Planning Commission Replat Arbor Lakes at Cobblestone Park, Ph. 10 Montville Township Meeting: May 4, 2016 App. No.: 037-2016-R Developer: Cobblestone Park Development Group, LLC Surveyor: TGC Engineering Site Area: 9.2244 acres Sublots: 30 Block: Block B10, 6.3713acres Zoning: Cobblestone Park PND Utilities: Central water & sewer School Dist.: Medina City Reviewer: Susan Hirsch EXECUTIVE SUMMARY The Cobblestone park development is located on the east side of Wooster Pike Road (SR 3) between Sharon Copley (SR 162) and Poe Roads, and Arbor Lakes at Cobblestone Park is located south of Cobblestone Park Drive in the southwestern portion of the development. The proposed replat will create 30 additional sublots and one block. The site is served by central sewer and water. Recommendation: APPROVAL WITH MODIFICATIONS Proposal: This replat of Block A10 proposes the following: Creation of 30 sublots served by central sewer and water. The extension of Wisteria Lane and Morning Glory Lane, and Lilac Trail are proposed as private streets consisting of a 60 foot easement for access, and water and sanitary sewer lines. Creation of Block B10, which is all the land that is not within the existing or proposed sublots. (See attached GIS map and Replat). Access: Access to the Cobblestone Park subdivision is from Poe Road on the south, Highland Park Drive on the north and Wooster Pike Road (S.R.3) on the west. The Arbor Lakes development accesses Cobblestone Park Drive at two locations. All streets within the cluster portion of the subdivision are to be private. The internal private streets are looped with three private drives off the loop. Site Conditions: The site is rolling with moderate slopes. Wetlands exist on the east central and southeast portions of the Arbor Lakes site. Background: The Planning Commission originally approved the Preliminary Plan for the subdivision in February of 2004 and it has been revised many times since. In March of 2004 a Concept plan was submitted for the Senior Cluster Homes, and in May of 2004 a Final plat for Phase 1A was approved that created Blocks A-D. Block A was designated as a block for senior cluster housing. A detailed approval history is contained in the table below.

The Declaration of Covenants, Conditions and Restrictions for the Arbor Lakes Cluster Area (DCC&R), dated July 23, 2006, and recorded as Instrument Number 2006OR026855 in the Recorder s Office for Medina County, Ohio, and as amended by the First Amendment, dated July 9, 2012, shall continue to apply to all of the property in Phase 10 of the Cobblestone Park Subdivision and shall not be amended by the Declarant without the approval of Montville Township. 2. Applicant/Developer responsible for replatting each individual dwelling footprint upon building completion; this can be done in groups and the replat will show the boundaries of each Dwelling Footprint and each Owner s Lot, as defined by the DCC&R, for purposes of showing the areas of responsibility for the Arbor Lakes Association and each Medina County Planning Commission Page 2 of 4 May 4, 2016

The end result will be that the homeowner will continue to own the building envelope Lot, but the revised subdivision plat will show the boundary of the Dwelling Footprint and the Owner s Lot for purposes of defining the areas of responsibility under the DCC&R and recorded plat. Staff Comments: 1. The following required data/information was not provided on or with the Replat (Subdivision Regulation section references are included): a. Notarized certification by the owner or owners of the subdivision and the offer of the dedication of streets and other public areas and that there are no unpaid taxes or assessments against the land contained in the plat. 404(D)(2)f.17. Provide notarized signature of the owner. b. Certification from the Township that the Replat as submitted is in compliance with local zoning standards and requirements. Such Certification shall be in the form of an executed signature block on the original mylar and signed by at least two of the Township Trustees. 404(D)(2)g.1. Provide signatures of at least two of the township trustees. c. A subdivision served by a public central sanitary sewer [and public central water] shall be certified by the Sanitary Engineer stating all required wastewater disposal facilities and central water facilities have been satisfactorily installed or adequate financial guarantees have been approved. Such Certification shall be in the form of an executed signature block on the original mylar. 404(D)(2)g.4. Provide the signature of the Sanitary Engineer d. Certification of County Engineer that all required improvements have been satisfactorily installed or financial guarantees have been provided to cover all construction and stating, Construction plans have been approved. 404(D)(2)g.5 and 8. Add the above text to the County Engineer statement and provide the signature of the County Engineer. e. Acceptance of offers of dedication by County Commissioners, when all improvements have been constructed, or financial guarantees and construction agreements have been approved. 404(D)(2)g.6. Provide the signature of the County Commissioners. f. Protective covenants, conditions and restrictions shall be either shown on the plat or recorded separately as a separate instrument, provided volume and page reference thereto is indicated on the plat. 404(D)(2)h and i. Provide a note indicating the subdivision is governed by a homeowner s association and provide a volume and page reference to the recorded protective covenants, conditions, and restrictions documents (as amended if applicable). 2. The proposed Replat is in substantial conformity with the approved Preliminary Plan. 3. The proposed Replat is in conformity with the Montville Township Zoning Resolution. 4. With Arbor Lakes at Cobblestone Park, Phase 9, the developer requested that all of the remaining sublots within Phase 9 be approved at one time. Also, the sublots were more traditional in that they included area for both the dwelling and yard. Medina County Planning Commission Page 3 of 4 May 4, 2016

Arbor Lakes at Cobblestone Park Subdivision Phase 10, Replat 5. With Phase 10, the developer is continuing development of sublots that include the building footprint and yard area. In Phase 10, the proposed sublots range in size from 3,429 sq. ft. to 5,700 sq. ft. 6. The applicant has agreed to record replat(s) of Phase 10 that show the building footprints as they are built. This replat(s) will also indicate that the area outside the building footprint that is within the sublot will be owned by the property owner but maintained by the Arbor Lakes Homeowners Association. 7. The Covenants and Restrictions for the Homeowner s Association has been reviewed and approved by the Medina County Prosecutor s Office. However, as a result of the change in the configuration of the sublots, and the fact that yard area will become the responsibility of the homeowners association, the HOA documents may need to be amended to address maintenance of the landscaping within the sublots. This needs to be addressed prior to the Director signing the replat. Recommendation: The Department of Planning Services recommends that the Medina County Planning Commission APPROVE WITH MODIFICATION the Replat for Arbor Lakes at Cobblestone Park Subdivision Phase 10 subject to the following: 1. Satisfy the Tax Map, Sanitary Engineer and Highway Engineer comments listed above. 2. Provide the following data/information on or with a corrected Replat: a. Provide notarized signature of the owner. b. Provide all other required signatures c. Provide a note indicating the subdivision is governed by a homeowner s association and provide a volume and page reference to the recorded protective covenants, conditions, and restrictions documents.
