APPROVAL OF PLANS, SPECIFICATION AND LOCATION OF BUILDINGS In order to insure that the building(s) on the aforementioned land will preserve a high standard of constructions, no building or other structure shall be erected, placed or remain on the aforementioned land until a set of the plans of the working drawings and specification, including a plot plan showing a location of the building(s) or other structures, terraces, patios, walls, fences, driveways, property line, poles and set backs is submitted to the Grantor and approved by the Grantor as meeting the requirements of these restrictions and as being in accordance with the building, plumbing and electrical codes in effect at the time of construction or alteration of any building has begun. Re: PERFORMANCE AND COMPLETION BOND In lieu of posting a performance and completion bond as required by Section 4 Approval of Plan, Specification and Location of Building pursuant to the Declaration of Restrictions for Punta Gorda Isles Section 16, an owner/contractor may request that the Association waive the requirement to post a performance and completion bond so long as the owner/contractor agrees to deposit cash, securities in the amount of $2,500 into a non interest bearing account. Such deposit shall be deposited into a noninterest bearing account which shall be held by a third party as designated the Association. Refusal of approval of plans, specifications and location of building(s) by the Grantor may be based on any ground, including purely aesthetic grounds which in the sole and uncontrolled discretion of the Grantor seem sufficient. Prior to approval of plans, written approval must be obtained from the Grantor for use of the building contractor to be employed in the construction of the above mentioned building(s), or other structures. The issuance of a building permit or license, which may be in contravention of these restrictions, shall not prevent the Grantor from enforcing these provisions. BUILDER/CONTRACTOR AGREEMENT This is to ensure that all adjacent lots, greenbelts, ditches, and roadways remain clean and free of any type of construction debris and materials All contractors performing work in Burnt Store Village hereby agree to the following: 1. Site prep excess dirt must be removed. Storing dirt on Village COMMON PROPERTY, adjoining vacant property, or any Right of Way (ROW) is strictly prohibited. 2. No ditch or swale related to drainage is to be blocked to impede the flow of surface water. Required silt fences must be maintained, mowing and weed trimming of site is expected throughout construction. 3. The Contractor agrees to restore any ROW, greenbelt, common area or adjoining property on which it, or its subcontractors, has impacted in any way. Construction vehicles may not park or drive on adjoining vacant private property without the permission of the owner. 4. The Contractor will maintain a clean, secure, and safe work area free from construction debris. All construction sites must have dumpster located within the boundaries of the building site and emptied when full to prevent debris from blowing into adjoining property. No wire cages or wood boxes allowed. 5. Plastic water bottles, coffee/beverage cups, snacks, and lunch debris removed daily to discourage scavengers looking for food. 6. If severe weather warning; all construction material, including the port a potty must be secured. 7. Electrical wires must be underground from pole to house. 8. Contractor will be notified of any violation, and compliance is expected in a timely manner. Note: At the sole and uncontrolled discretion of the Grantor a performance and completion deposit may be required to insure against the possibility of an applicable cost of any corrective violations against the builder. Builders/Contractors please read and sign the following CLEAN SITE POLICY document related to a policy requiring a $2,500 refundable deposit for the repair of any damage not addressed after a notice from the Association. Deposit will be refunded upon receipt of a Certificate of Occupancy and sign off on an on site inspection. 4
BURNT STORE VILLLAGE POA SECTION 16 CLEAN SITE POLICY Effective May 16, 2018 all building/construction applications to build in Burnt Store Village (Section 16) will require a SEPARATE CONTRACTOR refundable deposit of $2,500 attached to a signed copy of the BUILDER AND CONTRACTOR AGREEMENT. Without all forms, survey, deposit, and a full set of construction plans submitted, approval requests will not be reviewed. The refundable deposit will be placed in a non interest bearing account. Upon receipt of a Certificate of Occupancy and a final on site inspection, the full deposit will be refunded A full deposit is not refunded when a CONTRACTOR is notified via telephone, email, or fax of a violation of the signed agreement, and a request to correct the problem upon such notice the Association will make arrangements to hire someone to bring the violation into compliance. The CONTRACTOR will be informed (in writing) of the corrective action and the cost against the deposit. This policy has been adopted to ensure that construction impacting Burnt Store Village adjacent private property, greenbelts, drainage ditches, and roads remain free from preventable damage. Contractor could be liable for additional expenses resulting in damages to adjoining lots or roadway that are in excess of the $2,500 Clean Site Policy deposit. MAIN CONCERN: Burnt Store Village does not have a storm sewer system. All water leaves the Village by way of swales and culverts. Any damage to the system causes surface water to back up into driveways and the right of way. Blocked and damaged swales prevent the surface water from exiting the Village as intended by the Burnt Store Village Street and Drainage Project. (BSVPOA) OWNER ACKNOWLEDGEMENTS A comprehensive landscaping plan shall be submitted to the Grantor for his approval and a sufficient number of trees and shrubs of sufficient size shall be shown thereon in a design which shall be commensurate with the development of high grade residential property. A basic landscaping plan will include the front elevation of the home, front accent trees, and rear yard plantings. A copy of the front elevation may be used, or a copy of the site plan. *Comprehensive landscaping is not to be confused with Charlotte County Tree Code. I (we) hereby acknowledge that I (we) am aware that the approved landscaping is required to be installed with in ninety (90) days after receipt of a Certificate of Occupancy by Charlotte County. The Villages current residents are made up of retires, young families and singles. In 1994, PGI turned over the affairs of the Village to the Burnt Store Village Property Owner s Association (BSVPOA) to manage the Village and maintain deed restrictions. The Property Owner s Association activities are managed by an elected Board of Directors. At the annual meeting in October, owner s meet to elect the board of directors, and approve the next operating budget. The Board of Directors is committed to responsible fiduciary control over the Association s finances and enforcing deed restrictions. 6
