The Vineyards The Walden Garden Society Rules and Regulations The following is a summary of selected Use Restrictions, Obligations of Owners, consideration for common walls and other requirements, as detailed in the Walden Garden Society The Vineyards Covenants, Conditions, and Restrictions ( CC&R s), and of Rules and Regulations as approved by the Walden Garden Society Board of Directors ( BOD ). The Rules and Regulations and other covenants are intended to protect the natural character of the landscape and the right of each property owner and resident to enjoy our community. Homeowners are strongly encouraged to review the Walden Garden Society CC &R s, in addition to the Rules and Regulations stipulated herein, particularly when making architectural plans and requesting and Board of Directors approval. Rules & Regulations as approved by the Board of Directors of the Walden Garden Society ( The Vineyards ): 1. Primary parking for resident and guest vehicles is the homeowner s garage and driveway. Parking spaces on the street are to be used only after the primary locations are occupied and spaces immediately in front of respective homeowner s house are to be used as secondary parking in consideration of other homeowners. 2. Vehicles of Resident guests, visitors, contractors, and other work vehicles are not to be parked overnight on the designated street parking spaces if space is available in the driveway or garage. 3. All residents, homeowners, guests, and visitors are to adhere to the posted twenty (20) mile per hour vehicle speed limit. Speeding will result in fines on first offense. 4. Each residence is for the occupation of the homeowner and their guests and visitors. No residence may be used for a business nor may it be occupied exclusively by nonhomeowners, such as renters or lease holders. 5. Dirt or construction debris must never be placed in the street or parkways, but rather in proper waste containers. Any waste container to be placed in the street for longer than 24 hours must have permission of the BOD. Permission, if given, will be for shortest period required for construction or other project. Any damage done to street or common areas as the result of the construction activity shall be returned to original condition at the expense of the homeowner. 6. Access through the entry gates, both East and West, via remote control devices, is a privilege granted to homeowners who are current on payment of their homeowner s dues. Homeowners not currently paid on HOA dues are subject to loss of remote control access. 1
Select Summary of Walden Garden Society The Vineyards CC&R s. Homeowners should consult the CC&R s in their entirety. 1. Lots are for residential purposes only. A home office is permitted as long as it does not increase noise, odors, pedestrian or vehicular traffic within the properties.(article VII, Sect. 1) 2. Prior review and approval by Architectural Committee is required before any modifications to the exterior of residence, including structural additions, major landscaping and construction of hard-scape, exterior paint and fencing.(article VI, Sect. 1 & 2) 3. Homeowners must limit For Sale signage of residence to (1) sign, of not more than 18 inches by 24 inches and for a duration of no more than six months. No other signage is permitted except small security company signs. Contractors signs are permitted only while construction is in progress. Once project is completed, signage must be removed within 30 days. (Article VII, Sect. 3) 4. No noxious or offensive activity shall be carried on upon any Lot or any part of the Properties, nor shall anything be done thereupon which may be, or may become, an annoyance or nuisance to the neighborhood, or which shall in any way interfere with the quiet enjoyment of each of the owners of his respective dwelling unit, or which shall in any way increase the rate of insurance. All written complaints received by the Board will be investigated. Any action will be governed by the Walden Garden Society The Vineyards CC & R s and Rules and Regulations stated herein. (Article VII, Sect. 4) 5. One or two dogs, cats or other common household pets may be kept at homeowner s residence and may not be kept, bred or maintained for any commercial purpose or in unreasonable numbers. Notwithstanding the foregoing, no animals or fowl may be kept on the Properties which result in an annoyance or are obnoxious to residents in the vicinity. (Article VII, Sect. 6) 6. Dogs and cats are not allowed to roam freely within the community. When dogs are outside their gated backyard, they must be leashed at all times. Homeowners are required to observe animal leash law ordinances of City of Simi Valley.(Article XVIII, Sect.3) 7. No decorative screens, athletic equipment, sunshades or awnings (other than patio covers approved by the Architectural Committee) shall be installed on the front of any residential building unless specifically approved by the Architectural Committee. While not in use, portable sports equipment (e.g. Basketball hoops and soccer/hockey nets, etc.) 2
are to be stored within the confines of homeowner s garage or in fenced back yard and out of sight. (Article VII, Sect. 7) 8. Temporary parking of two hours or less for camper or motor home, solely for the purpose of loading and unloading, is permitted. (Article VII, Sect. 8) 9. All trailers, campers, motor homes, recreational vehicles, mobile equipment, boats, jets skis, snowmobiles, commercial or inoperative vehicles may not be parked on any street within the development property, any common area or at any residence. The above may be stored within the confines of the private garage and out of sight of residents, (Article VII, Sect. 8) 10. No motorized or off road vehicles of any type are permitted on any public open space lot or parcel or on the accesses from the Properties. (Article XVIII, Sect. 2) 11. Rubbish, trash and garbage should be regularly removed from residences and shall not be allowed to accumulate. All refuse containers; wood pits, storage areas; machinery and equipment are prohibited unless obscured from adjoined lots and streets by fence or appropriate screen approved by the Architectural Committee. Rubbish and recycle containers should be placed at curbside no earlier than the evening before pickup and removed the next morning or no later than the following evening. (Article VII, Sect. 9) 12. No radio or television receiving or transmitting equipment or antenna, external apparatus or satellite dish antenna shall be installed on any Lot except those permitted by California Civil Code Section 1376 and/or regulations adopted by the FCC. Roof mounted equipment must be placed in an unobtrusive area.(article VII, Sect. 10) 13. No owner shall interfere with his/her property s drainage. Water must flow to the designed drainage system toward the front of the property and the street.(article VII, Sect. 13) 14. Each owner shall maintain and keep in a state of good repair and attractive condition his Lot, the landscaping thereon and the exterior surfaces of the improvements thereon, including without limitation any fences or walls facing on a public street, another lot or the Common Area. (Article X, Obligations of Owners, Sect. 2) 15. Party Walls. Each wall or fence which is constructed and which is placed on the dividing line between separate Lots, shall constitute a party wall. Any Homeowner proposing to utilize, modify, make additions to or rebuild the party wall in any manner which requires the extension or other alteration thereof, shall first obtain the written consent of the adjoining Owner and the Architectural Committee. (Article XI, Party Walls, Sect. 1 & 4) 16. Homeowners shall maintain an appearance consistent with the standards of the community. Newspaper or other paper, bed sheets and such are not considered acceptable window coverings. Garages used as storage or work areas should be kept closed unless in 3
use. The rules and regulations are in place for the purpose of protecting the value and desirability of properties thus benefiting homeowners. Date: July 21, 2008 THE VINEYARDS THE WALDEN GARDEN SOCIETY RULES ENFORCEMENT POLICY The primary objective of the Board of Directors Rules Enforcement Policy is rules compliance. Under the California Civil Code, all homeowners associations are required to publish a fine schedule. Enforcement and fines may vary depending on the Board of Directors interpretation of the facts presented. Each owner shall fully comply with said Covenants, Conditions, and Restrictions and with Rules and Regulations governing the use of the Community as adopted by the Walden Garden Society The Vineyards Board of Directors. (Article X, Sect. 1) Homeowners Obligations: ENFORCEMENT POLICY & SCHEDULE OF FINES 1. Homeowners shall maintain and keep property in a state of good repair and attractive condition, including landscaping, exterior surfaces, fences and walls facing public streets. (Article X, Sect. 2 & 7) 2nd warning Final step Second courtesy letter to homeowner Fine of $250 per month until resolved, to be included in each monthly statement Explanation: Until the homeowner has met the terms of the Walden Garden Society The Vineyards Rules and Regulations/CC&R s, the monthly fines will continue. 2. Parking violations: Final step Fine of $100 per month, to be included in each monthly statement 3. Speeding violations: 1st occurrence Fine of $50 with letter to homeowner 2nd occurrence Fine of $100 with letter to homeowner 3 rd or more occurrences Fine of $150 to be included in each monthly statement 4. Noncompliance with general Rules and Regulations and with Walden Garden Society The Vineyards CC&Rs. 4
Final step Fine of $250 per month until resolved, to be included in each monthly statement GENERAL POLICY GUIDELINES AND RECOMMENDATIONS: This is a general list where fines are required. It is not comprehensive and others could be added as needed. When called to appear before the Board of Directors to present your situation, Please come prepared to explain your plan of action. Payment of any and all legal fees or costs incurred by the Walden Garden Society BOD to enforce compliance or collect fines will be the responsibility of the homeowner. Owners are responsible for any damages caused by themselves or their guests to common areas including Entry and Exit gates. The Walden Garden Society The Vineyards Home Owners Association s Rules and Regulations/CC & R s are enforced for the community s benefit, and provisions are included in the governing documents to assess monetary penalties for violations.
