This is expensive commercial property. Even though you would not be acquiring much in fee, you must consider that the R/W estimate reflects not just the cost of the land, but also reflects the various administrative costs necessary for acquisition. We would need approved right of way plans suitable for public display, negotiations, and recordation. If there is any way that the Residency can deal with the landowners to secure a donation of the needed right of way, we recommend that this be the first option explored. CHRIS BURKE, R/W

The county is obtaining from the 3 property owners a Permanent Traffic Signal Easement instead of purchasing R/W to minimize cost. Traffic Engineering met with a Dominion Power field representative, & the cost for electrical service is approx. $5,200. This consists of the power coming from the closest point, which is the existing signal at the Lowe's entrance, boring under Koger Pkwy., and trenching along the south side of Koger Pkwy. up to the new signal location in the southwest corner (shopping center). I assume that, once we hear back from the county regarding any easements obtained or the need to purchase R/W, an updated estimate could be performed. For estimate purposes, the signal installation will cost approx. $145,000, with an additional PE cost of approx. $5,000. WAYNE HOLT, TE
I understand your hesitancy in locating the poles on the north side prior to having an approved site plan which incorporates Mall Drive extended. Jesse Smith will need to know exactly what you all need for the signal so that it can be reflected on the site plan and recorded. Please let me know if this schedule will not work for VDOT. For the southeast quadrant, I believe we will need from VDOT a plat of the required easement for recordation (and to show the developer when requesting the donation). Southeast and southwest quadrants - We discussed providing plats showing the necessary easement areas with our R/W & Survey Sections, and they can accommodate this, however, they did have a good suggestion. Before we begin to gather the required information (Metes and Bounds) & draw up a plat using project funds, maybe our preliminary sketch of the easement area for both of these quadrants could be shared with the property owners to get their verbal concurrence & then proceed with the plat work. Proposed N. leg of intersection - Again, hopefully our preliminary drawing could be discussed with the property owner and then shown on their site plan. If additional information was required, at least we would know that they are in agreement with our proposal. WAYNE HOLT, TE
Dedication is not necessarily a fast fix to this problem. If the property owner dedicates land to the Commonwealth, Right of Way will not accept that dedication unless we have proof by title examination that the property owner has clear title. If there are deeds of trust or encumbrances on the property, partial releases must be obtained for the area being dedicated before the deed is executed. We only accept fee simple title. Also, there must be environmental clearance for the area being dedicated. If you already have environmental clearance on this small project, then that will suffice. Also, the deed of dedication must be approved by the AG s office. So it isn t necessarily a fast fix. If we go with an easement, we are obtaining a right to use the property for a specific purpose. BE SURE TO INCLUDE LANGUAGE IN THE EASEMENT AGREEMENT FOR THE TOWNE CENTER, AS REQUESTED. ONCE YOU SEND ME THE PLATS AND AGREEMENTS, I CAN ROUTE THEM TO THE APPROPRIATE PARTIES FOR EXECUTION.
