June 12, 2018 REPORT TO THE CHIEF ADMINISTRATIVE OFFICER FROM THE DEVELOPMENT, ENGINEERING, AND SUSTAINABILITY DEPARTMENT ON DEVELOPMENT VARIANCE PERMIT APPLICATION NO. DVP00520 1988 SUNNYCREST AVENUE OWNER/APPLICANT: DAN LEGGATT PURPOSE To issue a Development Variance Permit to increase the maximum lot coverage for an accessory building from 80 m 2 to 102 m 2. SUMMARY The subject is property located on Sunnycrest Avenue in Brocklehurst, is zoned RT-1 (Two Family Residential-1), has a lot area of 1,133 m 2, and contains an existing single-family dwelling and an 11 m 2 accessory building. The property abuts two residential properties (east and west) as well as middle and elementary schools (Brocklehurst Middle School and Kay Bingham Elementary School), with a rear lane separating the subject property from the school properties. The applicant is proposing to construct a 91 m 2 accessory building in addition to the existing 11 m 2 accessory building to allow enough floor area for a garage and woodworking shop for personal leisure and storage. The maximum lot coverage for accessory buildings in the RT-1 zone is 80 m 2 ; therefore, a Development Variance Permit is required (Attachment A ). The intent of limiting lot coverage for accessory buildings is to avoid the construction of excessively scaled buildings in urban areas, ensure buildings are subordinate in scale to the principal dwelling, and reduce visual impacts on neighbouring properties. In this case, the proposed building would not be out of scale for this neighbourhood, as the typical lot size in the area is similar to more suburban zones where higher accessory building coverage is permitted. For example, the suburban RS-2 (Single Family Residential-2) zone permits accessory buildings up to 112 m 2 and a minimum lot size of 929 m 2. In contrast, the proposed variance would permit a lower lot coverage (102 m 2 ) on a larger lot area (1,133 m 2 ) than would be required in the RS-2 zone. In addition, the 1,133 m 2 subject parcel is more than twice the 464 m 2 minimum lot area in the RT-1 zone, and the percentage coverage of 9% in accessory building area is well under the 12% permitted in the RT-1 zone. The building is proposed to be located along the rear property boundary (approximately 20 m from the nearest dwelling), with access to the garage from the rear lane, which will minimize impacts on neighbouring properties. As there are no technical concerns with the application and the public notification process provides an opportunity for the public to provide input on the application, the Development, Engineering, and Sustainability Department supports the application and advises Council to proceed as outlined in the recommendation.
