PALM BEACH COUNTY STATUS REPORT SR 1992-007.8 (For Zoning Control # 1992-007) Staff Recommendation Staffrecommends the postponement of Status Report SR 1992-007.8 until November 29,2007, as requested by a representative of the property owner. Development Approval Being Reviewed: Zoning Petition 1992-007 was approved by the adoption of Resolutions R-1993-515 and R-1993-516 on April 20, 1993. The resolutions rezoned property to the CC-Community Commercial zoning district and approved a Special Exception for a Planned General Commercial Development, including a fast food restaurant with drive-thru window, auto service station (automatic) and financial institution with 3 drive-up tellers. The zoning action is now being reviewed pursuant to Article 2.E., "Monitoring," of the Palm Beach County Unified Land Development Code for failure to commence development. Property Description: The property is approximately 7.92 acres and is on the northeast comer of the intersection of Hypoluxo Road and Military Trail. Property Owner: Morningstar Nursery, nc. Required Action: Article 2.B., requires that the Board of County Commissioners take one or more ofthe following actions: 1) grant a time extension of up to two years; 2) rezone the property andlor revoke the special exception/conditional use; 3) impose entitlement densitylintensity; 4) add or modify conditions of approval,s) permit the property owner to file a petition to add or modify conditions of approval; 6) direct staff to cite the property owner for Code violation; and/or 7) deny or revoke a building permit, issue a stop work order, revoke any concurrency, deny a Certificate of Occupancy, deny or revoke any permit or approval. REVEW FACTORS Consistency with Land Use Plan and Unified Land Development Code The land use category for the property is Commercial High with an underlying designation of Medium Residential 5. The current approval is consistent with the land use designation ofthe Palm Beach County Comprehensive Plan. The certified site plan approved the development of 81,000 square feet (68,500 s.f retail, 5,000 s.f financial and 4,000 s.f restaurant). To be consistent with the Unified Land Development Code (ULDC), a project must meet the Countywide Traffic Performance Standards. This determination has not yet been made. Performance Standards A traffic impact study was submitted to the Traffic DiviSion, but there are issues that the owner's traffic engineer is attempting to resolve with County staff. Due to this, a request has been made to postpone this status report until November 29,2007. Supplemental nformation An application to amend the land use of parcels to the north and east (total of 24.04 acres) was submitted for amendment round 05-1. The request was to change from the current land use designation of Multiple Land Use with an underlying five units per acre, to Commercial High with an underlying designation of five units per acre. The amendment was not approved (split vote which is a denial). The property owner's justification statement said it is the intent of the property owner that the ultimate use ofthis property is as a site for a Super WalMart. There was no reference to the comer parcel which is the subject ofthis status report. A previously requested land use amendment

that was subsequently withdrawn did say there was an intent to include the comer parcel. The 19.18 acre parcel (of the above referenced 24.04 acres), which is immediately to the north of the property which is the subject of this status report, has a valid development order (Petition 2001- OOS/Resolution R-200 1-2067) which was approved on November 29,2001. The development order is currently under a time extension which will expire on November 29, 2007. The development order approved a rezoning to the MUPD-Multiple Use Planned Development district with two daycare facilities, and a general and congregate living facility, type. The 4.86 acre parcel fronting Hypoluxo Road which was included in the proposed land use amendment was not included in Petition 2001-005. The property owner challenged the original conditions of approval of the development order for the special exception. The property owner and Palm Beach County subsequently agreed to a settlement agreement which required the amendment of certain conditions. The proposed amendment was subsequently approved through the status report process in 1996, and at that time an extension until 1999 was approved. Time extensions totaling eight years have subsequently been approved. The last extension expired on July 6, 2007. When a time extension was approved in 200, a new condition of approval was imposed to require compliance with architectural guidelines. The property owner has complied with conditions of approval of Resolution R-96-826 which required the conveyance of right-of-way for a safe site comer (#4), and right-of-way for a tum lane (#5).
