RECOMMENDATION: Approve the use permit associated with a site plan to permit an outdoor café subject to the conditions of the staff report, and with a County Board review in one (1) year (July 2017). ISSUES: This is a request to operate an outdoor café within a public easement for the Whole Foods Market located within The Bartlett apartment building (SP #105; SP-9). The Crystal City Civic Association has expressed their support for this outdoor café and the Aurora Highlands Civic Association has not yet responded to staff with any concerns with this proposal. Though no outstanding issues have been identified with the request, the Applicant has been issued a Zoning violation for operating an outdoor café along 12th Street South and South Eads Street without the requisite use permit approval. for a certificate of occupancy for an outdoor café space along 12th Street South only, which would resolve the Zoning violation. SUMMARY: Whole Foods Market (the Applicant ) requests approval of a use permit application to permit the operation of an outdoor café along 12 th Street South. The Whole Foods Market is located within the ground floor of The Bartlett apartment building, which is the Metropolitan Park 4/5 site plan building that was approved by the County Board on July 13, 2013. Construction of the apartment building is complete and residents began occupying units in early June 2016. The Whole Foods Market opened for business at the end of June 2016. The approved Metropolitan Park 4/5 site plan (SP #105; SP-9) permits the operation of an outdoor café along 12 th Street South for the grocery store as long as certain conditions are met, such as the preservation of a nine (9) foot wide clear sidewalk. The Applicant s proposed outdoor café will consist of ten (10) tables and 32 seats that will be enclosed by a three (3) foot tall fence along the Whole Foods Market s frontage on 12 th Street South. As proposed, the outdoor café meets the conditions of approval for the Metropolitan Park 4/5 site plan, and is consistent with the County s practices and policies for outdoor cafes. Therefore, staff recommends approval of the use permit for an outdoor café for the Whole Foods Market located within The Bartlett apartment building, subject to the conditions of the staff report, with a County Board review in one (1) year (July 2017). BACKGROUND: The County Board approved the Metropolitan Park 4/5 site plan (SP #105; SP-9) on July 13, 2013, which allowed construction of a 699 unit multifamily residential building with ground floor retail including a full-service grocery store. The building was constructed as The Bartlett apartment building and contains a Whole Foods Market. Condition #80 approved with the site plan permitted outdoor café seating for the grocery store along 12 th Street South as long as it was in conformance with the County s Guidance for Outdoor Cafes, dated August 20, 2012, and that a minimum clear sidewalk width of nine (9) feet was maintained. Since the time of the site plan s approval, the County s Guidance for Outdoor Cafes was superseded by the approval of a Zoning Ordinance amendment that allows outdoor cafes within public easements through use permit approval (ACZO 12.9.14). DISCUSSION: The Applicant s proposed outdoor café for the Whole Foods Market in The Bartlett apartment building would be located within a public easement along the grocery store s frontage on 12 th Street South. The outdoor café will be enclosed by a three (3) foot tall fence and will contain ten (10) tables and 32 seats along with trash/recycling receptacles and outdoor speakers affixed to the face of the building. In addition, the outdoor café will maintain a nine (9) foot wide clear sidewalk along 12 th Street South as required by Condition #80. CONCLUSION: As proposed, the Whole Foods Market outdoor café meets the conditions of approval for the Metropolitan Park 4/5 site plan, and is consistent with the County s practices and policies for outdoor cafes. Therefore, staff recommends approval of the use permit for an outdoor café for the Whole Foods Market located within The Bartlett apartment building, subject to the conditions of the staff report, with a County Board review in one (1) year (July 2017). Conditions for SP105-9-U-15-2 1. The applicant agrees that an outdoor café is permitted on 12 th Street South only as shown between Vestibules 2 and 3 on the Whole Foods Market Seating Plan (dated May 26, 2016) (the Plan ), and that the outdoor café shall not be used until a certificate of occupancy has been obtained for that use. The applicant agrees to maintain a minimum of nine (9) feet of clearance width along all sidewalks for pedestrians. 2. The applicant agrees to comply with all requirements set forth in all applicable ordinances, codes and regulations, including, by way of illustration and not limitation, those administered by the Zoning Office (including the applicable requirements listed in Section 12.9.14. for Outdoor Cafes ), the Inspection Services Division, the Community Code Enforcement Office, the Police Department, and the Fire Marshal's Office. 3. The applicant agrees that no live entertainment or dancing are permitted in the outdoor café area at any time. The applicant agrees to comply with and follow the requirements SP105-9-U-15-2 - 3 -

listed in the Arlington County Zoning Ordinance (ACZO) Section 12.9.14. for Outdoor Cafes as they relate to sound or audio or video entertainment. 4. The applicant agrees that any umbrellas in the outdoor café shall not encroach beyond the railing shown on the Plan nor interfere with pedestrian movement along the sidewalk. The applicant also agrees that the railing and all other equipment as shown in the outdoor café on the Plan, including tables, chairs and recycling containers shall not be permanently affixed to the sidewalk. 5. The applicant agrees to designate a neighborhood liaison to communicate with the nearby residents and neighbors to address concerns which may be related to the outdoor café and an on-site liaison (this may be the same person) that shall be available during the hours of the business operation to receive and respond to developer/landlord and community concerns. The name, telephone number and electronic mail address (if available) of the on-site liaison shall be submitted to the Zoning Administrator and a copy sent to the Crystal City Civic Association and the Aurora Highlands Civic Association prior to the issuance of a certificate of occupancy for the outdoor café. 6. The applicant agrees that the County Board shall review the use permit upon any change in tenancy of the subject space. Such review shall occur prior to the issuance of a certificate of occupancy for a new business. 7. The applicant agrees that outdoor display of merchandise shall occur only subject to County Manager approval and in conformance with Condition #81 of SP #105; SP-9. SP105-9-U-15-2 - 4 -
