INTRODUCTION These Rules and Regulations are intended to be a helpful guide for the enjoyment of Gull Point by unit owners, guests, and tenants. It is also important that residents be aware of some basic principles which govern condominium life and ownership. These principles can be found in the Declaration of Condominium and Code of Regulations on the Gull Point website (http://www.gullpointde.org ) and should be read by all owners. This set of particular Rules and Regulations are approved by the Gull Point Council and altered or amended from time to time by the Council as considered necessary. GULL POINT HOMEOWNER ASSOCIATION-GENERAL INFORMATION 1. Council meeting minutes will be posted to the Gull Point website: (http://www.gullpointde.org) and emailed to owners requesting email notification or sent via US postal mail no less than two weeks prior to the next meeting together with the notice of such meeting and an accompanying agenda. 2. The Annual Meeting of the Association of Homeowners is held in the month of June. 3. Special meetings of either the Council or the Unit Owners may be held with 14 days notification to all owners, accompanied by an agenda. 4. The Homeowners' maintenance fee is payable quarterly in advance on the first of January, April, July, and October. 5. Late fees will be assessed as per the Council policy and administered by the management company. A copy of that policy is posted on the website or can be obtained through the management office. AUTOMOBILES AND OTHER VEHICLES 1. All moving violations, licensing, registration and vehicle violations should be reported to the Delaware State Police (302-856-58500) for enforcement with complainant acting as a witness. 2. The Gull Point speed limit is 15 miles per hour. 3. Roadways are also walkways and bikeways. 4. Recreational dirt bikes, All Terrain Vehicles and Golf Carts are prohibited. Bicycles, tricycles, and mobility scooters must not be parked outside overnight. 5. Any motor vehicle which is inoperable will be considered abandoned and towed away at owner's expense. Extenuating circumstances may be discussed with management. 6. Minor motor vehicle repair or maintenance on the premises is permitted. No vehicles may be left on jacks or blocks. PARKING 1. No personal vehicles are permitted to park on traveled portions of the roadway. 2. Utility and maintenance vehicles may park on traveled portions of the roadway when performing services in the community. 3. Personal automobiles and trucks may be parked only in designated parking areas. 4. Parking in other areas, including "No Parking" areas and parking on the grass is not permitted. 5. Parking areas in front of garages are for the sole use of occupants of the units. 6. No parking space is assigned to any unit, except in front of unit owner's garage. 7. Each unit is entitled to two parking spaces. 8. Commercial vehicles may not be parked overnight. Commercial vehicles shall be defined to include any vehicle with business lettering and are not permitted unless the company is working on the property. 9. Mobile homes and RV trailers may not be parked overnight in parking areas. 10. Boat trailers may park for a maximum period of forty-eight (48) hours in front of the homeowner s unit. In case of emergency, this time limit may be increased by the Council. 11. Moving vans, work trailers, maintenance or contractor vehicles may not be driven or parked on lawns and sidewalks without prior approval and direction from the Maintenance Supervisor. Any damage to common grounds or drainage fields will be paid for by the responsible unit owner. 12. Untagged vehicles or vehicles with expired registration tags are not permitted on the property.

POOL REGULATIONS The following rules and regulations are for the protection and benefit of the owners, guests and tenants of Gull Point. POOL SCHEDULE: Thursday before Memorial Day through Last Sunday in September Hours: 7:00 am 9:00 pm The pool will be closed during inclement weather and all patrons must vacate the premises during lightning storms. Access to the Gull Point pool is administered by the management company. The Gull Point Pool can only be accessed using an activated Fob (electronic gate key). Each Fob is coded uniquely to each unit, thereby recording usage. Pool activities are monitored by video cameras. Owners assume full responsibility for all family members, guests and/or renters to comply with these Gull Point regulations. Pool access may be terminated for the entire unit s household at the discretion of the Council or its managing agent and its owners shall be liable for any and all damages to and in the pool area, as well as any violation assessments levied. 1. Swim at your own risk. 2. Pool access is limited to designated hours. Anyone within the pool fencing outside of the hours of operation is considered trespassing and will be prosecuted to the fullest extent of the law. 3. If you are not up-to-date on your dues, your fob access will be shut off and you will not be allowed access to the pool. 4. Members of the community shall not open the gate for those who do not have a fob or have a deactivated fob. 5. Vacate pool area during thunder and/or lightning or in times of mechanical failure. Facility will reopen a half hour after last instance of thunder and/or lightning. 6. Secure pool umbrellas with bungee cords when leaving pool area and/or during high winds. 7. Individuals are responsible for loss or damage to personal property in pool area. 8. No running, pushing, diving, horseplay or other undue disturbance permitted. 9. Alcohol consumption permitted in moderation. 10. No smoking within the fenced area. 11. No glass containers in pool area. 12. Children fifteen (15) and under must be accompanied by a person 18 years or older. 13. Swim diapers required for infants. 14. Keep pool and bathroom areas clean and place trash in designated containers. 15. Pets are not permitted except for service dogs. 16. Use of rafts, toys, flotation devices and sound devices are permitted as long as they do not interfere with others.

17. Chairs, lounge chairs and tables may not be reserved. However, if you are planning on bringing 10 or more guests to the pool, please contact the Pool Chair to reserve tables and a canopy. A $5.00 fee per person is required for parties over 10. 18. Do not hang on the rope (separating the shallow and deep area). 19. Please be mindful of others. Keep personal hygiene in mind and no public manicuring (shaving, toenail clipping, hair trimming, etc.) at the pool. 20. Every Unit will obtain one (1) key fob. Each additional or replacement fob is $35.00. ***Failure to adhere to these Rules could result in loss of pool privileges.*** IN THE EVENT OF A POOL EMERGENCY (SUCH AS CLOUDY WATER OR FECES IN THE POOL) PLEASE CONTACT SEASCAPE MANAGEMENT CO. AT 302-645-2222. GENERAL MARINA REGULATIONS (A complete set of Marina Rules are available on www.gullpointde.org) 1. All children under the age of six (6) must wear a life jacket when walking on the docks. 2. State of Delaware licenses must be obtained by anyone between the ages of 16 and 64 to fish or to put crab pots in the Indian River Bay. 3. Crab pots (limit of 2 per unit) may be put in at the crabbing pier and/or in a unit owner's slip or in other designated areas along the main dock. A unit owner may not put a crab pot in another owner's slip without permission from the slip holder. 4. All crab pots must have a GP tag with the owner's name attached to it. Tags may be obtained through the maintenance office or a member of the marina committee. 5. Dogs on the docks must be on a short leash. 6. Owners desiring slips should contact the management company for a copy of a slip lease and additional marina rules and regulations. 7. Alarms will sound if fire extinguishers and life rings are removed from the marina. If an alarm is heard, one should investigate to see if someone needs assistance or is attempting to remove property. Call 911 in case of perceived emergency. PET REGULATIONS 1. Dogs must be on a leash at all times within the confines of the Gull Point Community and owner, tenant or guest must be present. 2. Cats are not allowed to run loose. If a cat is loose it will be considered feral and may be trapped. 3. All pet feces must be picked up and disposed of properly. Pet pickup bags are provided at dispensers throughout the community. 4. Noise from pets should be kept to a minimum so as not to disturb other residents.

5. A unit owner or tenant is responsible for the necessary registration and immunization of his or her pet in accordance with requirements of local authorities. On request, the owner must provide documentation of immunization. 6. Any animal running loose on the property will be reported to local authorities to be taken into custody. 7. Any costs of physical damage caused by a pet will be assessed to the pet owner and/or unit owner. 8. Pets are not permitted in the pool area or the ponds. 9. Pets shall not be left unattended on porches or decks. 10. Pets should not be leashed to trees, stakes, structures, or decks. 11. Each owner is responsible for compliance with these regulations of his/her guests or tenants. NOISE 1. TVs, radios, stereos, and such should not be played at a level that is disturbing to other residents. Violations should be reported to the Delaware State Police at the time of disturbance. 2. All activities that would disturb neighbors must be avoided between 10:30 PM and 8:00 AM. TRASH REMOVAL AND TRASH CONTAINERS 1. Dumpsters for trash and recycling items are provided in a designated area in the complex at the rear entrance. 2. Trash shall be placed in plastic bags and put inside the dumpster. 3. Recycled items should not be placed in plastic bags, but can be put in either loose or in paper or compostable bags. 4. Only household trash should be put in the dumpster. Larger household items or furniture items are not permitted within the dumpster area and residents should make their own arrangements for bulk pickup. OPEN FLAMES 1. The following are prohibited: Recreational fires including tiki torches, wood burning firepits, chimeras, oil fryers, open flame cooking within the confines of any enclosed area, and cooking next to a structural wall or under building overhangs. 2. Grills should be placed as far away from building structures as possible. 3. Propane firepits are allowed. Before purchase contact the management company (302-645-2222) for specifications.

LANDSCAPING 1. Homeowners may place decorative flower containers or pots on the front landing and decks of their units. 2. Homeowners may place decorative flower containers or pots on the established planting beds surrounding their unit. No containers are to be placed on the lawn areas of the common ground. 3. Trellises and stakes are allowed in decorative flower containers and pots on decks only. 4. Homeowners may place lightweight window boxes that sit on top of the railings without attaching them directly to the railings, i.e. with screws or any type of support system. Nothing else is to be attached to railings. The homeowner will be responsible for any subsequent damage and repair to common elements. 5. Homeowners may hang decorative signs or elements to exterior unit walls by front porches, decks or inside screened porches. The homeowner will be responsible for any subsequent damage and repair to common elements. 6. Homeowners may hang pots from roof overhang on deck or porch. The homeowner will be responsible for any subsequent damage and repair to common elements. 7. Homeowners may not grow any plant in the ground. 8. Containers and plants must be well maintained 9. If the growing containers or plants are not maintained and are not in accordance with the above conditions, Council will ask that they be removed by the homeowner within 15 days of notice. 10. No homeowner may place decorative landscape elements if such placement creates an objectionable or unsightly condition. ARCHITECTURAL STANDARDS Unit owners are allowed to install the following items according to specific standards determined by the Council from time to time. 1. Storm Doors 2. Satellite Dishes 3. Handrails 4. Gates 5. Awnings 6. Attic Fan 7. Propane Tank Enclosures 8. Heat Pump Enclosures Owners should contact the Management Company for these standards before installation. Installations that are not according to these Gull Point standards will be removed at the owner s expense. These installations must be kept in good repair and all repairs are the responsibility of the homeowner.

RENTALS 4. Unit owner must provide Management Company with contact information for each renter and a copy of the rental agreement. 5. The unit owner must provide his tenant with a copy of the Rules and Regulations at the time the tenant takes possession of the unit. 6. Unit owners are liable for any rules violations and damages caused by tenants. COMPLAINTS AND VIOLATIONS Complaints and/or violations should be reported to and will be investigated by the Management Company. If the investigation indicates that a homeowner is in violation, penalties may be levied at the discretion of Council and based on the seriousness of the offenses.

GULL POINT RULES AND REGULATIONS - CONDENSED VERSION This summary of basic rules is suitable for easy display for guests and tenants and does not contain all the Rules and Regulations of the Community. You may park in any open parking place except in front of another unit's garage. Do not park on the grass or on traveled portions of roadway. Commercial vehicles, mobile homes and RVs may not be parked overnight. Boats and trailers may be parked for a maximum period of 48 hours unless the Gull Point Marina Emergency Plan is put into effect. You may use the pool only during the posted hours. Pool rules are posted at the pool and must be followed. The locked gated pool area requires the use of an authorized electronic pool fob to gain entrance into the pool area. Each party must utilize a fob to enter the pool. Please do not open the gate open for those without a fob. Children under the age of 15 must be accompanied by a person over 18 while at the pool. Children under the age of 6 must wear a life-vest when walking on the docks. Dogs or other pets must be leashed at all times and any feces must be picked up immediately. Cats must be kept indoors unless in carriers at all times. Only household trash should be put in the dumpster. All trash should be in plastic bags. Larger items are not permitted within the dumpster area. Residents should make their own arrangements for bulk pickup. Dirt bikes and ATVs used for recreational purposes may not be ridden on common property or roadways. Quiet hours in Gull Point are between 10:30 PM and 8:00 AM. No laundry or towels, sheets, swimwear, etc. may be hung on the deck rails.
