WHEREAS, the Titusville City Council desires to permit certain structures, such as sundecks, balconies and stairs, within the Multifamily High Density Residential ( R- 3) zoning classification to extend into principal structure setbacks that face major water bodies; BE T ENACTED BY THE CTY COUNCL OF THE CTY OF TTUSVLLE, FLORDA as follows: SECTON 1. That Chapter 28 " Zoning", Article V, " Zoning District Standards", Section 28-307 " Multifamily High Density Residential ( R- 3)." of the Code of Ordinances, City of Titusville is hereby amended to read as follows: Sec. 28-307. - Multifamily High Density Residential ( R- 3). Multifamily High Density Residential( R- 3) a) Purpose The Multifamily High Density Residential ( R- 3) district is intended to allow the development of a variety of housing types at a maximum density of fifteen (15) units per acre. This district is further intended to satisfy the need for a high concentration of population, is located adjacent to arterial or collector streets and is well served by public services and facilities. That Chapter 30 " Development Standards", Article, " mprovements", Division 2 " Structure Project Over Certain Property", walls." of the Code of Ordinances, City of Titusville is hereby amended to read as follows: Section 30-151 " Projections; fences and Sec. 30-151. - Projections. a) For all zoning districts, unless specified elsewhere in this Section, every part of a required yard shall be open from its lowest point to the sky, unobstructed, except for the customary projection of sills, belt courses, cornices, ornamental features and eaves and except that marquees or canopies may extend to within two ( 2) feet of the outer edge of the sidewalk. None of these projections shall extend into a required yard or over the building line more than thirty-six ( 36) inches. Open or enclosed fire escapes, outside stairways, balconies, chimneys, flues, or other projections shall not extend into any required yard except that uncovered steps may project not more than three ( 3) feet into any required yard. b) n any commercial district or any M- 1 ndustrial district, there shall be permitted fixed marquees or canopies to overhang the public right- of-way and no closer than two ( 2) feet to a vertical projection of the curb line ten ( 10) feet the lowest portion of such marquees or canopies shall be at least ten ( 10) feet above the sidewalk elevation. Fixed marquees and canopies may extend to a vertical projection of the street side of a sidewalk provided that a vertical distance of fourteen ( 14) feet is maintained between the sidewalk elevation and any marquee or canopy. c) Within any commercial district or M- 1 district, there be permitted awnings, canopies or covered walkways of canvas or other nonpermanent material not structurally tied into principal building, providing that such awnings or covered walkways shall in no case be closer than two ( 2) feet to a vertical projection of the curb line. walkways shall have a minimum vertical height of seven ( 7) feet above the sidewalk d) elevation. Within the T district and M- 2 district, such awnings, canopies, or covered walkways may be erected within any front yard or side yard abutting a street, provided such awnings, canopies, or covered walkways do not exceed six ( 6) feet in width; in no event shall such structures extend over any public right-of-way line. All such awnings, canopies, or covered walkways shall be specifically designed and intended for the protection of pedestrians. Within any townhome development adjacent to the ndian River Lagoon and located in the R-3 district, elevated decks or balconies ( excluding screen rooms or other enclosures) on townhouses may project into the rear yard setback a maximum of five ( 5) feet toward the water where the property is adjacent to a major water body, or a common area. Open stairs, fire escapes and chimneys on townhouses may project no more than four ( 4) feet into the required side or rear setback. Principal structures, including balconies, may not extend into the shoreline protection setback required by Section 30-63, Shoreline protection setbacks. SECTON 3. SEVERABLTY. f any provisions of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTON 4. REPEAL OF CONFLCTNG ORDNANCES. All ordinances or parts of ordinances, and all resolutions and parts of resolutions, in conflict herewith are hereby repealed to the extent of such conflict. SECTON 5. EFFECTVE DATE. This Ordinance shall become effective upon adoption by the City Council in accordance with the Charter of the City of Titusville, Florida. September 21, 2018 Page 5 of 6
SECTON 6. NCORPORATON NTO CODE. This Ordinance shall be incorporated into the City of Titusville Code of Ordinances and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this ordinance and the Code may be made.
