NOW, THEREFORE, pursµant to Minnesota Statutes 414.0325, be itjojntly RESOLVED and agreed by the City Council of the City of Waconia and the Board of Supervisors of the Township of Waconia, Carver County, Minnesota, as follows: 1. Thts Joint ~esolutiqn provides for the ccmdltions Qf annexation. No alteration pf the stated boundaries are appropriate., and no consideration by the chief adnihiistrative law judge is nec::essary. The chief administrative ]aw judge may review and comment, but shail., within 30 days, order the annexatio11 In ~ccordancewith the.terms of this resoll,!tion. 4. There will be no change in the electric service or cost resulting from the annexation. 5. That for purposes of real estatetaxatio.n, ifthe annexation becomes effective on or before August 1 of a i.evy year, the City pf Waconia m~y revy on the annexed area beginning with the s:ame levy year. lf the annexation becomes effective after August.1 of a levy year, Waconia Township mc;1y continue t~ levy on the annexed area for that levy year, and the C"ny ofwaconia may not levy on the annexation area until the following levy year, 6. Pursuant tq Minnesota Statutes. 414.036, the City and the Township agree that the road sagn,ents described on Exhibit A and depicted on Exhibit B are tax cexempt and no tax reimbursement is.due from the City to the Township. 7. There are no special assessments assigned by the Township to the Land and no debt incurred by thetownship prior to the annexation and attributable to the Land need tq be re.imbursed. 8. To the extent that the annexation areas contain streets or roadways, the City shall b:e $0lely responsible for any maintenance or improvements after the arin.exation has been ordered. 9. The City and Township agree that in the event there are l'.!rrors, omissions or any other problems withthe legal descriptions provided In 1:xhlblt A or mapping provided in Exhi:bit B) in the Judgment of the. Office of.administrative Hearings/Municipal Boundary Adjustments, the City ancl Township agree to make suc:h correctlons and file any addltlonal documentation, including new exhibits making the.r;:orre~ions requested or required by the Office of Administrative Hearings/Municipal Boundary.Adjustments as n~sary to make effective the annexation of the Land in agtordance with the terms of this Joint Resolution. 10. Th1s Joint Resolution is effective upon approval and adoption by boththe City Coundl of the City of Waconia and the Board of Supervisors.of the Township of Waconia. 2
