Department with the winning tender will be advised that their tender was accepted by the Enfield Fire Department, and will be notified of the delivery date of the replacement apparatus as soon as possible. CONDITIONS OF SALE 1. Condition of Property The property is offered for sale as is, where is. The description of the property is based on the best information available to the Enfield Volunteer Fire Department. However, unless specifically provided in the offer, the Enfield Volunteer Fire Department makes no warranty, expressed or implied, as to the quantity, kind, character, quality, weight, size or description of any of the material or its condition or fitness for any use or purpose. 2. Failure to Remove - Should the Purchaser fail to remove the property within fifteen working days from notice of apparatus availability, excluding weekends and statutory holidays or by any extension granted the Purchaser in writing by the Enfield Volunteer Fire Department. The Enfield Volunteer Fire Department without prejudice to any other remedies, may cancel the contract without notice to the Purchaser and retain as liquidated damages any deposit or amount paid on account of the property. The Purchaser shall lose all claim to and interest in the property and may be held responsible for all loss, cost and expense incurred by the Enfield Volunteer Fire Department due to his failure or default. 3. Title Unless otherwise provided in the Offer, title to the property sold hereunder shall rest in the Purchaser as and when payment is received in full. 4. Applicable Law - The Enfield Volunteer Fire Department and the Purchaser agree that any Agreement entered into is to be interpreted in accordance with, and governed by, the laws of Nova Scotia and the Purchaser irrevocably submits to the exclusive jurisdiction of the courts of Nova Scotia. 5. Damage to Property The Purchaser shall be responsible for any damage to property resulting from the removal of the property sold be it public or private property. 6. Adjustments If, through withdrawal, loss or error, property cannot be delivered to the purchaser, the Enfield Volunteer Fire Department liability shall be limited to a refund of the purchase price. 7. Liability The Enfield Volunteer Fire Department does not assume any liability for injuries suffered by or the death of any persons, or for any loss or damage arising out of the inspection, handling, removal, use or demolition of the property listed herein, and the Purchaser shall indemnify and save harmless the Enfield Volunteer Fire Department in all respects thereof. 8. Contract The Offer to Purchase form, and these Conditions of Sale together with the Enfield Volunteer Fire Department acceptance, shall when executed, constitute the entire agreement between the Purchaser and the Enfield Volunteer Fire Department, and time shall be deemed to be of essence in all respects thereof. 9.
