(the "Property") Dear Gwinnett County Commissioners and staff: This letter of intent and Buffer Reduction Application are submitted on behalf of the property owner, Tarek Real Estates, LLC (the "Applicant") to allow for the use of the existing 25 foot buffer and retaining wall, for a quality redevelopment. The subject property contains an aging convenience store and car wash, located at the comer of Indian Trail-Lilburn Road and Dickens Road. The property is located at a commercial intersection with similar uses. The property was zoned C-2 in the 197's and includes a retaining wall and a 25 ft. buffer, made up mostly of shrubs and tall pine trees. At this time, the property owner seeks to redevelop the site into a new, quality convenience and retail store, including the elimination of the outdoor carwash. The architecture would be similar to the Circle K store design submitted with this application. The new building also requires a retaining wall. The property is located adjacent to a single-family home, and the Gwinnett County's Unified Development Ordinance ("UDO") requires a 75 ft. buffer between C-2 and residential zoning classifications. However, the updated buffer requirements make redevelopment impossible, leaving little to no room for a building, parking, gas pumps, and access. Accordingly, in order to redevelop the property and meet development requirements, the Applicant requires a buffer reduction for the use of the existing retaining wall and 25 ft. buffer. The buffer would be replanted and enhanced, to be disturbed where necessary for grading or repairs to the retaining wall, consistent with Gwinnett County development and landscaping standards. In addition to the elimination of the aging car wash, the new store will greatly improve the appearance of this intersection and encourage the redevelopment of neighboring properties.
