Request The applicant is requesting the rezoning of 1.8 acres from B-N (Neighborhood Business) to CZ I-G (Conditional Zoning General Industrial) to permit an auto body shop to be expanded. The auto body shop on this property is a nonconforming use. Under the Unified Development Ordinance, a nonconforming use cannot be enlarged. An auto body shop is classified as vehicle repair, which is a permitted use in the I-G district and a conditional use in the Eastern Lincoln Development District. If this rezoning request is approved, the use of the property would be subject to the approved plan and any conditions mutually approved by the county and the applicant. Site Area & Description This property is located at 1634 N. NC 16 Hwy., on the east side of N.C. 16 Business about 1,200 feet north of Smith Harbour Drive. It is adjoined by property zoned B-N, I- G and PD-MU (Planned Development Mixed Use). Land uses in this area include business, industrial, institutional and residential. The NC 16 Corridor Vision Plan recommends concentrating commercial development in three identified community centers and in nodes around main intersections. This property is not located in one of those areas.

Additional Information Permitted uses Under current zoning: retail sales, offices, services, restaurant, etc. Under proposed zoning: expanded auto body shop. Adjoining zoning and uses East: zoned PD-MU, common open space in Smithstone development. South: Zoned B-N, retail sales. West (opposite side of N.C. 16 Business): zoned I-G, parking lot for Lincoln Charter School and auto body shop. North: zoned B-N, vehicle service. NC 16 Hwy. In attendance were Jeffrey Brewer, president of Scott Auto Body; employees Frank Phelps, Marcia Block and Brian Shannon; Carie Wadlinger, owner of the store next door; Jay Spears, owner of property on the opposite side of the highway; Commissioner Jim Klein; Planning Board chair Christine Poinsette and member Brian Rabalais; and Dr. David Curtis, owner of the property at issue. Mr. Brewer said Scott Auto Body has rented the property for seven years and is planning to buy it. Scott Auto Body is known for repairing high-end cars such as Jaguars, Lamborghinis and Aston Martins. Its main office is in Charlotte. Most of its customers at the Denver location live on this side of Lake Norman. The company is planning to invest $1.5 million in the location. The plans include upgrading the exterior of the existing building, tearing down an old building, expanding the body shop and adding landscaping. The company projects its business will grow 25% and 5-6 employees will be added. The company had wanted to utilize two driveways and connect them, but the N.C. Department of Transportation had reservations and is limiting access to the driveway on the southern side of the property. That driveway will be improved to provide a greater turning radius.
