FOREWORD The sale at Nearton End Farm is a result of Adrian Ford and family deciding to make the move to a larger holding in the West Country. The farm is currently on the market with agents Fisher German along with the usual farm implements the sale includes the reminants of Adrians former business as an agricultural engineer. LOCATION To the sale signs will be put up on the morning of the sale. VIEWING OF LOTS Strictly on the morning of the sale or by prior arrangement with the auctioneers. MOVEMENT OF GOODS Removal of items - all items to be removed from the site on the day or by negotiation with the auctioneers. REGISTRATION OF BIDDERS Potential purchasers must have a bidding number prior to the sale. Purchasers already registered with the market may use their existing account number. New purchasers must obtain a bidding number on the day of sale supplying name, address, postcode and contact details. PAYMENT Payment is strictly on the day of sale, unless discussed with auctioneers prior to the day. Cheques (supported by a Guarantee Card) or Cash up to the limit of Three Thousand pounds sterling ( 3,000.00). Debit and Credit Card facilities are available at the mobile sales office. CONDITIONS OF SALE 1. All prospective purchasers to make themselves known to the auctioneers prior to sale time, giving their full name, trading title, address and contact numbers. 2. No cash transactions over 3,000 sterling will be accepted. Payment may be made by debit, credit or cheque with a guarantee card. 3. All descriptions either written or verbal are a guide only. The auctioneers and vendors will not be held responsible for the accuracy of any description. Prospective purchasers must satisfy themselves of all descriptions. 4. All lots are SOLD AS SEEN and any descriptions given in this catalogue are for guidance purposes only. Specific warranties may be given verbally by the auctioneer at the time of sale. 5. The auctioneer as agent of the vendor reserves the right to bid up to the reserve price where set on any lot. 6. The auctioneer shall determine the bidding and can refuse a bid at his discretion. The auctioneer shall also reserve the right to determine the purchaser in any dispute of re offer the lot. 7. At the fall of the hammer the PURCHASER will take full responsibility for the lot. The lot may not be removed from the premesis before the payment is made, (unless a prior agreement has been made with the auctioneer). 8. No lot shall be removed from the sale premesis without a PASS OUT obtained from the auctioneers pay office. 9. Failure on behalf of the purchaser to pay for any lot/lots will result in a resale, any deficit or costs incurred will be the responsibility of the original purchaser. 10. Value Added Tax will be charged on all deadstock unless otherwise stated. 11. The vendor and the auctioneers as vendor s agent retain all titles in any lot until all purchase monies have been paid in full. Outstanding monies will be charged at an interest of 4% above banking lending rate. 12. The transfer of lots from the purchaser to a third party will be accepted. However, the original purchaser shall remain responsible for any non-payment. 13. All persons entering the sale ground do so at their own risk and with notice of the condition of the premesis and their contents. 14. All persons entering the sale ground are hereby made aware that there are significant risks on the sale ground including moving machinery and equipment; caution should be exercised at all times and children must be fully supervised at all times. 15. All persons entering the sale ground must take notice of all specific health and safety notices on display at individual sites. If in doubt, please consult the auctioneer in charge. 16. Any accidents or incidents that occur on the sale ground must be immediately reported to Thame Farmers Auction Mart Ltd and details recorded in the accident book. 17. No powered machinery or equipment should be started without the prior approval of the auctioneers. 18. No vehicles are permitted on the sale ground during the sale. Any vehicles brought onto the sale ground to collect lots should be operated with extreme caution and within a 5mph speed limit. 19. The auctioneers shall have the right at their discretion to refuse admission to their premesis or attendance at their auctions 20. The purchaser of any vehicle or trailer is responsible for complying with all legal requirements as to the construction and the use of such vehicle or trailer and for obtaining all certificates, permits or other authorisation necessary before such vehicle or trailer can be used on the road. 21. The purchaser of any lot is responsible for complying with all legal requirements as to the safe use of lots purchased at the sale and shall ensure compliance with all relevant legislation relating to the safe use of such lots. 22. The purchaser will be deemed to have inspected any lot and will be solely responsible for ensuring that the lot complies with the Health and Safety At Work Act 1974 and in particular Sector Information Minute 01/2006/03 as issued or subsequently amended by the Health and Safety Executive or subsequent governing body prior to commencing use or work with such lots. 23. The purchaser will provide if requested the vendor or auctioneer acting as agent on behalf of the vendor a written undertaking pursuant to Section 6 (8) of the Health and Safety at Work Act 1974 to confirm that all duties under Sections 6 (1)(a) or 6 (1a) of the Health and Safety at Work Act 1974 have passed to the purchaser at the fall of the hammer.
