THE KENYA INFORMATION AND COMMUNICATIONS ACT (No. 2 of 1998) INFORMATION AND COMMUNICATIONS TECHNOLOGY SECTOR POLICY GUIDELINES AMENDMENT IN EXERCISE of the powers conferred by section 5A of the Kenya Information and Communications Act, 1998 the Cabinet Secretary for Information, Communications and Technology amends the policy guidelines issued vide Gazette Notice No. 2431 of 2006 by inserting the following new subparagraphs immediately after paragraph 4.7: 4.7.1. The switch off of terrestrial analogue television broadcasting transmission and the transition to digital terrestrial television broadcasting in Kenya. In order to comply with the International Telecommunication Union (ITU) digital terrestrial television migration deadline of 17th June, 2015 set out in the GE-06 Agreement, the National Government has adopted a phased terrestrial television analogue switch-off strategy which will result in analogue television transmissions being switched off in different regions on different dates in tandem with the rollout of the relevant digital signal infrastructure. The phased terrestrial television analogue switch off will ensure minimum disruption by facilitating an efficient and effective transition. 4.7.2 Analogue switch off dates. In keeping with the foregoing, the Communication Commission of Kenya shall ensure that 1. All terrestrial analogue television broadcasting transmissions by any person shall be switched off in three phases by the following dates (a) Nairobi region 13th December, 2013; (b) Mombasa, Malindi, Nyeri, Meru, Kisumu, Webuye, Kisii, Nakuru and Eldoret regions 30th March, 2014; (c) All other regions 30th June, 2014. 2. All persons providing terrestrial television broadcasting transmissions in the VHF/UHF television broadcasting radiofrequency bands in the regions specified in paragraph 1 shall switch off and migrate their television broadcast transmission systems from analogue to the digital signal distribution transmission framework and infrastructure on or before the dates specified in paragraph 1. 3. After the expiry of each switch-off date specified in paragraph 1, no terrestrial analogue television transmission shall be effected by any person in the specified regions.
