 183 is approximately 12.6008 acres. (Ord. Nos. 21478; 24826) SEC. 51P-183.103. DEFINITIONS AND INTERPRETATIONS. (a) In this article: (1) FLOOR AREA means "floor area" as defined in Chapter 51. Chapter 51: (4) OFFICE-RELATED USES means the following uses as they are defined in (A) (B) (C) (D) (E) (F) (G) (H) (I) Radio, television, or microwave tower. Commercial radio or television transmitting station. Telephone exchange, switching, and transmitting equipment. Bus passenger shelter. Game court center. Office. Temporary construction or sales office. Bank or savings and loan office (with or without drive-in windows). Medical clinic. (5) TRAFFIC IMPACT STUDY means the traffic impact study for the PDD kept on file in the department of public works and transportation. (6) TRANSPORTATION SYSTEMS MANAGEMENT ACTION PROGRAM means the transportation system management action program kept on file in the department of public works and transportation. (b) Except as otherwise provided in this section, the definitions and interpretations in Chapter 51 apply to this article. References in this article to the "Dallas Development Code" mean Chapter 51. (c) Unless otherwise stated, all references to articles, divisions, or sections in this article are to articles, divisions, or sections in Chapter 51. (Ord. Nos. 21478; 24826) SEC. 51P-183.104. DEVELOPMENT PLAN. Development of the PDD must conform with the development plan (Exhibit 183A). (Ord. Nos. 21478; 24826) SEC. 51P-183.105. LANDSCAPE PLAN. Landscaping must be provided in accordance with the landscape plan (Exhibit 183B). The landscape regulations contained in Article X do not apply to future improvements in the PDD. (Ord. Nos. 21478; 24826)

SEC. 51P-183.106. USES. (a) The only uses permitted in the PDD are office-related uses, mechanical plant uses, residential uses, and retail-related uses. The three low-rise buildings labelled "East LR-1," "East LR-2," and "East LR-3" on the development plan are subject to the following additional use regulations. (b) A minimum of 30,000 square feet of floor area of retail-related uses must be provided on the ground floors of the three low-rise buildings. The ground floor retail-related uses may be divided between the three buildings in any fractional amount. (c) A maximum of 151,000 square feet of floor area of retail-related uses is allowed in the three low-rise buildings combined. The high-rise building labelled "East HR" on the development plan may contain no more than 40,000 square feet of floor area of retail-related uses. (Ord. Nos. 21478; 24826) SEC. 51P-183.107. BUILDING SIZE. (Ord. Nos. 21478; 24826) SEC. 51P-183.108. LOT COVERAGE. Maximum permitted lot coverage in the PDD is 37 percent. (Ord. Nos. 21478; 24826) SEC. 51P-183.109. PAVING. Paving of all streets, driveways, parking spaces, and maneuvering areas for parking must comply with the requirements of the Dallas Development Code, as amended, and all other applicable ordinances and laws. (Ord. Nos. 21478; 24826) SEC. 51P-183.110. PARKING. (a) In general. A minimum of 3,406 off-street parking spaces must be provided in the PDD as shown on the development plan. All required parking spaces must be provided below grade. (b) TSM action program progress reports required. The owner must submit a regular progress report on the Transportation Systems Management (TSM) Action Program to the director of public works and transportation. The progress report must provide detailed information regarding carpool, vanpool, contract buses, transit subsidy programs, or any other program that is identified in the traffic impact study. The first regular progress report must be submitted to the director of public works and transportation within one year following the date of issuance of the certificate of occupancy for the first

building completed in the PDD. A second progress report must be submitted to the director of public works and transportation within two years of the date the first report is due. Additional reports must be provided as required by the city plan commission. (c) Parking demand evaluation and TSM study required. The owner shall conduct a comprehensive parking demand evaluation and a TSM study in accordance with accepted standard methodology approved by the director of public works and transportation, and shall submit a report on the evaluation and study to the director of public works and transportation within one year of the date of issuance of a certificate of occupancy permitting occupancy of an aggregate of 100,000 square feet of floor area of retail-related uses or 1.75 million square feet of floor area in the PDD. If the study demonstrates that the parking demand for the PDD exceeds the supply, the director of public works and transportation shall report the parking deficiency to the city plan commission for consideration of authorizing a public hearing to amend the parking requirements in the district. (Ord. Nos. 21478; 24826) SEC. 51P-183.111. SETBACKS. All structures in the PDD must comply with the setbacks shown on the development plan. (Ord. Nos. 21478; 24826) SEC. 51P-183.112. SIGNS. All signs must comply with the provisions for business zoning districts contained in Article VII, "Sign Regulations." (Ord. Nos. 21478; 24826) SEC. 51P-183.113. PHASING OF DEVELOPMENT. (a) No certificate of occupancy for the East High Rise may be issued until Haskell Mall, east of Central Expressway, as shown on the development plan, is designated as a special community collector, and an additional maneuvering lane is provided in each direction to facilitate ingress and egress to and from the PDD. This special secondary thoroughfare must be landscaped as shown on the landscape plan, and in accordance with the requirements of Section 51P-183.105 of this article. A maintenance agreement must be executed to assure that the landscaping shown on the landscape plan is maintained for no less than 40 years from the effective date of Ordinance No. 21478. (b) No certificate of occupancy may be issued for the East High Rise until the right-of-way necessary for the frontage road of Central Expressway is dedicated. (Ord. Nos. 21478; 24826) SEC. 51P-183.114. TRANSIT STATION(S). The owner must make available, at no cost to the Dallas Area Rapid Transit Authority (DART), location(s) of sufficient area to incorporate DART station(s) within the PDD and within the right-of-way of Central Expressway. (Ord. Nos. 21478; 24826) SEC. 51P-183.115. FACADE TREATMENT. No exterior facade of any building in the PDD may contain highly reflective glass. For purposes of this section, "highly reflective glass" means glass with exterior visible reflectance percentages in excess of 27 percent. Visible reflectance is the percentage of available visible light energy reflected away

from the exterior surface of the glass. (The higher the percentage, the more visible light reflected and the more mirror-like the surface will appear.) (Ord. Nos. 21478; 24826) SEC. 51P-183.116. GENERAL REQUIREMENTS. Development of the Property must comply with all applicable federal and state laws and regulations, and with all applicable ordinances, rules, and regulations of the city. (Ord. Nos. 21478; 24826; 26102) SEC. 51P-183.117. COMPLIANCE WITH CONDITIONS. (a) All paved areas, permanent drives, streets, and drainage structures, if any, must be constructed in accordance with standard city specifications, and completed to the satisfaction of the director of public works and transportation. (b) The building official shall not issue a building permit or certificate of occupancy for a use in this planned development district until there has been full compliance with this article, the Dallas Development Code, the construction codes, and all other ordinances, rules, and regulations of the city. (Ord. Nos. 18578; 24826; 26102) SEC. 51P-183.118. PRIOR OBLIGATIONS NOT CHANGED. Nothing in Ordinance No. 21478, as amended, modifies, alters, or diminishes the owner s obligations and responsibilities contained in Ordinance Nos. 21107 and 18943, or any covenants or agreements resulting therefrom.
