Milepost 227 Talkeetna North, Chase, Curry, to MP 249 The US and our State Constitution both unequivocally state that No person shall be deprived of life, liberty, or property, without due process of law. The Alaska RR took vested rights from Alaskan property owners, and did so behind closed doors completely outside of the Constitutionally mandated due process of law.
Milepost 248 Curry, Sherman, Gold Creek, Chulitna MP 274 The Alaska RR has been telling Alaskans for decades that They OWN the right of way. This is not true in most cases. In most cases, the Alaska RR only owns a simple surface easement across the private property of others.
Milepost 274 Chulitna, Hurricane Gulch, Honolulu Creek, Colorado Creek, MP299 The Alaska RR claims Exclusive Use takes rights from Alaskans and gives them to the RR. ONLY Due Process of Law as mandated by the Constitution can take property rights from Alaskans and give them to the Alaska RR. This process NEVER happened. Property rights were just stolen.
The Alaska Railroad, the DOI, and the BLM ignored our State and US Constitution. They also completely ignored due process of law. STEP 2. Find the new illegal US Patent which corresponds to your milepost marker in the left column. Step 4. It's not necessary but if you've found the patent and US Survey overlaid on
your property, and would like to see the actual document on the government website you can enter your patent # here: https://sdms.ak.blm.gov/scanned_images/patentindex.html Make sure you're using the Enter a patent below to download a PDF copy section in the bottom half of the page. In the Document Type drop down menu, Select PA Patent. In the Conveyance No window enter the patent # with no dashes. Most Homesteaded and other lands along the RR contain what's called
the 1914 right of way. A surface easement which lets the RR do their business across private land. Here is what it looks like in a typical Alaskan Federal Homestead land patent. These are very common all along the rail belt. Here is one of 46 new Federal land patents which were laid over private property already patented by the Federal Government.
The language is similar in all 46 patents which cover private property from Seward to Fairbanks. This patent completely changes the legal nature of the 1914 ROW and gives the RR all kinds of rights which the Federal Government never owned or otherwise had to give to Alaska when the transfer occurred in 1982. Included in the rights created out of thin air is the right to fence off some of the private property. This places a cloud on the title of the property, and has a direct negative impact on the market value because of the direct and constant threat of lost access via unlawful fencing. In simpler terms, the Alaska RR with this illegal patent applied without due process of law, can legally fence off Alaskans from a portion of their private property. Property which had already been given or conveyed to Alaskans by the government with the standard 1914 ROW included. The Alaska RR would argue that ARTA, the Alaska RR Transfer Act of 1982, gave
them the authority to take private property rights from Alaskans. It clearly does not but even it did this argument is completely irrelevant to the much more serious crime committed against Alaskans. There is a very clear and concise process of law which is mandated by our State and Federal Constitution which unequivocally must be followed. The Alaska RR made no attempt to follow the law because it was made crystal clear when ARTA was passed and the State took ownership of the RR that the rights of private property owners were not to be affected. It was also crystal clear to the RR that had they attempted to abide by the constitution and follow the law on this matter, it would have had zero chance of success.
