City Engineer/Public Works Director City Engineering/Public Works Department RECOMMENDATON REQUESTED ACTON: Adopt Resolution authorizing a budget amendment for the purchase of a 40-foot Water Line Easement on the Lands of Perdigao (Assessor's Parcel Number 112-080-040) to serve the Wastewater Treatment Facility (WWTF). BACKGROUND DSCUSSON ANALYSS: The Wastewater Treatment Facility Upgrade Project has been under construction since mid-june 2015. A component of the original design was an onsite well, storage and booster pump facilities to provide potable water and fire protection. The well project was originally separated from the larger WWTF Project in an attempt to minimize and control construction costs and risks due to the backlog of well drilling work caused by the sustained drought conditions in California. The "firsf Well Project was advertised for bids and closed on February 19, 2015. The City did not receive any bids. n an attempt to make the project "more attractive" in the sustained drought environment, staff removed the State Revolving Fund reporting requirements and provided significantly more flexibility when the project needed to be completed. The "second" Well Project was advertised for bids and closed on April 23, 2015. For the second time, the City did not receive any bids. On April 28, 2015, the City Council adopted Resolution 15-056 awarding the WWTF mprovements Project to C. Overaa & Co. Through the first several months of the project, Overaa, Stantec and City Staff coordinated to evaluate capital reductions to reduce the overall construction budget. The team evaluated the alternative to bidding the well facility a third time versus exploring an alternative to connect the WWTF water supply to the City's system at the east end of Parkway Boulevard. t was determined that the costs (i.e. lifecycle costs, including capital and annual operations and Page 1 of3

maintenance costs) would be less for the mainline alternative compared to well configuration. n conjunction with the City Attorney's office, staff directed the completion of an appraisal for the value of the easement. Since the 40' Water Line Easement will be coincident with the existing 40' Sewer line Easement (purchased via Resolutions 01-071 and 01-075), the valuation of the new easement, as determined by a certified appraiser, is as follows: 40' WLE Valuation = mproved Land Value/acre x Area Required x 20% (new easement over previously encumbered land) 40' WLE Valuation = $23,000/acre x 1.516 acres x 20% = $6,974 The offer made to the property owner was rounded to $7,000. They have already signed the agreement and returned it to the City Attorney's office, awaiting execution. Per Resolution 03-166, the City Manager and City Engineer have the authority to accept deeds or grants to the City on behalf of the City Council. ALTERNATVES OPTONS: None recommended. ENVRONMENTAL: Acquisition of an easement does not constitute a project under the California Environmental Quality Act. The waterline construction will undergo an environmental review process prior to the commencement of construction. SUBSEQUENT ACTON(S): Execute agreement with owners/representatives of the Lands of Pedigao. Continue negotiations/process with the three other owners/representatives for the remaining 6 parcels. FNANCAL MPACT: The easement acquisition requires a budget amendment consisting of a pro-rata transfer from the Wastewater Operations & Maintenance Fund 305 in the amount of $4,200 and the Wastewater Capital Fund in the amount of $2,800. This acquisition will not be part of the State Revolving Fund reimbursement. The appropriation account will be in the Wastewater Treatment Plant Construction Account 316-122-560150 for $7,000.
