SITE INFORMATION Public sidewalks run along Emerson Street and Gross Point Road. Overhead utilities run along the west side of Emerson Street and within an easement along the north side of the subject site. Driveways at Skokie Boulevard, Emerson Street, and Gross Point Road provide access to the subject site. An easement within the northeast corner of the subject site allows for vehicular access from Gross Point Road to the adjacent Concourse office building complex at 4709-4711 Golf Road. The site is served by the CTA 54A North Cicero/Skokie Blvd, CTA 97 Skokie, and Pace 208 Golf Road buses, which run on Skokie Boulevard, and the CTA 205 Chicago/Golf and Pace 215 Crawford-Howard buses, which run along Golf Road. PETITIONER S SUBMITTAL The petitioner is requesting a subdivision of 1 lot into 2 lots in a B3 Business district and a dedication of portions of right-of-way at the northwest and southwest corners of the intersection of Gross Point Road and Kenton Avenue. Lot 1 will contain the Jewel-Osco grocery store and drive-through pharmacy and associated parking lot, the access driveways at Skokie Boulevard and Gross Point Road, and the detention pond. Lot 2 will contain a Culver s limited service restaurant with drive-through facility (case 2016-3P). A 1999 agreement between the 2 existing property owners of the shopping center is in the process of being amended to grant access rights to the new owner of the Culver s property. Thus, no new access easements will be established in conjunction with the subdivision. Two small portions of land at the northwest and southwest corners of the Gross Point Road and Kenton Avenue intersection will be dedicated to place the existing public sidewalk entirely within the Gross Point Road right-of-way. STAFF ANALYSIS Comments Staff Comment and Review sheets were sent to all pertinent departments. No comments were received for the subdivision case. Planning Division The Planning Division supports the proposed subdivision. The subdivision will meet all requirements of the Village Code and Map Data Policy. The right-of-way dedications at the intersection of Gross Point Road and Kenton Avenue will place the public sidewalk entirely within the public right-of-way. STAFF RECOMMENDATIONS Staff recommends that the petitioner s request to subdivide 1 lot into 2 lots in a B3 Business district and dedicate portions of right-of-way at the northwest and southwest corners of the intersection of Gross Point Road and Kenton Avenue be GRANTED subject to conditions listed below. RECOMMENDED SUBDIVISION CONDITIONS 1. The property must be subdivided pursuant to the Jetco Properties, Inc. Resubdivision, dated <to be determined>, and as may be further revised with the approval of the Village Manager, or designee, and Corporation Counsel. 2. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the Jetco Properties, Inc. Resubdivision must be submitted to the Village with all signatures other than Village staff or elected officials. 3. The Jetco Properties, Inc. Resubdivision shall be effective upon its recording by the Village in the Office of the Recorder of Deeds of Cook County, Illinois. 4. All monuments must be set no later than 1 year after the date of the recording of the plat. 5. The petitioner must submit to the Planning Division electronic files of the plat of subdivision in approved and finalized form. The files must be scaled drawing files in AutoCAD format (version 2010 or older). The drawings must be formatted to SPCS, NAD83, HARN 2007, with SPCS north being straight up, and the primary units in U.S. Survey Feet. All elements must be contained within a single file, no XREF or PDF attachment files shall be used. 6. If work is to be performed on public property or if public property is utilized or impacted during construction and or development, the owner must provide, or must cause the developer and/or contractor to provide, the Village of Skokie with a certificate of insurance naming the Village of Skokie as additionally insured for any and all claims related to any and all work. The owner shall hold, and shall cause the developer and/or contractor to hold, the Village of Skokie harmless and indemnify the Village for any and all claims for property damage or personal injury related to work on or use of public property. 7.
