Enact the attached Ordinance to Vacate: (i) a Water & Sanitary Sewer Easement; (ii) a 10 Storm Sewer Easement; (iii) a Portion of a 5 Sanitary Sewer Easement; and (iv) Portions of a 20 Storm Sewer Easement, all on property known as Reed School located at 1644. McKinley Road, Arlington, Virginia (RPC# 10-022-030), with Conditions; and 2. Authorize the Real Estate Bureau Chief, Department of Environmental Services, to execute, on behalf of the County Board, the Deed(s) of Vacation and any other documents necessary to effectuate the Ordinance of Vacation set forth in Attachment 1 attached hereto, subject to approval of all documents as to form by the County Attorney. ISSUES: Arlington Public Schools ( APS ) has requested that the County Board vacate portions of utility easements which are necessary in order to allow APS to construct the renovations and expansion of the existing building for use as an elementary school. There are no issues related to this request as of the date of this report. SUMMARY: APS has requested that the County Board enact an Ordinance to vacate portions of utility easements located on the property owned by APS in order to allow renovation of the County Manager: ##### County Attorney: ***** 27. existing building and construction of a new building addition for classroom space. If enacted, the requested vacation ordinance would permit the vacation of portions of water, sanitary and storm sewer easements to facilitate redevelopment of the site. BACKGROUD: The subject site, known as 1644. McKinley Road, is located at the corner of Washington Boulevard and orth McKinley Road near the Westover Shopping Center (see Vicinity Maps at Attachments 3-5). APS has owned the property for more than 80 years when the original school was built and opened in 1938. The utility easements to be vacated were dedicated by Deed of Dedication and Easement dated October 30, 1949 and recorded in Deed Book 907 at Page 296 among the land records around the time when the original school building was expanded and altered in 1950. On July 7, 2007, the County Board approved Use Permit U-3175-07-1 for construction of a combined school and public library. The project included tearing down the old building, with the exception of the original 1938 shell, and rebuilding a new Reed School and Westover Library, containing approximately 61,504 square feet in area. The County leases the library space from APS under a Deed of Lease dated May 22, 2008. The School Board adopted the FY 2017-2026 Capital Improvement Plan (CIP), including a project to expand the existing Reed School to create a new elementary school with 732 seat capacity to be completed for the 2021-22 school year. On September 10, 2018, APS filed an application the County s Zoning Division for an amendment to Use Permit U-3175-07-1, which is the subject of a separate Board Report. If approved, the requested use permit amendment will permit demolition of a portion of the existing building, including portions of the construction completed in 2009, for reconstruction of a two and four story school building, containing approximately 112,919 square feet, on the northeast side of the existing building. As part of the new construction, the first and second floors of the existing building will align with the first and second floors of the new building. The addition will consist of school administrative offices, classrooms, gymnasium, kitchen, cafeteria, teacher support areas, and other building support spaces. The renovated areas of the building will include new music/art rooms, library, classrooms, teacher support areas, and other building support spaces. Site modifications and improvements will also be made to the entrance plaza in front of the main school entrance, the parent pick-up and drop-off areas, sidewalks, playgrounds, courts, fields, landscaping and storm water management facilities. DISCUSSIO: The proposed vacations will clean up the property title by vacating portions of the public utility easements that no longer contain facilities. The utilities in the locations identified were actually removed by APS for the construction of the building in 2007, but the easements were never vacated. At the time, the pipes were relocated, but new easements were not dedicated. As a condition of the vacation ordinance, APS will be required to dedicate and convey to the County new utility easements for any relocated utilities. In addition, small portions of a 20 storm sewer easement are necessary to relocate the easement to align with the existing storm sewer pipe that is located on the APS property. APS must satisfy the conditions of the vacation ordinance before the Deed of Vacation may be recorded in the land records. - 2 -
The proposed utility vacations are more specifically shown on the exhibit entitled Easement Vacation Exhibit, Walter Reed Elementary School, Civil Engineering Plan, 1644. McKinley Road, Use Permit, Arlington, Virginia 22205, Arlington County, Virginia, prepared by Bowman Consulting Group, Ltd., dated October 16, 2018 and attached hereto as Exhibit A ( Plat ). The easement areas to be vacated include: (i) a Water & Sanitary Sewer Easement containing 3,213 SF; (ii) a 10 Storm Sewer Easement containing 3,354 SF; (iii) a 5 Sanitary Sewer Easement containing 812 SF; and (iv) two portions of a 20 Storm Sewer Easement containing 1,172 SF. Legal and Physical Description: The County easements, or portions thereof, to be vacated were established by Deed of Dedication and Easements dated October 30, 1949, and recorded in Deed Book 907 at Page 296 among the land records. PUBLIC EGAGEMET: Level of Engagement: Communicate This level of engagement is appropriate because the request to vacate the proposed utility easements will have no effect to the public on service or use. The vacations are merely clean up of the recorded documents. ew utility easements will be dedicated as part of the use permit amendment process. The associated proposed use permit amendment for Use Permit U-3175-07-1 has been the subject of an extensive review process conducted by APS involving several opportunities for public review and input. Outreach Methods: Public notice was given in accordance with the Code of Virginia by publishing the notice twice on October 23 and 30, 2018, in The Washington Times prior to the County Board meeting on ovember 17, 2018. In addition to the above legal requirements, APS has notified surrounding property owners of the proposed vacations by sending a notice to each owner by certified mail. Community Feedback: As of the date of this report, staff has not received any feedback from surrounding property owners. - 3 -
FISCAL IMPACT: In keeping with current practice, the County does not require compensation for the vacation of utility easements when the utilities will be relocated and rededicated as part of the associated use permit project. - 4 -
