WORKOUTS AND RESTRUCTURING We represent our clients in connection with the financing on their deals in both the good times and the challenging times. In challenging times, when a property fails to perform as expected and a loan default exists or is imminent, we counsel our clients regarding their options; assist them in communications with investors, lenders, servicers and other third parties such as franchisors; and negotiate and document loan workouts and restructurings. Over the course of two years, we renegotiated construction contracts to permit completion of construction, worked out a series of mechanics liens and construction claims and amended the condominium documents to coincide with building as constructed. We assisted our client in more than 100 individual unit sales and negotiated a note sale. Throughout the foreclosure process, we represented the Receiver in monthly Chancery Division hearings, which the Judge anointed as his most successful foreclosure matter. Represented receiver of a 750,000 SF suburban shopping center. During the course of the receivership we have assisted our client in the sale of outlots, and lease of shop spaces with national and local retail tenants. We have assisted in the implementation of a Special Service Area Agreement among the developer, the municipality and the Big Box owners of lots within the shopping center.
