BUILDING CONSENT INFORMATION Infrmatin n Prject Infrmatin Memranda, Building Cnsent Applicatins, Inspectins and Cde Cmpliance Certificate 1. The Building Act: The Building Act 2004 prvides fr the regulatin f building wrk, the establishment f a licensing regime fr building practitiners, and the setting f perfrmance standards, t ensure that: (a) Peple wh use buildings can d s safely and withut endangering their health; and (b) Buildings have attributes that cntribute apprpriately t the health, physical independence, and well-being f the peple wh use them; and (c) Peple wh use a building can escape frm the building if it is n fire; and (d) Buildings are designed, cnstructed, and able t be used in ways that prmte sustainable develpment. T achieve this purpse, the Act requires anyne prpsing t d building wrk t btain a Prject Infrmatin Memrandum and a Building Cnsent frm a Building Cnsent Authrity befre cmmencing building wrk. 2. Wh administers the Building Act? The Ministry f Business Innvatin and Emplyment (Building and Husing) is the gvernment department respnsible fr administering the Building Act 2004. 3. What is a Building Cnsent Authrity (BCA)? Building cnsent authrities are reginal r territrial authrities r private rganisatins registered under sectin 273 f the Building Act 2004, and are respnsible fr perfrming building cntrl functins under Part 2 f the Act. 4. What is a Prject Infrmatin Memrandum (PIM)? A Prject Infrmatin Memrandum (PIM) is a memrandum issued by the Cuncil under sectin 34 f the Act and sets ut infrmatin relevant t yur building wrk. The infrmatin is prvided n a prescribed frm and is required t include all such infrmatin knwn t cuncil which may be relevant t the prject r site. This includes ptential fr: Ersin Avulsin (remval f land by water actin) Falling debris Subsidence Slippage Alluvium (the depsit f silt frm flding) The presence f hazardus cntaminants which are likely t be relevant t the design, cnstructin r alteratin f yur prpsed building which are knwn t Cuncil. Details f strm water r wastewater utility systems which may relate t yur prject r site will als be included (where applicable). A Prject Infrmatin Memrandum als identifies any additinal apprvals required such as: Resurce Management Act New Zealand Histric Places Trust (heritage buildings / sites) New Zealand Fire Service Cmmissin 5. The memrandum als includes: Cnfirmatin, subject t ther prvisins f the Act that yu may carry ut the building wrk subject t The requirements f the building cnsent, and All ther necessary authrisatins being btained. D I need a Prject Infrmatin Memrandum? N, but if yu are cnsidering carrying ut building wrk and need infrmatin n any relevant special land features and regulatry requirements, a PIM can help infrm design requirements and reduce time and csts during the cnsent apprval prcess. This can be applied fr separately r in cnjunctin with yur building cnsent. 7. Hw t apply fr a PIM An applicatin fr a PIM must be made n the Frm 2 PIM/Building Cnsent applicatin frm which is available frm Cuncil. This frm must be cmpleted in full, signed and dated befre being submitted. 8. Dcumentatin required All applicatins must be accmpanied by 2 cpies f: The site plan Flr plan Fundatin Design Bracing Schedule Building elevatins Prpsed drainage plans. Prducer Statement (specific design) Specificatins Certificate f title 9. Hw lng des it take? Cuncil is required t issue the PIM within twenty (20) wrking days f the applicatin being received, hwever, depending n wrklads, this may be earlier. NB: Prviding all fees are paid, the PIM will be psted t the applicant when it is issued. If the PIM is applied fr with the Building Cnsent the timeframe fr the issue f bth is 20 wrking days. Smetimes it may be necessary fr Cuncil t btain further infrmatin frm yu t enable prcessing f yur PIM t be cmpleted. In such cases Cuncil will cntact yu within 10 days f receiving the PIM applicatin with a frmal request fr further infrmatin. Cuncil has 10 wrking days frm when this infrmatin is received t issue the PIM. 10. What is a Building Cnsent? A Building Cnsent means a cnsent t carry ut building wrk granted by a Building Cnsent Authrity under sectin 49, it is the frmal apprval issued by a Building Cnsent Authrity (BCA) that certain wrks meet the requirements f the New Zealand Building Act, Building Regulatins and Building Cde. Yu cannt undertake any building wrk that requires a building cnsent withut this apprval. Mst building wrk requires a building cnsent but sme minr wrk is exempt under the Act. 11. Exempt wrk Exempt wrk is listed n Schedule 1 f the Building Act. This may be viewed n the web http://www.building.gvt.nz/bc-n-cnsentschedule-1 12. When is a Building Cnsent required? A building cnsent is required fr mst wrk including: Swimming pls, spa pls (please check) and their fencing Retaining walls ver 1.5m (n surcharge) Retaining walls any height incurring a surcharge Decks ver 1.5m high Carprts and rfs ver decks attached t buildings mre than 20m 2 Free-standing nn-habitable buildings larger than 10m 2 r less than its height frm the bundary r a dwelling Plumbing and drainage wrk Demlitin if attached r ver three streys high Relcatin f buildings Additins, alteratins t existing buildings New buildings (please check) Change f use (please check) Slid Fuel Heaters Small dams (mre than 35,000 litres f water) Fr guidance r further infrmatin please telephne (07) 306 9009. 13. Hw lng des it take t get a Building Cnsent? Building Cnsent prcessing time depends n the cmplexity f yur prject and whether r nt yu have prvided us with sufficient infrmatin. All Building Cnsents are required t be granted within 20 wrking days, hwever; if infrmatin submitted is deficient the time clck is stpped and a written request will be made fr further infrmatin. The time clck is nt restarted until the requested infrmatin is received. It is pssible that yur Building Cnsent applicatin requires checking by several disciplines; it is pssible therefre, that the clck maybe stpped n mre than ne ccasin if infrmatin is deficient. 14. Hw d I apply fr a Building Cnsent? Yu will need t cmplete ne f the apprpriate Frm 2 applicatin frms, (listed belw) and prvide infrmatin that is relevant t yur building prject. Once yu have gathered all the necessary infrmatin yu can either pst in the applicatin r bring it in persnally t ur ffice. On receiving yur applicatin a Building Cntrl Officer will check yur applicatin t ensure all relevant infrmatin has been prvided. Please Nte: this is nt a technical assessment but merely a check t ensure all necessary infrmatin has been prvided. If all infrmatin has been prvided yur applicatin will be entered in t the prcessing system. The clck starts n the day the applicatin has been accepted. If yur applicatin is incmplete, it will be returned with a list advising f infrmatin that is required. 15. What srt f infrmatin d I need? Building cnsent applicatins can be cmplex; we recmmend that yu engage a prfessinal persn t help with design wrk and drawings. Each applicatin must be accmpanied by the apprpriate fee and 2 cpies f: Plans Specificatin Fundatin Design Bracing Schedule Building elevatins Prpsed drainage plans Getechnical reprt fr buildings (Please check) Prducer Statement (specific design) Engineering Calculatins (if applicable) Fire safety design (if applicable Certificate f title E2 risk matrix (demnstrating weather - tightness features) (if applicable) 16. Prducer Statements A prducer statement requires the fllwing as a minimum requirement t be accepted a written statement header with prducer statement wh is issuing the prducer statement (suitably qualified and authr f prducer statement) the prducer statement must be addressed fr the attentin f the Kawerau District Cuncil wh has cmpleted r designed the wrk identified (qualificatins t undertake the wrk required) the prduct name and specificatins fr applicatin f prduct used (where applicable) what parts/clauses f the building cde the wrk relates t full legal descriptin f the site where the wrk will be undertaken clearly identifying what part f the building cnsent wrk is cvered by the prducer statement prvide the sum f Prvisinal Indemnity Insurance held Title: Building Cnsent Infrmatin Versin N: 10 Date Issued: Nvember 2017 Appendix: 10.3.1 Respnsibility: QAC/Building Cntrl Administratr Page 3 f 13

Alteratins t an existing building Sectin 112 f the Act requires Cuncil, as the Building Cnsent Authrity, t be satisfied that after the alteratins the building will cmply, as nearly as is reasnably practicable, with the current prvisins f the Building Cde that relate t: means f escape frm fire access and facilities fr persns with disabilities (if this is a requirement in terms f sectin 118) cntinued cmpliance with the ther prvisins f the Building Cde t at least the same extent as befre the alteratin. T be satisfied that cnsideratin f Sectin 112 has been undertaken, Cuncil will assess the extent t which the prpsed upgrade will be effective t bring the building clser t the relevant Building Cde standards. As part f the building cnsent applicatin, building wners will need t prvide an evaluatin f: what shuld be in the building t satisfy 1 and 2 abve as if this building was new what is currently in the building what is prpsed t bring this building tward the standard required by items 1 and 2 abve. The evaluatin shuld als detail the benefits and sacrifices required s Cuncil can cnsider what is reasnably practicable. 18. Changing the use f yur building Sectin 115 f the Building Act 2004 applies, this sectin ensures that when changing the use f a building, the current building stck is being upgraded tward the current prvisins f the Building Cde, specifically relating t: means f escape frm fire, alng with prtectin f ther prperty, sanitary facilities, structural perfrmance, and firerating perfrmance facilities fr persns with disabilities (if this is a requirement in terms f sectin 118) cntinued cmpliance with the ther prvisins f the Building Cde t at least the same extent as befre the change f use. In the same way, Cuncil will need t assess the extent t which the prpsed upgrade will be effective t bring the building clser t the relevant Building Cde standards. As part f the building cnsent applicatin, building wners will need t prvide an evaluatin f: what shuld be in the building t satisfy 1 and 2 abve as if this building was new what is currently in the building what is prpsed t bring this building tward the standard required by items 1 and 2 abve. Extensin f Life Sectin 116 Building Act An wner f a building with a specified life must btain permissin frm the Territrial Authrity t alter r extend the life f the building in accrdance with any cnditin impsed under sectin 113(2) f the Building Act when the building cnsent was granted. 20. Subdivisin f Buildings - Sectin 116A Building Act Cuncil must nt issue a certificate under sectin 224(f) f the Resurce Management Act 1991 fr the purpses f giving effect t a subdivisin affecting a building r part f a building unless it is satisfied, n reasnable grunds, that the building will cmply, as nearly as is reasnably practicable, with every prvisin f the building cde that relates t ne r mre f the fllwing: Means f escape frm fire. Access and facilities fr peple with disabilities (if this is a requirement fr the building). Prtectin f ther prperty. The building must als cntinue t cmply with the ther prvisins f the building cde t at least the same extent as befre the subdivisin applicatin was made. 21. Falling debris Subsidence Inundatin Slippage A building cnsent authrity must refuse t issue a building cnsent fr the cnstructin r a building r majr alteratins if the building wrk is t be carried ut n land subject t a natural hazard r the building wrk is likely t accelerate, wrsen r result in a natural hazard n the land r ther prperty. Despite this if the applicant can demnstrate that adequate prvisin has been made t prtect the land, building wrk r ther prperty frm the natural hazard the building cnsent authrity may grant the building cnsent under sectin 72 f the Building Act this will result in a cnditin n the building cnsent t the effect that the cnsent will be ntified t either an apprpriate Minister and the Surveyr General r the Registrar f the Mari Land Curt r Registrar General f Land dependant n the wner f the land. 22. Building n 2 r mre Alltments Sectin 75 Where an applicatin invlves the cnstructin f a building ver tw r mre alltments and they are held by the wner in fee simple the territrial authrity must issue a certificate that will trigger registratin n the title that states; That the lts (specified alltments) must nt be transferred r leased except in cnjunctin with any specified ther r thers f thse alltments. 23. Waivers and Mdificatins Sectin 67 Building Act The Territrial Authrity can grant a building cnsent subject t a waiver r mdificatin t the perfrmance criteria f the relevant building cde clause and can include cnditins. A waiver t accessibility requirements can nly be issued by the Chief Executive f the Ministry Business Innvatin and Emplyment. Waivers and mdificatins will appear n a Land Infrmatin Memrandum fr the prperty. 24. Restricted Building Wrk and Licenced Building Practitiners. Restricted Building Wrk Only LBPs are allwed t carry ut r supervise restricted building wrk Therefre, a cnsent applicatin that invlves restricted building wrk will need t include the names f the LBP carrying ut r supervising that wrk. See Sectin 45(1)(e) f the Building Act. The Gvernment has detailed restricted building wrk. It includes the design and cnstructin f a huse r small-medium sized apartments: Primary structure (eg fundatins and framing) t ensure the building can withstand vertical and hrizntal lads. External structure (eg rfing and cladding) t ensure the building is weathertight. Fire safety systems (eg sprinklers, fire alarms) t ensure peple are adequately prtected frm the dangers f smke and fire. Apprpriately licensed LBP will be respnsible fr plans and specificatins used in a cnsent applicatin fr restricted building wrk. See sectin 45(2)-(4) f the Building Act. Fr mre infrmatin abut restricted building wrk, visit the Licensed Building Practitiners website Licensed Building Practitiner (LBP) A persn is recrded in the registrar f LBP after they have satisfied the register f LBP that they meet the standards fr their licence class. See Sectin 286 f the Building Act. There are seven license classes in the LBP scheme: Design Site Bricklaying and Blck laying Carpentry External Plastering Fundatins Rfing Yu can apply t be licensed in mre than ne license class but yu must be able t demnstrate that yu are cmpetent in each class yu apply fr. They represent the skills and knwledge that a cmpetent persn with sund experience in the building cnstructin industry shuld be able t demnstrate. The LBP scheme is fr cmpetent individuals. Cmpanies and cmmercial entities cannt be licensed, but the peple they emply r subcntract can apply t be licensed. If yur wrk is cvered by ne f the license classes, this is yur pprtunity t have yur skills and experience frmally recgnised. T check if yur builder/cntractr is currently licensed under the LBP scheme, we recmmend yu search the Public Register by their name. (https://lbp.ewr.gvt.nz/publicregister/search.aspx) 25. Owner Builder Exemptin Yu are an Owner-Builder if yu: Have a relevant interest in the land r the building n which the restricted building wrk is carried ut (ie wnership), and are an individual (ie nt a cmpany). Live in r are ging t live in the hme (this includes a hliday hme, r bach). Carry ut the restricted building wrk t yur wn hme yurself, r with the help f yur unpaid friends and family members, and Have nt, under the Owner-Builder Exemptin, carried ut restricted building wrk t any ther hme within the previus 3 years. 26. Natinal Multi Use Cnsents Multiprf r Natinal Multi use cnsents are generic apprvals issued by the Ministry f Business Innvatin and Emplyment fr building that can be cnstructed anywhere in the cuntry with minr changes where the lcal Building Cnsent Authrity is nly typically apprving the fundatins and drainage prvisins f the Building Cde. Multi use cnsents are required t be prcessed within 10 days baring any suspensin fr further infrmatin and applicatin must be supprted by a cpy f the natinal multi use apprval and details f any minr custmisatins. 28. Hw is my Applicatin prcessed? All applicatins, regardless f hw they are received, are put thrugh a frmal vetting prcess. The vetting prcess is nt a technical check it is merely a check t see if all infrmatin has been prvided. Yur applicatin may be rejected at this time if insufficient infrmatin has been prvided. Once the applicatin has been vetted and accepted as cmplete, it is then entered int the prcessing system. At this pint the 20 wrking day time clck is started. The applicatin is then allcated t the Building Cntrl Officer r cntractr fr technical assessment and fr prcessing and may require peer review t cnfirm cmpliance. In sme cases we may als engage ther third party cntractrs, such as engineers r Fire and Emergency New Zealand (FENZ) t cnfirm cmpliance. Yur applicatin will be thrughly checked and assessed fr cmpliance with the building cde. If there are any questins r cncerns a letter will be sent t yu requesting further infrmatin r clarificatin. We will endeavur t put all questins in ne letter. When a request fr further infrmatin is sent the 20 wrking day time clck is stpped and prcessing is suspended until this infrmatin is prvided. Once the Building Cnsent Authrity is satisfied n reasnable grunds that cmpliance with the building cde is achieved, then a final check is made t ensure all wrk has been assessed crrectly befre the building cnsent is granted r refused. Once this apprval r refusal is given an invice is generated fr any balance f fees payable (inspectins, cde cmpliance certificate, etc). Upn payment f these fees, the cnsent will be issued (r refused). Where the Building Cnsent Authrity des nt have cmpetence t prcess fr cmpliance it shall be utsurced. There are tw stages in relatin t issuing a building cnsent. 1. Granting the cnsent. This is when all requested additinal infrmatin (if any) has been received and the technical check has been cmpleted and the building fficer checking the applicatin is satisfied n reasnable grunds that sufficient infrmatin has been prvided t adequately demnstrate cmpliance with the relevant perfrmance prvisins f the building cde. Reasnable grunds means the building fficer has been reasnable in his request fr infrmatin and that the infrmatin is readily available and is necessary t verify cmpliance with the chsen means f cmpliance with the perfrmance prvisins f the building cde. 2. Issuing the cnsent. The building cnsent is issued t the applicant upn the payment f all fees, levies, and charges. All building cnsents are issued n the cnditin that agents authrised by Cuncil (BCA) are entitled at all times during nrmal wrking hurs r while building wrk is being dne t inspect the land r building wrk. 29. Hw much will it cst? This depends n the type f applicatin and the cst f the prpsed wrk. Fees fr Develpment Cntributins The Kawerau District des nt have the pressure n its infrastructure systems that is being experienced by sme territrial authrities and therefre des nt have a pressing need t extend its existing infrastructure systems t cpe with increasing demand. The spare capacity in Cuncil s infrastructure means it can cpe with sme grwth withut a resulting increase in demand fr Cmmunity facilities. Cuncil s plicy in relatin t develpment cntributins is nt t assess develpment cntributins under the Lcal Gvernment Act 2002, but t retain the prvisins f the District Plan that allws the assessment f financial cntributins. Accrdingly, we d nt have charges relating t sectin 36 develpment cntributin ntices. 31. Hw Will I Be Ntified? When yur building cnsent is ready fr issue and all fees are paid yur building cnsent will be psted t the cntact persn nminated n the applicatin frm. Yu will als be ntified in writing if yur applicatin is refused utlining the reasns why it has been refused. If there are utstanding fees then yu will receive an invice advising yu that yur building cnsent is ready and will be issued when all fees are paid. 32. When can I start building? Cnstructin can nly prceed n granting f building cnsent; hwever it is imprtant t understand that if resurce cnsent is required fr yur prject and this has nt been granted a sectin 37 Ntice may be issued under the Building Act and this may include restrictins n all r part f the building wrk. 33. What are the Building Cnsent Cnditins r advice ntes? When a building cnsent is issued there may be a number f cnditins r advice ntes attached t the building cnsent dcument. These may be in relatin t: The entitlement t inspect (this is a statutry cnditin that applies t every building cnsent) Specified intended life Develpment cntributins (if any) Sectin 37 certificate restricting what building wrk (if any) can be undertaken prir t the issue f resurce cnsent Waivers and mdificatins (sectin 67) Building n land subject t natural hazards (sectin 71) Building ver tw r mre alltments advice ntes r ntices attached t building cnsents are simply that advice frm Cuncil that certain requirements shuld met r may be helpful infrmatin in relatin t the building cnsent and building wrk. Specialist inspectins t be undertaken. It is imprtant that yu read and understand all cnditins f the Building Cnsent befre cmmencing wrk. If yu d nt understand any cnditin impsed, please cntact us t discuss these. 34. Hw lng d I have t cmplete the wrk? Wrk must have cmmenced within 12 mnths f the date f issue r the building cnsent lapses requiring a new applicatin r the wner can apply fr an extensin f time t cmplete wrk. Yu are required t apply fr a cde cmpliance certificate as sn as the building wrks are cmplete. If the prject has been delayed, it may be pssible t apply fr an extensin t this time. If the decisin is t refuse t issue the cde cmpliance certificate the Building Cntrl Officer writes t the wner advising the decisin and reasns fr the decisin. 35. Amendments and Variatins t Building Cnsents All building wrk in cnjunctin with a building cnsent must be dne in accrdance with the plans, specificatins and detail prvided with the building cnsent. If yu wish t change sme aspect f the prject yu must apply fr an amendment r a variatin t the building cnsent and this must be apprved befre the wrk is carried ut. Decisins abut whether a change meets the definitin f a minr variatin and whether the minr variatin can be granted are the respnsibility f the BCA, nt any ther party. Fllwing receipt f a minr variatin prpsal the BCA will advise the applicant whether the change will be assessed as a minr variatin r is t significant a change frm the cnsented building wrk and requires a frmal applicatin fr an amendment t the building cnsent. A minr variatin requires a frmal applicatin. The Building Cntrl Officer will advise the wner r authrized agent t cmplete a variatin applicatin frm which will be added t the cnsent file. Als required frm the designer r builder are accmpanying revised architectural plans r cnstructin details cvering the prpsed change. The prcess fr btaining an amendment is similar t btaining the riginal cnsent. Full cnstructin detail f any changes must be submitted with an applicatin fr Amendment t a Building Cnsent which must then be prcessed and apprved by the BCA. 36. Wh des inspectins fr the Kawerau District Cuncil? The Kawerau Building Cntrl Officer and cntracted Building Cntrl Officers, and in sme circumstances there may als be inspectins by specialists where there are cmplexities fr the prject that are beynd the cmpetencies f the BCA staff eg. Engineers. Where Prducer Statements require inspectins by Engineers it is the wner s respnsibility t ensure these inspectins are carried ut. Recrds f these inspectins must be prvided t the BCA with any PS4 issued by the Engineer. 37. What inspectins d I need? This may include inspectins by third party specialists t determine cmpliance f the building wrk. Typical inspectins include; Site - lcatin f the building n site (a surveyr s reprt r visible bundary markers). Pre-slab - plumbing in/under the flr slab. Fundatin - befre placing any cncrete fr fundatin walls r ftings. Piles - befre placing any cncrete fr pile fundatins (timber r cncrete). Pre-slab - befre placing any cncrete fr cncrete flr slabs and any integral ftings. Masnry - befre placing any cncrete r cncrete blck walls. Sub-flr - befre cvering any subflr framing. Framing - all fixtures visible. Wrap/cavity - upn cmpletin f the building wrap with flashings/tapes installed and befre fitting any external cladding. Brick - brick wrk at half height. Weather-tight - befre applying any catings t the external cladding system. Pre-line - befre fitting internal linings r installing wet area membranes, air seals fitted internally arund jinery, bracing cnnectins cmplete. Pre-line - plumbing systems befre fitting any linings. Pst-line bracing - while fixings are still visible. Pst-line wet area membranes inspectin f installed wet area membranes befre installatin f finish surfaces such as tiles. Drainage - testing any drainage wrk prir t back filling and befre cvering any field drains. 38. Site Safety Final - final inspectin n cmpletin f all building wrk. On the cnstructin site, the safety f peple, including Building Cntrl Officers, is yur respnsibility. This includes prviding safe access t all parts f the site t allw wrk t be inspected. A Building Cntrl Officer will refuse t undertake the inspectin if the area is unsafe. Check that yu are ready befre yu bk the inspectin. If wrk is nt ready, it will be failed. Repeat inspectins may incur additinal csts. The Building Cntrl Officer will check all items n the inspectin checklist, and they must be cmpliant in rder fr the Building Cntrl Officer t pass the inspectin. It is preferable that the wner r an agent be available n site fr all inspectins. While we appreciate that this may nt always be pssible it is mandatry that fr final inspectins the wner r their representative is n site. 39. Inspectins by Others Smetimes it is necessary fr specialists t cnduct inspectins in additin t the inspectins carried ut by the Building Cnsent Authrity, eg structural engineers, fire engineer, r the need fr a specialist practitiner respnsible fr certifying the wrk. If a specialist inspectin is necessary yu will generally be advised befre the cnsent is issued. Typically these types f inspectins may invlve having a getechnical engineer cnfirm grund stability, r having an aspect f specific structural design checked by a registered engineer. Please ensure yu read inspectin requirements and are familiar with them befre cmmencing wrk. 40. Hw d I bk an inspectin? Building inspectins are bked by cntacting Cuncil s Custmer Services Officers r the Building Cntrl Administratr - telephne 07 306 9009. Inspectins can be undertaken Tuesday and Thursday 9.00am t 4.00pm (excluding public hlidays). Inspectins requested utside these timeframes will be subject t availability f the Building Cntrl fficer. Fr an inspectin t take place, the apprved plans and cnsented dcumentatin must be available n site. The Building Cntrl Officer will be inspecting the building wrk against these apprved dcuments. On cnclusin f all inspectins the utcme f the inspectin is recrded n the relevant inspectin sheet and if the inspectin has passed, then wrk can cntinue. N.B: If we arrive n site and the apprved plans and dcumentatin are nt available we will nt undertake the inspectin. Yu may hwever be billed fr ur time. 42. What if the inspectin has nt been apprved? If an inspectin is failed, a verbal instructin will be given and the wrk t be rectified will be recrded n the relevant inspectin sheet and a site instructin sheet. A cpy f the site instructin sheet will be left with the wner r their representative. An inspectin f the remedial wrk will be required. If the wrk is nt remedied t the satisfactin f the Building Cntrl Officer a Ntice t Fix is likely t be issued. 43. What is a Ntice t Fix? A Ntice t Fix is a frmal ntice issued by the Building Cnsent Authrity advising that certain wrks have nt been carried ut in accrdance with the Building Cnsent. If a Ntice t Fix is issued, yu are required t address the issues identified within a prescribed timeframe t prevent further actin being taken. Enfrcement f Ntices t Fix is undertaken by the Cuncil. If a Ntice t Fix is issued, a letter identifying the prcess will accmpany it If yu have nt applied fr a Cde Cmpliance Certificate within tw years frm the date the cnsent was granted yu will be advised in writing t cmplete an applicatin fr a Cde Cmpliance Certificate (Frm 6). If the wrk cannt be cmpleted, please cntact us t discuss an extensin f time. When all wrk has been cmpleted in accrdance with the Building Cnsent, ther relevant certificatin has been received, and all utstanding fees have been paid a Cde Cmpliance Certificate shall be issued. 45. What is a Cde Cmpliance Certificate? A cde cmpliance certificate is the Building Cnsent Authrities verificatin that all wrks undertaken cmply with the building cnsent. It is an imprtant dcument and shuld be retained fr future reference. It is mandatry fr the building wner t apply fr a cde cmpliance certificate after all wrk has been cmpleted. The applicatin frm fr cde cmpliance certificate, (Frm 6) is available n the website r Cuncil Office. Having received an applicatin fr a cde cmpliance certificate and it is fund that nt all the required infrmatin has been submitted with the applicatin the 20 day prcessing clck will be suspended. The applicant will be advised f the utstanding infrmatin. Once this infrmatin has been received the clck is re-started and the prcessing f the applicatin will cntinue. Buildings that require a cmpliance schedule will als have this issued with the cde cmpliance certificate. 46. What abut issuing Cde Cmpliance Certificates fr Building Cnsents issued under the 1991 Act r that have nt been issued by the BCA? Prviding we are satisfied that the building wrk cmplies with the building cde and the prvisins f the Building Act, then generally a Cde Cmpliance Certificate will be able t be issued. If the Cuncil is nt satisfied that the Building Act prvisins are satisfied r is nt satisfied that reasnable grunds exist t enable the issue f a Cde Cmpliance Certificate, then issue may be refused. We ntified yu in writing with the reasns fr the decisin nt t issue the Cde Cmpliance Certificate. Shuld Cuncil refuse t issue a Cde Cmpliance Certificate and yu cnsider that this is nt justified then yu may wish t apprach The Ministry f Business Innvatin and Emplyment (Building and Husing) and btain a Determinatin. 47. What is a Determinatin? A determinatin is a binding decisin made by the MBIE. It prvides a way f slving disputes r questins abut the rules that apply t buildings, hw buildings are used, building accessibility, health and safety. Althugh determinatins are generally sught because a building wner disagrees with Cuncil abut decisins made in regard t their building, a determinatin can be applied fr by Cuncil r by a neighbur wh may be affected by building wrk. 48. Applying fr a Determinatin T apply fr a determinatin yu will need t fill in Frm D1 and Part 1 f Frm D2 which are available n the MBIE website (www.mbie.gvt.nz), and pst this t MBIE with yur supprting dcuments and fee. 49. Hw lng des it take t get the Determinatin? The Ministry is required t issue the final determinatin within 60 wrking days f receiving the applicatin, r lnger if agreed t by the parties. The 60-day perid des nt include time delay while waiting fr infrmatin r cmment frm ther parties - the clck is stpped during these times. If yu can t prvide the infrmatin by the date given, yu may request an extensin. The Ministry has the pwer t make the determinatin if the infrmatin requested is nt prvided in reasnable time. 50. Building wrk that may need t be dne befre a Determinatin is issued If yu have been sent a Ntice t Fix abut wrk that is unsafe, yu must cmply with this Ntice. Otherwise, Cuncil cannt require yu t carry ut building wrk related t the determinatin unless the Department agrees this is necessary. 51. Cmmercial and Industrial Prperties Sectin 363 Public Premises. If yur building is pen t the public, whether fr free r payment f a charge, the building cannt be used/ccupied until a Cde Cmpliance Certificate is issued. This is because public premises will generally have systems within the building which cntribute t life, safety and well-being f the building user. (These systems are called specified systems). In certain circumstances it may be pssible t apply fr a Certificate fr Public Use, which will allw parts f a building t be used by the public befre the Cde Cmpliance Certificate is granted. Each applicatin will be cnsidered n a case-bycase basis. 52. What are Public Premises? What is a Cmpliance Schedule Statement? A Cmpliance Schedule Statement is issued by the Building Cnsent Authrity and serves as temprary ntificatin f cmpliance schedule requirements. It will list the inspectin, maintenance and reprting prcedures necessary t keep the specified systems in gd wrking rder. It is issued at the same time as the Cde Cmpliance Certificate. It must be replaced in 12 mnths with a Building Warrant f Fitness, which is issued by the building wner t Cuncil. 55. Hw d I btain a Cmpliance Schedule? A Cmpliance Schedule must be applied fr at the same time a building cnsent applicatin is made and will be issued with a Cde Cmpliance Certificate by the Building Cnsent Authrity fr: New buildings (if the building has ne r mre specified systems), r An upgrade t an existing building r systems, required as a result f a change f use r alteratins, which may als require a Building Cnsent. 56. What infrmatin d I need if I am applying fr a Cmpliance Schedule? Yur designer shuld prvide yu with infrmatin relating t the perfrmance standards fr each specified system cntained within the building. These perfrmance standards will identify the inspectin, maintenance and reprting prcedures required fr each system. 57. Can I be prsecuted fr nt btaining a Cmpliance Schedule r if my Building Warrant f Fitness has expired? Yes, depending n the alleged ffence the fine can be up t 20,000 and further fines f up t $2,000.00 per day if the ffence cntinues. 58. What is a Building Warrant f Fitness (BWOF)? A building warrant f fitness (Frm 12) is a statement issued by the building wner t Cuncil stating that the requirements f the cmpliance schedule have been fully met. The building warrant f fitness must have attached t it all certificates f cmpliance issued by the Independent qualified persns (IQP). These dcuments must be issued in the prescribed frm (Frm 12A) and certify that the inspectin, maintenance and reprting prcedures stated in the cmpliance schedule, have been fully cmplied with during the previus 12 mnths. Yu are legally required t btain written reprts relating t the inspectin, maintenance and reprting prcedures f the cmpliance schedule which must be signed by the Independent qualified persns (IQP) wh has carried ut any f the listed prcedures, (inspectin, maintenance r reprting). Yu are required t keep all reprts tgether with the cmpliance schedule fr a perid f 2 years and prduce thse reprts fr inspectin when required. 60. What is an IQP (Independent Qualified Persn)? An Independent qualified persns (IQP) is a persn wh is qualified t carry ut any perfrmance inspectin, maintenance, reprting r recmmendatin n a specified system. All Independent qualified persns (IQP) are required t be registered with Cuncil. 61. Cmplaints What happens if I am unhappy abut any decisin made by the Building Cnsent Authrity? A custmer has a right t appeal r t cmplain abut any building cntrl functin the Building Cnsent Authrity undertakes; and have this heard and be prperly managed. Cmplaints prvide feedback abut service experience and give us the pprtunity t imprve ur perfrmance. 62. What is a Building Cntrl Functin?
