Authority: Executive Committee Item 11.6, as adopted by City of Toronto Council on October 24 and 25, 2011 Enacted by Council: November 29, 2012 CITY OF TORONTO BY-LAW No. 1634-2012 To authorize the entering into of an agreement for the provision of municipal capital facilities and an exemption from taxation for municipal and school purposes for the municipal capital facilities for affordable housing located on various properties owned by the Toronto Community Housing Corporation, and to amend By-law No. 1413-2011. WHEREAS City of Toronto By-law No. 282-2002, A Municipal Housing Facility By-law provides that the City may enter into agreements for the provision of affordable housing as a municipal capital facility and that the City may exempt, from taxation for municipal and school purposes, land or a portion of land on which an affordable housing facility is or will be located; and WHEREAS the Council of the City of Toronto approved an exemption from taxation for municipal and school purposes for all housing units within the various affordable housing projects operated by Toronto Community Housing Corporation ("TCHC") located at the premises described in Schedule "A" hereto (the "Premises"); and WHEREAS the Council of the City of Toronto has authorized the City to enter into a municipal capital facility agreement with the TCHC, setting out the terms and conditions of exemption from taxation for municipal and school purposes for the Premises; The Council of the City of Toronto HEREBY ENACTS as follows: 1. (1) The City of Toronto is authorized to enter into an agreement under section 252 of the City of Toronto Act, 2006 with TCHC for the provision of municipal capital facilities for affordable housing at the Premises which meets the requirements of By-law No. 282-2002 (the "Agreement"). (2) The land and municipal capital facilities of the Premises shall, subject to subsection 1(4), be exempt from taxation for municipal and school purposes while this by-law is in force and so long as the Premises are used as a municipal capital facility, namely as affordable housing. (3) The tax exemptions referred to herein shall be effective from the latter of the date the Agreement is entered into, and January 1, 2013. (4) Section 1 of this by-law shall be deemed repealed: (a) if TCHC ceases to occupy the Premises without having assigned the Agreement to a person approved by the City in accordance with the Agreement;

2 (b) (c) if TCHC or its successor in law ceases to use the Premises for the purposes of affordable housing in accordance with City of Toronto By-law No. 282-2002; and/or if the Agreement is terminated for any reason whatsoever. 2.
