RECOMMENDATIONS: A. THAT "2017 Delta Permissive Taxation Exemption Bylaw No. 7601,2016", be given first, second and third readings (Attachment A). B. THAT a grant to the Royal Canadian Legion, Branch #289 in the amount of $9,000 be approved. C. THAT a grant to the British Columbia Institute of Technology (BCIT) and Vancouver Community College (VCC) in the amount of $77,000 be approved. PURPOSE:._...--_..._..._-_..._._-._-_...--. The purpose of this report is to seek Council's approval to exempt specific community service properties from municipal taxation for the year 2017. In addition, Council is asked to award a grant to the Royal Canadian Legion, Branch #289 and BCIT and VCC in lieu of permissive tax exemptions. BACKGROUND: This r~port was considered at the September 9, 20~ 6 meeting of the Finance Assistance Review Committee, and at the September 22, 2016 meeting of the Mayor's Standing Committee on Finance. Both committees support the direction and recommendations contained in this report. A permissive tax exemption is a means for Council to support organizations within the community by exempting land and/or improvements from municipal property taxation. There is no obligation to grant exemption. In order for organizations to qualify for exemptions, they must first meet criteria as set out in the Community Charter. The next step is to determine whether organizations meet Delta's Permissive Tax Exemption Guidelines.

2017 Permissive Tax Exemptions Council Policy: Page 2 of 4 September 21, 2016 The following are the Permissive Tax Exemption Guidelines for determining eligibility for exemptions: The use of the property must be consistent with municipal policies, plans, bylaws, and regulations. The organization must be non-profit. The services of the organization should be complementary extensions of municipal services and programs. The PermissiveTax Exemption will be based on the principal use of the property. Delta residents must be primary beneficiaries of the organization's services. DISCUSSION: 1. Permissive Tax Exemptions For the 2017 taxation year, the permissive tax exemption bylaw (Attachment A) has been updated as follows: Renewal Applications Renewal applications were received for 92 properties from prior year recipients of a permissive tax exemption. These renewal applications have been thoroughly reviewed to ensure compliance with Community Charter legislation and Delta's Permissive Tax Exemption Guidelines. It is recommended to grant exemption for all of the renewal applications received. New Applications There were no new applications. ", Delta Museum and Archives Society The Corporation of Delta assumed responsibility for providing museum and archive s~rvices. The five properties that were previo!-lsly provided a permissive tax exemption will now be exempt as municipal properties. The Delta Museum and Archives Society has been removed as an occupier on these Delta-owned properties. Kinsmen Retirement Association., I During 2016, the Kin House was demolished and the construction of the new Reach Child and Youth Development Society's child development centre is underway. The Kinsmen Retirement Association has been removed as an occupier on this Delta-owned property for 2017.

2017 Permissive Tax Exemptions Private Schools Page 3 of 4 September 21, 2016 During 2016, the Community Charter Section on statutory exemptions was amended to provide private schools with the same statutory exemption as a public school. This means private schools no longer require a permissive tax exemption. In Delta there were four private school properties that previously received a permissive tax exemption. Delta Christian School Society, Immaculate Conception School, Sacred Heart School and Southpointe Academy have all been removed from the permissive tax exemption bylaw. 2. Grant in Lieu of a Permissive Tax Exemption As an alternative to providing a permissive tax exemption, Council could support an organization by awarding a grant in lieu of a permissive tax exemption. The Royal Canadian Legion, Branch #289 The Royal Canadian Legion, Branch #289 leases a property in Tsawwassen from a private entity and property taxes are paid directly to the private entity. Since 2010, Delta has provided a grant to the Legion that approximates the amount of municipal taxes to recognize their services to the community. The Legion has requested for consideration of a property tax relief grant in 2017 (Attachment D). It is recommended that a grant of $9,000 be awarded to the Royal Canadian Legion, Branch #289 in lieu of a permissive tax exemption. BCIT and VCC, Annacis Island Campus.~,: r: i3 ~:! U,I j In 2014, BCIT and VCC opened a joint campus on Annacis Island to deliver training and conduct research in support of the transportation sector. Under provincial legislation, campuses owned by BCIT and VCC are exempt from property taxes. Because the Annacis Island Campus is leased from a private entity, BCIT and VCC are not statutorily exempt from property taxes and do not qualify for a permissive tax exemption. In 2016, Council awarded a grant. of $71,500 in lieu of a permissive tax exemption to provide support to the Annacis Islan.d Campus. BCIT and VCC have requested for con~ideration of a property tax relief grant in 2017 (Attachment E). It is recommended that a grant of $77,000 be awarded in lieu of a permissive tax exemption, which equates to approximately half of Delta property taxes. Implications: Financial Implications - Properties included in the bylaw result in an estimated $856,000 in exempted municipal taxes for Delta. Attachments Band C provide further financial information on the proposed amounts exempted for each organization. Additionally, with Council approval, grants totaling $86,000 would be awarded to the Royal Canadian Legion, Branch #289 and BCIT and VCC, Annacis Island Campus.

WHEREAS; pursuant to Sections 220 to 227 of the "Community Charter", the Council may, by bylaw, exempt certain buildings and lands from taxation under Section 197(1 )(a) of the "Community Charter"; AND WHEREAS, pursuant to Section 224 of the "Community Charter" the Council may, by bylaw, exempt specific.community service organizations' land, improvements or both from taxation under Section 197(1)(a) of the "Community Charter"; AND WHEREAS, pursuant to Section 131(1) of the "School Act" S.B.C. 1996, as amended, property that is exempted from taxation under the "Community Charter" is also exempted from taxation under the "School Act". NOW THEREFORE, the Council of The Corporation of Delta in an open meeting assembled, ENACTS AS FOLLOWS: -1. This bylaw may be cited for all purposes as "2017 Delta Permissive Taxation Exemption Bylaw No. 7601, 2016". 2. The entire parcel of each of the lands described in Schedule "A" attached hereto and forming part of this bylaw together with the improvements situated thereon are exempt from taxation under Section 197(1 )(a) of the "Community Charter" in accordance with the provisions of Section 224(2)(f) of the "Community Charter" for the year 2017. The portions of the parcer of lands as described in Schedule "B" attached hereto and forming part of this bylaw together with the improvements situated on the portions as so described are exempt from taxation under Section 197(1 )(a) of the "Community Charter" in accordance with Section 224(2)(f) of the "Community Charter" for the year 2017.

We struggle financially each month to maintain our not-far-profit premises, with the bulk of our net revenue consumed by the substantial commercial rent to Century Group. We depend heavily on the volunteer efforts of our members and executive for the daily operations of the branch. This RCL branch is very proud to benefit our community and humbly request your consideration of a tax relief grant once again for the taxation year 2016-2017. Our commitment to Delta organizations and veterans in our community in need is unwavering and our donation Committee meets regularly to select the recipients from the many requests for support we receive throughout the year. We take this mandate and duty to the community very serious and hope to continue our giving for years to come. Jackson Council Members The Corporation of Delta 4500 Clarence Taylor Crescent Delta, BC V4K 3E2 Re: Request for 2017 Tax Relief Grant: BCIT and VCC Annacis Island Campus Introduction With the support of municipal and provincial governments and industry partners BCIT and Vancouver Community College (VCe) has established a joint campus on Annacis Island at 1608 Cliveden Avenue to conduct research and deliver training for the transportation sector. The purpose of this letter is to request a 2017 tax relief grant for the campus from the Corporation of Delta as we are not eligible to apply for a Permissive Tax Exemption. A copy of 2016 tax relief grant is attached. VCC and BClT are non-profit and registered charities funded by the provincial government and governed by legislation under The College and Institute Act. Both institutions are post-secondary educational organizations and offering various programs in advanced technological & vocational fields to different communities over 50 years. Both institutions own their existing campuses currently located in Vancouver, Burnaby, North Vancouver and a satellite campus in Richmond. Under legislation, all owned campuses are exempt from municipal property t;:lxes, however; the Annacis Island campus was acquired through a 30-year capital lease. Background BClT was required to relocate the heavy trades program from its Great Northern Way campus to make room for the construction of a new Emily Carr University facility. VCe's heavy trades program currently located at the Broadway campus was over crowded. The Annacis island location is perfectly situated for our student demographic who are drawn from the entire lower mainland, and industry partners. This renovated 144,000 square foot building is equipped wit~ state of the art infrastructure for education, and applied research. The capacity of this facility will allow BClT and VCC to prepare youth and apprentices to fill a variety of high demand jobs in support of Provincial initiatives, while also providing ao research venue for LNG, diesel emissions, marine and rail innovations. Moving in through August 2015, the campus opened its doors to students on September 15 th 2014. BCIT and VCCcombined have approximately 1400 students living in Delta and attending programs delivered at all our campuses in the lower mainland. Currently with a total 1,248 students attending in 6 **programs and 5 to 6 annual research projects anticipated in this campus, the annual contribution to Annacis Island in the municipality of Delta is. significant. Conclusion BCIT and VCC have established the Annacis Island Campus to deliver training and conduct research in support of the transportation sector. This is a long term initiative that we believe will provide substantial social and economic benefits to the municipality of Delta and its residents, and enhance the quality of life for the community. We therefore request the Council grant the property tax relief for the Annacis Island Campus as part of our ongoing support and partnership with the municipality.
