DATE: October 2, 2012 RECEIVED October 3, 2012 Page 1 of 2 VAUGHAN COMMITTEE OF ADJUSTMENT TO: Todd Coles, Committee of Adjustment FROM: Grant Uyeyama, Director of Development Planning Development Planning Department MEETING DATE: October 11, 2012 OWNER: Royal 7 Developments Ltd. FILE(S): A308/12 Location: Proposal: 2900 Highway 7, Vaughan Ward 4, Vicinity of Highway 7 and Jane Street The Owner is requesting permission to construct a 37-storey residential apartment (future condominium) building, located on a podium ranging in height from one to five storeys, with the following variances: Variance Proposed Required 1 Location of Building 1 (Tower and Podium) 2 Maximum Building Height for Building 1 (Podium along Regional Road 7) 3 Encroachment of Canopy Beyond Building Face Permit the tower and podium location as shown on the attached sketch, which is partially outside of the building envelope shown on Schedule E- 1376A, Exception Paragraph 9(1248) 20.4m (as shown on the attached sketch) 2.5m (at main entrance abutting Highway 7) The tower and podium shall be located within the building envelope and in accordance with the setbacks shown on Schedule E-1376A, Exception Paragraph 9(1248) 17.0m 0.5m Official Plan: Comments: The subject lands are designated Corporate Centre Node by in-effect OPA #500 (Vaughan Corporate Centre Plan), as amended by OPA #663 (Avenue Seven Plan). The subject lands are also designated Neighbourhood Precinct (N3) by the Vaughan Metropolitan Centre Secondary Plan which forms part of Volume 2 of the Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board (OMB). The proposal conforms to the policies of the Official Plans. On September 4, 2008, the OMB approved related Zoning Bylaw Amendment File Z.06.051 and Draft Plan of Subdivision File 19T-00V21 to permit the development of five high-rise residential buildings (four with ground floor commercial), together with a park, buffer and road blocks. On September 25, 2012, Vaughan Council approved related Site Development File DA.11.058 (Phase 1) to permit the development of a 37-storey residential apartment (future condominium) building, located on a podium ranging in height Development Planning Department I City of Vaughan I 2141 Major Mackenzie Drive I Vaughan, ON L6A 1T1 T: 905.832.8585 I F: 905.832.6080 I www.vaughan.ca

Page 2 of 2 from one to five storeys and with the above-noted variances. The proposal is generally in keeping with the building envelopes and setbacks in the OMB approved Zoning By-law. Minor changes are required to facilitate a different building design than originally approved at the OMB. The increased building height for the podium facing Highway 7 and the canopy encroachment at the main entrance along Highway 7 are also considered appropriate, as they create a strong street presence along Highway 7. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Recommendation: Condition(s): The Development Planning Department supports Minor Variance Application A308/12. None.
