CARRIAGE HOMES AT BRIDGEWATER BAY Lease Application Clause By signing and submitting this Application for Lease, the Owner and Lessee acknowledge and consent that, should the prospective tenancy and lease be approved by the Bridgewater Bay Carriage Homes Association, Inc. (the Association ), and the Lessee takes occupancy of the subject unit, in the event any installment of the condominium assessments or other charges for the unit during the term of the tenancy shall not be paid when due, the Association is authorized to notify the Lessee that future rent payments shall be remitted to the Association until further notice. Such payments shall be applied by the Association to the unpaid assessments or charges, including late fees, interest, and maintenance arrearage. At such time as the arrearage has been completely offset by the rent payments or otherwise brought current by the Owner, any surplus remaining from such rent payments shall be paid by the Association to the Owner and the Association shall forthwith notify the Lessee that the Lessee may resume making rent payments to the Owner. In the event the Lessee shall fail to comply with the Association s notice pursuant to this paragraph directing the Lessee to make rent payments to the Association, such failure shall be deemed a breach of the Owner s and Tenant s obligations to the Association and a default event under the lease. Upon the lessee s failure to cure such default within ten (10) days following the Association s written notice of such default sent by certified mail to the Tenant addressed to the subject unit and to the Owner at the address appearing on the Lease, the Association shall thereupon be entitled to rescind its approval of the tenancy and the Lease, and thereupon to commence in its own right eviction proceedings against the Tenant. By executing this application, the Owner and Lessee specifically acknowledge that this provision shall survive the approval of the lease agreement by the Association and shall be binding and effective for the term of the lease, including any renewal. This provision shall be deemed incorporated into the lease agreement between the Owner and Lessee and enforceable by Association as a third party beneficiary. No application will be processed unless fully completed with appropriate check(s). The completed application must be submitted along with a copy of the lease, at least, 20 days before Lease start date. 2. FEES TO INCLUDE: A non-refundable $100 Application Fee PAYABLE TO TURTLE BAY I is required. (Seasonal Tenants: You are NOT excused from paying this fee). Criminal Background Checks: $50 per adult PAYABLE TO TURTLE BAY I. One check is acceptable. A COPY OF YOUR LEASE AGREEMENT IS REQUIRED. 3. A fully executed copy of the lease agreement must be enclosed with this application along with 2 letters of reference, business or professional. An interview with the applicant(s) is required prior to lease application approval. 4. No subleasing or assignments of lease rights are allowed. 5. Tenants & guests are NOT allowed to have pets. 6. Rentals: 30-day lease minimum / 12-month maximum / No more than six (6) rentals per year. 7. Vehicles and Parking: Parking is restricted to (2), two private automobiles and passenger-type mini-vans, jeeps and pick-up trucks having a capacity of no more than 2 tons and those vehicles permitted by Community Documents. No Commercial vehicles, campers, mobile homes, motor homes, house trailers or trailers of every other description, recreational vehicles, boats, or boat trailers shall; be permitted to be parked or to be stored on the condominium property, except in closed garages, so long as such storage in the garage does not require permitted vehicles to be improperly parked. 8. Garbage & trash shall be securely bagged and kept in Rubbermaid type receptacles in garages at all times except when receptacles are placed at the curb for scheduled pick up by Waste Management. No receptacles shall be placed at the curb more than 12 hours prior to scheduled pick-up or remain at the curb more than 12 hours after pick-up. Pickup schedule is as follows: Wednesday: Recycling and Trash pick-up is between: 6:00 am 6:00 pm Saturday: Trash only 6:00 am - 6:00 pm 9. Garage Doors shall be kept closed at all times except as necessary for ingress or egress purposes. Garages may only be used for the purposes intended and may not be converted to additional living space. 10. Entry Codes, gate access barcodes and the FOB s (keyless entry to be used to enter the clubhouse). Please make an appointment with the Assistant Property Manager at 239-592-5111 Monday through Friday 8:30am 4pm at the clubhouse to register and obtain your entry codes. Bar Codes for the gate can be sold to annual tenants for $5.00. The FOB s and Tennis Keys are obtained from the Owner of the property. 11. Guests who occupy the unit in the absence of the unit owner must register with the association at the clubhouse. 12. In the event that an owner of this unit is more than 30 days late paying fees due to the Carriage Home Association of Bridgewater Bay (CHA) and the amount exceeds $100. CHA reserves the right to collect the regular monthly rent directly from the tenant to the extent necessary to recover those monies owned to CHA. Should this action be required, both the owner/agent and the tenant will be notified by mail by the CHA board and a monthly accounting will be made to the owner/agent until the outstanding debt is satisfied. Any monies collected in excess of the owners debt will be turned over to the owner/agent. At that point, rent collection will revert to the terms specified elsewhere in this lease.
