Probably not. While nothing in Washington law or federal law appears to prohibit the filming of buyers' physical movements within seller's home, seller is prohibited, by Washington law, from intercepting buyers' conversation through an audio recording without first obtaining buyers' consent. RCW 9.73.030 says: "... it shall be unlawful for any individual... to intercept, or record any... Private conversation, by any device electronic or otherwise designed to record or transmit such conversation... without first obtaining the consent of all the persons engaged in the conversation." While the Hotline lawyer is not aware of any case law directly addressing this issue, it does not appear that there are any exceptions allowing the nanny cam, audio recording, absent buyers' consent. Moreover, buyers' consent must be given orally, as part of the actual recording. It is not enough for seller to post a sign in the home announcing that audio visual recording equipment is operating within the home. 4 Million Renters Say They're Eager to Buy (REALTORMag) Ten percent of U.S. renters say they want to buy a home in the next year, according to a new survey of renters in the 20 largest housing markets by Zillow. That means if all the renters buy a home in the next year that would amount to about 4.2 million first-time home buyer sales - double the number of first-time buyers in 2013, CNBC reports. Agents Target Unlisted Foreclosures with More Success (InmanNext) More than 8 in 10 real estate owned (REO) properties - 500,000-plus homes that could ease today's sharp inventory shortage - are unlisted, according to an estimate provided to Inman News by data aggregator RealtyTrac. And more than 9 in 10 of the estimated 844,000 homes that are in the foreclosure process but not yet repossessed are also sitting on the sidelines, according to RealtyTrac.
