Customer Guidelines For Construction of New API Power Lines As indicated in our Conditions of Service, contestable work is any work that will ultimately expand the distribution network of Algoma Power Inc. (API). Any expansion, of the distribution network, along a public road allowance, public access, easement or ultimately intended to serve more then two metered services, must be transferred to API. The network could be either a primary voltage expansion (>750V) or a secondary voltage network (<750V). As described in API s Conditions of Service (COS) you are allowed to seek alternative bids for the proposed extension. Following the COS (Section 2.1.2), as an alternate bid you will be responsible for the following portions of the project: (a) selecting, hiring, and paying the qualified contractor all the costs for the work eligible for the alternative bid; (b) assuming full responsibility for the construction of that aspect of the expansion project; (c) Administering the contract. Administering the contract includes acquisition of all required permissions, permits, and property rights as required; (d) constructing the System Expansion (line extension) to meet API's design requirements; (e) paying an inspection fee to API for inspection of the construction ; (f) paying the cost of any easements or property agreements as required by API; (g) transferring ownership of the facilities built, to API for a nominal fee prior to connection; (h) paying costs for all design engineering; and (i) paying all applicable Electrical Safety Authority inspection fees; API shall be responsible for: (a) providing the design specifications for the construction; and (b) inspecting and authorizing the line for connection. Process for the Construction of the Network Expansion 1. Customer is to arrange for a site review with API engineering staff. The site review will discuss the route of the power line. 2. API will prepare a budgetary estimate for the design, construction, inspection fees for the proposed power line, as well as the costs to connect the completed line onto API s distribution network. The estimate will include a rough timeline for the design portion of the powerline as well as describe any special requirements of the design. 3. Customer will determine if API or a customer selected contractor is to construct the power line. 4. Upon determination of the construction method, the customer is to provide a deposit to cover API s engineering and inspection costs. The engineering cost

covers the design of the power line and staking of the power line within the agreed upon route. Easement requirements will be identified within the supplied design by API. Note: Changes to the original design, route, re-staking or additional inspection requirements will result in additional costs to be paid by you in advance of any additional API work. 5. The customer is responsible to procure property and construction rights, easements, and permissions for the power line. Procurement of property rights include negotiation, purchase of all easements, creation and registration of the reference plan of the easement, transfer of the easements to Algoma Power Inc., legal costs and any other costs to acquire rights to construct the line. 6. The customer is responsible to ensure that the power line route is cleared of vegetation to meet the power line design requirements of API. Staking of the pole and anchor locations will be performed by API staff, after the route has been cleared of vegetation. 7. The customer is responsible to contract a qualified power line contractor. Qualified contractors can be found using the Electrical Safety Authority (ESA) qualified contractors list. 8. The customer is responsible to procure all material to build the power line based upon API s design, material standards, and construction standards. API is a member of the Utility Standards Forum (USF) and provides a copy of the USF Standards subject to your acceptance of the loaner requirements. Appendix A provides additional information regarding material for the power line. 9. Once the power line has been constructed, the customer is to contact API Engineering in writing, to arrange for an inspection of the power line. Any additional work required to resolve inspection defects will be the responsibility of the customer. The customer is also responsible for the costs of API s additional inspection costs. At API s sole discretion, an approval of the power line by ESA will be accepted as a form of inspection. 10. Once the power line has been approved by API, the customer is to provide; a. a completed Transfer of Privately Built Power Lines ( Appendix B ), b. list of procured material with the appropriate material approvals, c. copies of the actual costs of the construction including supporting invoices, d. copies of the registered easement (transferred to API) for each parcel of property, e. any municipal consents (transferred to API), f. any encroachment permits (transferred to API) as required. g. A deposit for any costs to connect the power line to API s distribution network. 11. API will provide the customer with written acceptance with a copy of the API completed Transfer of Privately Built Power Lines as well as provide a tentative connection schedule. 12. As a requirement of the COS, API will monitor future unplanned service connections that occur on this power line and issue connection credits for a period of five (5) years. Any connection credits are issued as each individual secondary

service has been approved for connection. The connection credit will typically be issued to the individual service owner at the time of connection unless specified otherwise in the Transfer of Privately Built Power Lines document agreed to with API.

Appendix A 1. Joint use anchoring requires 1 inch diameter anchor rods. 2. Typical anchors to be used are power installed screw anchors (PISA). Rod extensions to be used as required. In some soil conditions anchor plates will be required to be used. Refer to API s Standards Document. 3. All power line poles will be western red cedar. Algoma Power Inc. uses western red cedar poles exclusively. 4. Conductor size shall be a minimum of #2 ACSR (bare) unless the API supplied construction plan indicates a heavier conductor to be used. The construction plan will indicate the required conductor size to be used. 5. Conductors shall be installed using the sag charts found in the API USF Standards document. 6. Insulators are to be polymeric and rated for 28 kv (phase to phase), unless written approval from API prior to procurement indicates otherwise. 7. Suspension type insulators will be polymeric insulators only. 8. All hardware will be galvanized and utility grade. Refer to Ontario Electrical Safety Code for specifications. All material is subject to API written approval prior to procurement. 9. Guy wire will be 3/8 inch, diameter and Grade 180 or better. 10. All construction will follow established specifications, procedures and methods. Refer to API Standards, EUSA rule book, and Ontario Electrical Safety Code.

Appendix B

TRANSFER OF PRIVATELY BUILT LINE EXTENSION THIS AGREEMENT MADE BETWEEN, (hereinafter the Customer ), OF THE FIRST PART, and Algoma Power Inc., (hereinafter API ), OF THE SECOND PART; WHEREAS the Customer has arranged for the construction of a line extension on a road allowance or easement adjacent to or across the Customer s property and which is described as follows: Description of Line Township Plan Lot/Part Twp. Voltage Length No. Of Spans No. Of Poles No. Of Anchors (Hereinafter called the Line ); AND WHEREAS Algoma Power Inc. has inspected the Line and is satisfied that it has been constructed in a manner that meets its requirements; NOW WITNESSETH in consideration of the sum of One Dollar ($1.00) now paid by Algoma Power Inc. to the Customer, the receipt of which is hereby acknowledged, the Customer and Algoma Power Inc. hereby covenant, promise and agree as follows: 1. The Customer hereby grants, transfers and conveys to Algoma Power all right, title and interest in the Line free and clear of all encumbrances. 2. Algoma Power Inc. shall assume ownership, operation, maintenance and public liability of the Line in accordance with standard engineering practices. 3. Algoma Power, its officers, directors, agents and/or employees and successors and assigns are not responsible for any damages, claims, liabilities, costs, demands, actions, expenses or compensation associated with the Line where the cause of such damages, claims, liabilities, costs, demands, actions, expenses or compensation occurred prior to the Execution Date. 4. The Customer agrees: To relinquish all equity in the Line to Algoma Power at this time. Initial 5.
