Appendix 2 - Property GARDA ACQUISITION MANAGED IN DUBLIN 1. Mary Fitzsimmons List of Counties covered Monaghan, Louth, Meath, Dublin Description: All Garda sites and buildings are acquired under funding available within Subhead D, managed within Property Management Services and must be approved by MAC in advance of progressing with a request from the client, An Garda Siochana. A detailed Brief of Requirements is prepared by our client, with our assistance, and Project Management prepare an advertisement to trawl the market for a suitable site or building, subject to the area of land/building required and assessed by our Senior Architect. Sites are assessed by our Architect, short-listed in order of priority and a Valuation Report prepared for Project Management Services. Project Management Services are in direct contact with each of the prospective Vendor's during this period with an update on progress within this Office. The client approves the most suitable site, following a site visit and a submission and Letter of Offer issues to the Vendor to acquire the property. Regular telephone communication takes place with both the Architect, Vendor and CSSO once the Letter of Acceptance issues. Queries raised from CSSO regarding legal matters within the contract document are addressed by Project Management Services until the Contract is executed by the Commissioners of Public Works and furthermore, until the purchase is legally complete by both parties. Duties: Preparation of submissions during the course of the acquisition. Telephone communication with the Vendor or Agent, preparation and attendance at site meetings. Issuing a Letter of Offer to the Vendor. Issuing regular communication to both client and Vendor during the course of the acquisition. Issuing regular email communication with the CSSO re legal matters pertaining the the acquisition. In-house communication both written and oral, with MAC, the Senior Architect and Line Management re progress. Preparing the Contract for Sale for execution by CPW. Preparing the necessary Purchase Order for payment of funds for the acquisition. Ejectment Proceedings taken against the Commissioners of Public Works in relation to occupation and rent arrears of leased premises, occupied by An Garda Siochana and operating as a Garda Station. Duties: Preparation of title documentation to each State owned property, background information for both the client and CSSO. All documentation issues to CSSO and communication with CSSO and local State Solicitor is required regularly to progress the cases within the District and Circuit Court. Briefing regularly to both MAC and Garda Housing re up-dates, when appropriate. Attend Court as a Witness for the State and give evidence on each case and the detail therein. 1. Cashel official married quarters, Co Tipperary 2. Glenbeigh official married quarters, Co Kerry Ejectment proceedings on 15 July 2011 in Clonmel District Court, Judge issued a Court Order in favour of CPW with a stay of 12 months for the permissive occupant to vacate the State owned property. Garda Housing to report if Mr Noel O'Brien vacated on/before 15 July 2012 Retiremen Ejectment proceedings taken against the permissive occupant, Mr t Michael O'Donoghue who gave an undertaking to the Judge in the 30/7/2010 District Court on 8 September 2011 to vacate the premises by 1 February 2012. Mr O'Donoghue sought compensation before vacating, CPW refused, he vacated on 1 February, 2012. Keys are in the possession of the Superintendent, Caherciveen. Mr O'Donoghue issued a claim for renovations to the premises which CPW have stated they will vigorously defend, if necessary.
