APPLICANT S PROPOSAL Technical Information This is a final plat for 1 lot, for The Cottages at Bluebird Creek subdivision proposed at 1010 N. Lightburne Road. The rezoning and preliminary plan applications were approved in February 2016. The final plat allows Page 1 of 3
the dedication of public roads, right-of-way, easements, and the subdivision of the land into individual lots. PUBLIC INFRASTRUCTURE FACILITY CITY STANDARD Streets Sanitary Sewer Water Storm Water Direct connection to fully improved street network Direct, gravity flow connection Direct connection to City water services All storm water must be released from the site at an acceptable rate STATUS Direct access to N. Lightburne Street, which will be improved with curb and gutter, an acceleration and deceleration lane, 5 sidewalk, and a southbound exclusive left turn lane. Sanitary sewer service will be provided via 8 sanitary sewer main that runs through the property. Water service will be provided via a connection to the line that runs along N. Lightburne Street. Storm water will be collected via on-site storm sewer and piped to on-site aboveground detention system where it will be released at an acceptable rate. STAFF ANALYSIS In accordance with the UDO, staff s analysis of a Final Plat application is guided by Section 30-28.14. 1. The final plat substantially complies with the intent of the comprehensive plan; Recommendation #1 of the The Blueprint for Liberty states that the City of Liberty should be a full-service community for a diverse population consisting of neighborhoods designed for interaction. A range of housing types and sizes to accommodate households of all ages and sizes should be provided. The applicant is proposing to provide housing for seniors living in Liberty. Staff believes this proposal satisfies the intent of the comprehensive plan and future land use map. An Amendment to the Future Land Use Map was approved in February 2015. The City Council has accepted the Preliminary Development Plan as proposed. 2. The final plat complies with the provisions of this UDO; The proposed plat complies with all standards of the UDO and this PD zoning district. 3. The final plat substantially complies with approved city development standards and policies; The proposed plat has direct access to water, sewer, and the public street network and substantially complies with City standards and policies. 4. The final plat substantially conforms to the approved preliminary plat, when applicable; The proposed plat substantially conforms to the previously-approved Cottages at Bluebird Creek Preliminary Plan. 5. All public works elements have been designed to city specifications and certified by the city engineer; All proposed public utility extensions conform to city specifications and will be certified by the City Engineer. 6. All necessary easements, dedications, vacations, and other agreements have been accepted or approved. All onsite easements and dedications have been reviewed and approved by the City Engineer and are accepted with the approval and recordation of this plat. STAFF RECOMMENDATION Staff finds that the application does conform to Section 30-28.14. - Final plat, approval criteria. Therefore, staff recommends approval of P&Z Case No.16-20FP. The Planning and Zoning Commission recommended approval of this item 6-0-0. V. Case 16-20FP: Final Plat for The Cottages at Bluebird Creek, 8.3 acres at 1010 N. Lightburne Street. Mr. Peterman presented the information in the staff report. Chairman Rosekrans asked if there were any questions of staff. Commissioner Personett asked for clarification regarding Lightburne being a City maintained street vs. MoDOT. Commissioner Personett said he recalled some discussion regarding acceleration and deceleration from the previous meeting in February, and asked if there are any remaining concerns with the southbound left turn lane. Mr. Findlay confirmed Lightburne is City maintained and has no concerns as the southbound left turn lane will give access to the golf course and northbound will give access to the site. Chairman Rosekrans asked if the applicant wished to speak. Brenda Haddad representing Herman Kittle, 1405 S Ellis, Webb City, Missouri, said this is a MHDC financed development to serve low and moderate income seniors, special needs will be referred by Center for Human Services, currently has a waiting list and has several people very excited about it. She said they are excited to be working within the City of Liberty for this project. She said she was available for questions. Chairman Rosekrans asked if Commissioners had any other questions for staff or the applicant. Hearing none, he asked for a motion. Action: Commissioner Holt moved to approve as recommended by staff. Commissioner Howard seconded the motion. Vote: Motion passed 6-0-0 Yes: Commissioners Armstrong, Holt, Howard, Personett, Reinier, and Rosekrans.
