POND CAPACTY PURCHASE POLCY
Garners Creek Storm Water Utility Capacity Purchase Policy Background The Garners Creek Storm Water Utility was created to provide a physical system of drainage that protects the landowners by the efficient and effective transportation of water in accordance with and in compliance with local, state and federal regulations. n order to achieve this goal, the Utility constructs regional detention ponds to control the peak flows allowed through the Garners Creek watershed. These ponds also improve water quality along Garners Creek by reducing total suspended solids (TSS) and total phosphorus (TP) pollutants. Since larger, regional detention ponds are generally more costeffective than smaller, site specific ponds, the Utility has decided to offer properties that develop or redevelop the opportunity to purchase capacity from Utility owned and operated regional ponds. Future development or re-development sites within a Utility owned regional pond watershed would have the opportunity to purchase capacity from the Utility, rather than construct and maintain their own facility. Determination of Watershed Area Each regional detention pond receives runoff from a defined watershed area. The watershed area is determined by reviewing USGS or County topographic maps, storm sewer maps, construction plans of individual subdivisions or developments and other available drainage maps. This information is combined and analyzed to determine the watershed area contributing runoff to the detention pond. The watershed area will be shown on a map on file in the Utility office and website. Determination of Project Cost Each detention pond constructed by the Utility is advertised for public bidding in accordance with State of Wisconsin municipal bidding procedures. The total project cost includes, but is not limited to, property or easement acquisition costs, engineering fees, construction cost, permit fees, legal fees, posting and publication expenses, and administrative charges. Any state or federal grant funding received by the Utility is considered and accounted for when determining the total project cost. Determination of Capacity Purchase Rate The detention pond capacity purchase rate will be determined individually for each facility. The rate will be established by dividing the total project cost by the watershed area on an acreage basis. The watershed area will include any existing or future public roadways within the area. At the completion of each regional detention pond project, a capacity purchase rate will be determined and submitted to the Commission for review and approval. Purchase of Regional Retention Capacity Any property owner wishing to purchase capacity in a regional detention pond will make written request to the Commission. The Commission will review the request to determine if capacity is available for purchase and the corresponding fee for the capacity purchase. The Commission will notify the applicant of its decision. The capacity purchase will be considered executed upon the Utility receiving the appropriate fee from the applicant.
