A-6, Council made the following appointments: NAME TERM OF APPOINTMENT Isabelle Christian 13 June 2009 Stratford to (reappointed) 13 June 2011 Marcia Enman 17 June 2009 Wellington to (vice Jane Boyd, resigned) 13 June 2012 Further, in accordance with section 7 of the said Act, Council appointed Isabelle Christian as chairperson for the duration of her term and Andie Bulman as vice-chairperson, effective 13 June 2009 and for the balance of her term as a member, expiring 31 December 2010. EC2009-303 ELECTRIC POWER ACT CITY OF SUMMERSIDE ELECTRIC UTILITY ANNUAL ASSESSMENT DETERMINED Pursuant to clause 46(2)(a) of the Electric Power Act R.S.P.E.I. 1988, Cap. E- 4, Council determined the assessment to be paid by the City of Summerside Electric Utility to the Island Regulatory and Appeals Commission for the 2009-2010 fiscal year to be twenty thousand dollars ($20,000.00).

237 EC2009-304 EXECUTIVE COUNCIL ACT MINISTER OF AGRICULTURE AUTHORITY TO ENTER INTO AN AGREEMENT (AMENDMENT NO. 2 TO THE CONTRIBUTION AGREEMENT FOR THE 2008 POTATO ASSISTANCE PROGRAM) WITH THE GOVERNMENT OF CANADA Pursuant to clause 10(a) of the Executive Council Act R.S.P.E.I. 1988, Cap. E-12 Council authorized the Minister of Agriculture to enter into an agreement with the Government of Canada, as represented by the Minister of Agriculture and Agri-Food, to amend the Contribution Agreement for the 2008 Prince Edward Island Potato Assistance Program, to amend the program parameters and extend the program deadline, such as more particularly described in the draft agreement. EC2009-305 FINANCIAL ADMINISTRATION ACT SPECIAL WARRANT (SUPPLEMENTARY CAPITAL EXPENDITURE FOR FISCAL YEAR 2008/09) DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS Pursuant to subsection 37(1) of the Financial Administration Act R.S.P.E.I. 1988, Cap. F-9, Council ordered that a Special Warrant do issue authorizing a supplementary payment out of the Capital Fund for the Department of Transportation and Public Works as follows: Account Class Account Name Amount Strategic Highway Improvement Projects 0371-05010 Professional Services $506,400.00 Further, Council noted that this amount will be fully offset by revenue from the federal government under the terms of the Memorandum of Understanding with the Public Transit Capital Trust Fund. EC2009-306 HOLLAND COLLEGE ACT APPROVAL TO INCUR A LIABILITY Pursuant to clause 11(1)(b) of the Holland College Act R.S.P.E.I. Cap. H-6 Council authorized the Board of Governors of Holland College to incur a liability and to make expenditures by borrowing an amount not to exceed eight million, five hundred thousand dollars ($8,500,000.00) for establishment of a Centre for Applied Science and Technology at Holland College Charlottetown Centre.

L-5 Council granted permission to Ocean Capital Investments RPE Limited of Saint John, New Brunswick to acquire a land holding of approximately ninety-eight decimal three four (98.34) acres of land in Lot 6, Prince County, Province of Prince Edward Island, being acquired from Irving Oil Limited of Saint John, New Brunswick SUBJECT TO the condition that the said real property not be subdivided. The condition preventing subdivision shall be binding on the said Ocean Capital Investments RPE Limited and on all successors in title. EC2009-320 QUINN S CONTRACTING LIMITED R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Quinn s Contracting Limited of Parrsboro, Nova Scotia to acquire a land holding of approximately fifty (50) acres of land in Lot 62, Queens County, Province of Prince Edward Island, being acquired from David Kennedy of Charlottetown, Prince Edward Island. Further, Council noted that the said land holding, being Provincial Property No. 654640, was previously identified for non-development use in accordance with section 2 of the Land Identification Regulations (EC606/95) made under the said Act. Identification continues to apply. EC2009-321 ULTRAMAR LTD. R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Ultramar Ltd. of Montreal, Quebec to acquire, by lease, an interest in a land holding of approximately one decimal one five (1.15) acres of land in Lot 17, Prince County, Province of Prince Edward Island, being acquired from Island Petroleum Products Ltd. of Summerside, Prince Edward Island.

243 EC2009-322 W.I.N. HOLDINGS INC. R.S.P.E.I. 1988, Cap. L-5 Council granted permission to W.I.N. Holdings Inc. of Charlottetown, Prince Edward Island to acquire a land holding of approximately zero decimal six one (0.61) acres of land in Lot 34, Queens County, Province of Prince Edward Island, being acquired from Erin Jeffrey of Charlottetown, Prince Edward Island. EC2009-323 UNIVERSITY ACT UNIVERSITY OF APPROVAL TO INCUR A LIABILITY Pursuant to clause 17(1)(b) of the University Act R.S.P.E.I. 1988, Cap. U-4 Council authorized the Board of Governors of the University of Prince Edward Island to incur a liability and make expenditures by borrowing an amount not exceeding two million ($2,000,000.00) dollars to fund replacement and upgrading of aging infrastructure including sewer, heating, wiring, utility tunnels and pathways.
