CURRENT PLANNING Carol McFarlane, AICP, Planner II October 2, 2013 Current Planning staff has reviewed the requested submission and provides the following comments: 1. Per Section 72-612, table II, Rural Development Requirements, right-of-way for publicly maintained rural roadways must be a minimum of 70 feet wide. If Collins Grove Road is a publicly maintained roadway, 25 feet of additional right-of-way will need to be dedicated to the County of Volusia. 2. The A-2 zoning classification requires a lot width of 150 feet. The proposed eastern lot does not meet the minimum 150-foot lot width at the front building line as measured 50 feet from the proposed front lot line. The lots will need to be rearranged to meet this requirement, or a variance to the minimum lot width must be approved through the Planning and Land Development Regulation Commission. 1

DEVELOPMENT ENGINEERING Joe Spiller, Civil Engineer II October 2, 2013 A review by this office of the above named submission indicates that the following comments should be addressed prior to the Overall Development Plan approval. The applicant is requested to respond to all comments in writing and make all necessary revisions prior to the next submittal. 1. The parcel is a legal lot. 2. FEMA Flood Insurance Rate Maps indicate that the entire site is located within a Zone X designation; areas determined to be outside of the 500 year floodplain. 3. The portion of Collins Grove Road abutting the proposed project is classified as a County maintained prescriptive dirt local roadway. The site falls within a Rural Land Use category and is within 2 miles of a school. 4. Per LDC Sec. 72-612(a), primary access to a subdivision or development shall be from a street paved to the standards of Division 4. This street, if not already paved, shall be paved by the developer from the entrance of the development to the nearest public paved street. Per LDC Sec. 72-612(g)(1), every lot or parcel shall have access from a publicly dedicated street. 5. Per LDC Sec. 72-777(b)(1)h, subdividing of lands into four (4) lots or less, each being one (1) acre or larger in size where no new paved streets are proposed is exempt from the requirements of Division 8, Stormwater Management. The subject proposal appears to be for a total of two (2) lots, all of the lots being greater than one (1) acre in size. The proposed subdivision is exempt. 2

ENVIRONMENTAL PERMITTING Danielle Dangleman, Environmental Specialist III September 27, 2013 Environmental Permitting has reviewed the Overall Development Plan Application for. Environmental Permitting has no objection to the approval of this project and offers the following comment: 1. Any future construction and/or clearing on the proposed lots will need to meet the environmental provisions of the Land Development Code. LAND DEVELOPMENT Jesse Bowers, Land Development Assistant September 27, 2013 Land Development staff has reviewed the requested submission and provides the following comments: The subject parcel is Lot 15, Assessor's Beresford, MB 16, Page 57. Per the plat, the subject lot does not have legal access; however, access to this parcel is via Collins Grove Road, a dirt, County maintained roadway. A single family residence exists on this lot. The proposal is to extend an easement from the maintained road to the proposed new parcel. SOILS Dave Griffis, County Extension Director September 27, 2013 As requested I visited the site. Soils were found to be: 1. #1 Apopka fine sand, 0 to 5 percent slopes. This nearly level to gently sloping well drained soil is on intermediate to high sand hills. The water table is usually below a depth of 72 inches. This soil has a high potential for community development. 2. A portion of the property has been developed. SURVEY David Kraft, County Surveyor October 3, 2013 Survey staff has reviewed the requested submission and provides the following comment: Beresford Road is a paved road with a 50' R/W, and Collins Grove Road is a dirt Road maintained by the County. This survey will need to show and describe, with legal descriptions and acreages, the parent tract and the newly created lot(s). 5
