DISCLAIMER FOR ALL CITY OF KISSIMMEE DEVELOPMENT REVIEW APPLICATIONS Important note: The Development Review process associated with this request (as outlined in the attached application) is intended to ensure that the request meets the requirements established in the City of Kissimmee Land Development Code and site development criteria for the City of Kissimmee, and other local, regional and state agencies. It is not intended to constitute approval of building construction or permits as required by external agencies. Other processes, permits, authorizations, and/or fees may be required prior to construction of requested improvements. CITY OF KISSIMMEE LICENSE AGREEMENT APPLICATION FOR OUTDOOR SEATING/DINING Outdoor seating/dining may be allowed as a temporary use by the City Commission if such activity is deemed to be in the best interest of the public. In addition to the license agreement, the requirements for outdoor seating/dining within the right-of-way are as follows: Must be associated with a restaurant or specialty retail establishment as defined in Section 5-3-1 of the City Code of Ordinances having a valid City of Kissimmee Business Tax Receipt (BTR) within the B-1 (Downtown Commercial) zoning district. Tables, chairs and umbrellas must be temporary and not founded to the ground. Tables, chairs and umbrellas must be located in accordance with an approved site sketch and may not be placed in such a manner that obstructs a sidewalk where a pedestrian would have to walk between or navigate multiple sets of tables, chairs and umbrellas as the pedestrian walks down the street. A minimum five (5) foot pedestrian sidewalk clearance shall be provided to the entrance of any business. A minimum five (5) foot wide clear path shall be provided between tables, chairs, umbrellas and any curb, landscaping area, city placed signage, and city placed benches or any other item placed by a governmental entity. Tables and chairs must be kept clean, free of trash and are to be bused in a timely manner. City trash cans may not be used for bussing tables. The tables, chairs and umbrellas shall be the responsibility of the lessee of the tenant space, in front of which tables, chairs and umbrellas are directly located. Once the tenant or the building owner is notified that table, chairs or umbrella is in violation of any standard, said individual will have one hour to correct the situation. If the situation is not corrected, the item in violation will be removed from the City s right-of-way per City Code and may result in possible revocation of the license agreement. The license agreement shall become void at the conclusion of the term indicated on the agreement, if there is a change in ownership or business, or if a valid BTR does not exist for the associated business. A new application must be filed by the new owner and/or business and authorized by the City Commission prior to the outdoor placement of any table, chair and umbrella. NOTE: Fees shall increase annually on October 1, in accordance with the Consumer Price Index for All Urban Consumers (CPI-U), U.S. city average, percentage change from the previous year as determined by the U.S. Department of Bureau of Labor Statistics (BLS). Fees were amended by City Commission on December 15, 2015 by Resolution #34-2015. All requests must be accompanied by a completed application, checklist, fee, plan(s) and any other supporting materials. A sufficiency review will be conducted with 24 hours of submittal. If submittal is insufficient, the request will not be scheduled or distributed for review. Deadline submittal is 4:00 p.m., Friday, in accordance with the City of Kissimmee Schedule for DRC, PAB & City Commission. Late or incomplete submittals will not be accepted. DRC meets every other Tuesday at 8:30 a.m. Checks must be made to the City of Kissimmee and cannot be dated more than 14 days prior to the date of submittal.
