P-17-23 Written Statement Regarding Scope of Project To: Mountain Brook Planning Commission Regarding: Re-Survey of 14 Montrose Circle Dear Planning Commission: This re-survey is designed to remove an easement that was created along the rear lot line of all lots in the Montrose Circle subdivision when the subdivision was initially developed. The easement has never been used by any utility. After the subdivision was created, one of the early owners of Lot 14, acquired two additional parcels and gave back a part of the original lot. The result is the easement that originally ran along the rear lot line, is now in the middle of the lot, and runs under the garage and through the pool. In trying to sell the house and lot, it became apparent that a purchaser wants the easement removed so they can build a new structure, without the hindrance of the easement. The utilities have been notified, and we have received signed releases from: Spire (formerly Alagasco) AT&T Birmingham Water Works Board We have not received a received a release from Alabama Power or Spectrum, but they have been notified and we do expect to receive those. P-17-25 November 3,2017 Mountain Brook Planning Commission Written Statement SES Proposal 2009 Garden Place, Mountain Brook, AL 35223 The 7.2 kw Solar Energy System consists of 25 solar modules mounted in combination on both the.i:lat garage roof and the eastern roof hip leading up from the garage roof. Specifically, the flat garage roof will hold 16 Solar Modules, ballast weighted on racking at a 10-degree angle from the horizontal, as illustrated in the attached drawing. This roof is surrounded by a parapet wall that ranges from 24 to 30" high. No portion of these Solar Modules are visible from any public street. The adjacent eastern facing roof hip will hold 9 Solar Modules, as illustrated in the attached drawing. Only the top portion of the top row of two modules will be visible from one next-door neighbor's house, 2011 Garden Place, located in the back of the development. P-17-25 Petition Summary Request approval for the installation of an alternative solar energy system consisting of a roof mount array. Background Section 129-292 (Use Exemptions) of the Zoning Code specifies that the installation of equipment and minor structures and improvements that are incidental to the provision of and distribution of gas, electricity, water and telecommunications may be permitted in any zoning district, subject to Planning Commission approval. In conjunction with any such approval, the Planning Commission may impose conditions which promote the purposes of the zoning ordinance. On April 4, 2016, the Planning Commission approved Guidelines for Planning Commission Review of Solar Energy Systems. These guidelines are not regulatory but intended for use by the Planning Commission in the review process for alternative solar energy systems. The applicant in the subject case has included these guidelines in his application and has indicated compliance with each item within said document (see applicant s responses in red). Analysis The subject solar panel array is a rooftop array atop a single family residence in Garden Place. The application appears to meet the guidelines established by the Planning Commission with the exception on numbers 5 & 6 (see attached guidelines and applicant responses).
