Proof of ownership of the property on which the temporary use is to take place. Only a property owner can authorize any use or temporary use permit for their own property. (property owner must be applicant and must sign and may authorize agent to act on his/her/their behalf) 2. Site plan (not required for yard or garage sales) drawn in detail showing all current structures and uses on the property in addition to the proposed placement of the temporary use structure(s). Drawing must include all proposed setbacks from all property lines and separation from other structures. Include septic, well, driveways, rights of way, power poles, signs, parking, etc. 3. Site plan should show all temporary uses indicated in the areas where they will occur. 4. Filing fee for the initial permit application 5. Renewal fees if requesting renewal, will be due at time of that request. Renewals not available for yard or garage sales. 6. All State and Federal licensing, tax collection/exemption documentation for any for which these are applicable (ie to include, but not limited to sales, fireworks, car or auto sales, etc). Not required for yard or garage sales. NOTE: for some uses/structures (such as, but not limited to, tent sales) a fire inspection may be required. If a fire inspection is required, depending on time constraints, the fire inspection fee may be required to be paid prior to the inspection being completed. In this case, the permit will state that it is contingent upon a passing fire inspection and posting of said passing inspection at the site beside the temporary use permit. Duration and expiration of the permit A temporary use permit may be approved for a period of time less than one year, depending on the specified use. Prior to any permit expiration period, application must be filed for an extension of the permit stating the reason for the extension and the time required. Only specific types of temporary use permits are allowed extensions. See appropriate LDR Sections for regulations. If the temporary use is not discontinued upon expiration of the permit, it shall be deemed a violation of the LDR and shall be subject to the penalties therein. It is the property owner s responsibility to maintain or renew a valid permit. Yard or garage sales: A maximum of 2 yard sales are permitted per year, not to exceed three days for each sale. Additional requirements Approval of a temporary use permit may be subject to stipulations and conditions including, but not limited to the following: Traffic safety measures Additional parking requirements Limited activity hours Additional landscaping for temporary permit area Additional on-premise safeguards, which may include but are not limited to watchman, fencing, lighting, sanitary measures (depending on the use and zoning).
