The roll was called as follows: PRESENT: Mr. Fandal, Mr. Ballantine, Mr. Schneider, Mr. Brookter, Mr. Gordon, Mr. Guidry and Mrs. Thomas. ABSENT: N/A STAFF PRESENT: Mrs. Riles, Mrs. Lambert APPROVAL OF THE MINUTES Moved by Mr. Brookter and seconded by Mr. Schneider to accept the November 7th, 2018 minutes. PUBLIC HEARINGS MOTION CARRIED UNANIMOUSLY BOA CASE NO. 20181294BOA Request by applicant for a waiver a portion of the required 10 foot side yard greenspace area and to encroach 3.9 feet over the property line, within the adjacent required 10 foot side yard greenspace area, to allow for the construction of a 450 square foot outdoor seating area. The property is located at 13130 Highway 1085, Suite 105, Covington, Louisiana. Applicant & Representative: Copperstill Development LLC & CV Copperstill, LLC Mike Saucier (Mrs. Lambert read the staff report into the record...) Applicant Mr. Mike Saucier: identify himself as present for the request on behalf of WOW Café and Wingery, gave a description of the reasons for the request: to allow for a 450 square foot covered outdoor seating area to be placed within the required side yard/greenspace and to encroach over the abutting side yard greenspace area. Patio is part of the proposed restaurant business model, and will provide additional seating and an area to facilitate pick up orders. Marc Verges, Partner in Company: Described the importance of the patio for the restaurant and for the community. Patio is an integral part of the restaurant and allows for outdoor special events. It will have a large impact on the community. Steve Ballard, Owner of Company: Brand new restaurant model for WOW Café and Wingery. It is the first one in St. Tammany Parish. Patio is needed for the sports cormnunity and as a training space. 1

Mr. Fandal: Question the legality of approving v?rianc.qve,r the property line. Mrs. Lambert: Not prohibited but could create precedent. Mrs. Riles: Answered Mr. Fandal s question: Not prohibited but could create precedent. Mr. Schneider: Asked Mr. Saucier if he has a copy of the attachment referred in the letter submitted with the application form, in regards to the approval from Rouses. Mr. Saucier: We do have approval from Rouses. We can provide copy of the agreement. Mr. Schneider: Would it be possible to move the property line? Mrs. Lambert: Property line could be moved; however, moving the property line would not eliminate the need for a variance. Mr. Saucier: We could execute a servitude to allow to have the patio over the property line. Mrs. Riles: Servitude can be created and recorded; however it is a civil question between property owners. Moved by Mr. Gordon and seconded by Mr. Schneider to approve the requested variance. STAFF COMMENTS The request is to allow for a 24 feet X 90 feet accessory building. The building is proposed to have a 60 foot long open carport and an attached 30 foot long enclosed storage shed (See attached drawings). The purpose of the carport is to provide a cover for personal vehicles and a motor home and the purpose of the attached shed is for a small workshop and personal storage area. Although the proposed structure does not violate the required setback nor exceed the maximum allowable size of an accessory buildings (7.5 percent of the area of the lot on which the main building), staff is not in favor of the request, considering that no hardship or practical difficulty is being demonstrated. Moreover, the support or granting of such variance request may result in the establishment of a precedent in the parish.

Box 628 Covington, La 70434 Re: 128 Rue Holiday, French Branch Subdivision, Slidell, LA request for variance on accessory building. I am requesting a variance to be allowed to build one, ninety by twenty four foot building on my property. This building will have sixty feet of open carport with a thirty foot enclosed shed/storage building at its rear. See attached stamped plans of said purposed structure. The building will only be approximately 4.95% of the total square foot of my property. The property is just over one acre in area. The building will have the same/matching exterior material as was used on the house, which is and will be the only other building on the property. The carport will only be used for parking family vehicles and one 45ft. Motorhome, and all vehicles will be used strictly for personal and pleasure purposes The shed will be a small workshop and storage area, again to be used for personal use only. Under current rules I can build two separate buildings totaling the same square footage, but my request is to build one building which will make a more aesthetically pleasing landscape.
