TENURE The property is offered for sale freehold with vacant possession upon completion; with the exception of the telecommunications mast site which is currently subject to a lease. BASIC PAYMENT SCHEME The land has been registered and is sold with the benefit of 123.02 Normal, Non- SDA entitlements to receive payments under the Basic Payment Scheme. The Vendor has claimed the 2015 and 2016 Basic Payment Scheme and will make future Basic Payment Scheme applications as appropriate to maintain active usage of the entitlements. WOODLAND GRANT SCHEME Land parcels 1209 and 9440 (identified as 30 and 31 on the enclosed plan) are entered into an English Woodland Grant Scheme Agreement, specifically a Woodland Regeneration Grant, which commenced in December 2013. Further details of the agreement are provided in the Farm Information Pack. PLANNING Moor Leazes Farmhouse is subject to an Agricultural Occupancy Condition which specifies that occupation of the dwelling shall be limited to a person employed or last employed in agriculture as defined in Section 290(1) of the Town and Country Planning Act 1971 or in forestry, or a dependent of such a person residing with him (but including a widow or widower of such a person). TELECOMMUNICATIONS MAST Moor Leazes Farm incorporates the site of a telecommunications mast which is currently let to Cornerstone Telecommunications Infrastructure Limited (CTIL) by virtue of a Lease dated 13 th March 2007. The current rent passing in respect of the mast is 3,500 per annum, with the existing lease due to expire on 12 November 2016. However, negotiations regarding a potential new lease with a revised rent are currently underway. The Purchaser will take over the Landlord obligations of the Lease, in so far as they are capable of being performed, upon completion. SPORTING RIGHTS The sporting rights are included, save for those reserved to the Lord of the Manor of Lanchester by the Law and Property Act 1922. MINERAL RIGHTS The mines and minerals together with the ancillary powers of working the same, are excluded from the sale. CLAWBACKS & RESTRICTIVE COVENANTS Moor Leazes Farm is subject to a number of restrictive covenants which relate primarily to historic Coal Board matters affecting the land as well as the 32kW Tower line electricity apparatus which is installed on the farm. Field parcels 0711, 9032, 6924, 9106, 0885, 1593 and 3666 (shown as fields 18-23 and 25 on the enclosed plan) are subject to a 20 year clawback provision which commenced on 30 th March 2015. The clawback provision would be triggered on receiving planning consent for wind power generation or residential development, wherein the amount payable would be 50% of the uplift in value arising from the grant of planning permission, which would be payable either on disposal or upon implementation of any planning consent.
