3 CHAPTER The Department of Agriculture Act Title 1 These regulations may be cited as The Grasshopper Control Assistance Program Regulations, 1986. Interpretation 2 In these regulations: (a) assistance means assistance paid by the minister pursuant to section 4; (b) eligible insecticide means a control product, as defined in the Pest Control Products Act (Canada), as amended from time to time, that is: (i) used to control grasshoppers; and (ii) registered and used in accordance with the Pest Control Products Act (Canada), as amended from time to time, and the regulations made pursuant to that Act; (c) individual means an individual who resides in a rural municipality; (d) road allowance means a road allowance in a rural municipality that is laid out pursuant to the authority of an Act or an Act of Canada; (e) rural municipality means a rural municipality within the meaning of The Rural Municipality Act. 17 Oct 86 cd-8 Reg 5 s2. Application 3(1) Subject to subsections (2) and (3), where: (a) a rural municipality has or individuals have applied eligible insecticides to road allowances during 1986; and (b) the rural municipality wishes to obtain assistance to reimburse the rural municipality or individuals for the costs incurred by it or them in purchasing the eligible insecticides; the rural municipality shall submit an application to the minister on the form provided by the minister. (2) A rural municipality shall submit its application pursuant to subsection (1) on or before December 31, 1986. (3) No rural municipality is eligible for assistance if it submits its application after December 31, 1986.
4 GRASSHOPPER CONTROL (4) The application mentioned in subsection (1) is to include a schedule, on a form provided by the minister, showing: (a) the name of the rural municipality and the names of all individuals who have applied eligible insecticides during 1986; and (b) with respect to each application of an eligible insecticide on a road allowance: (i) the location of the road allowance; (ii) the type of eligible insecticide applied; (iii) the rate at which the eligible insecticide was applied; (iv) the approximate area, expressed in acres, to which the eligible insecticide was applied; and (v) the cost of purchasing the eligible insecticide to conduct the application. (5) Where individuals have applied eligible insecticide to a road allowance and the rural municipality has applied on behalf of those individuals for assistance to them, the application mentioned in subsection (1) is to be accompanied by a declaration, on a form provided by the minister, signed by each individual on whose behalf the rural municipality is applying and witnessed by a commissioner for oaths or a notary public, declaring, with respect to each individual: (a) his name; (b) his address; (c) the particulars of each application by him of insecticide and the cost of the eligible insecticide applied; and (d) a statement that the information contained in the declaration is true to the best of his knowledge and belief. (6) The reeve of the rural municipality and the administrator, secretary or secretary treasurer of the rural municipality shall sign the application mentioned in subsection (1). 17 Oct 86 cd-8 Reg 5 s3. Assistance 4(1) Where the minister: (a) has received an application from a rural municipality pursuant to section 3; and
5 (b) is satisfied that the application conforms to the requirements of section 3; he may provide assistance to the rural municipality in an amount required to reimburse the rural municipality and the individuals on whose behalf it is applying for the costs incurred in purchasing eligible insecticides applied on road allowances during 1986. (2) Where a rural municipality has applied for assistance to reimburse individuals and it receives assistance from the minister, the rural municipality shall pay to those individuals any moneys it receives as assistance to reimburse those individuals in the amounts disclosed on the application as the costs incurred by those individuals in purchasing eligible insecticides. 17 Oct 86 cd-8 Reg 5 s4.
