RULES AND REGULATIONS RIVERMIST APARTMENTS RENT: Rent is due before the first of each month and is late if not received on or before the 5 th of each month. As of the sixth of the month a $30.00 late fee is added to your rent. Rent is to be paid by check or money order made payable to Ed Zukowski and mailed to105 Brookside Dr. Waterloo, NY 13165. OCCUPANCY: Tenants are reminded that their Rental Agreement is a legal contract which should be read with great care. Among other things, this contract states the precise number of persons who may stay in the apartment. Any additional person(s) staying in the apartment for a period of more than 7 days MUST obtain permission from management. Also, there is a legal limit on the number of persons who may occupy an apartment. WALKWAYS AND HALLWAYS: All walkways and hallways are to be kept clear and free of debris at all times. Absolutely no storage of any items on or near the walkways or hallways outside of the apartments is permitted. All brooms, mops, waste receptacles, floor mats etc. must be kept inside the apartments. BALCONY: You cannot use balcony or patio for storage. Only patio furniture and similar items can be left on balcony or patio. PLUMBING STOPAGE: All expenses or repairs resulting from tenant stopping of waste pipes, toilets or overflow from sinks, toilets, tub/showers, or containers must be paid for by the tenant when caused by tenant misuse or neglect. Tenants should own a toilet plunger and a sink plunger. WATER UASAGE: Any running water such as toilet or faucet must be reported to landlord immediately or the extra water usage resulting will be charged to tenant. One toilet running for one month costs over $300.00 in W & S. NOISE LEVELS: The Village of Seneca Falls requires that the sound levels of TV, stereos, radios, electronics, loud conversation, yelling, etc. must be reduced between the hours of 10 PM to 8 AM. In addition, the laws states that each tenant is entitled to the Quiet Enjoyment of their apartment. This also applies to car radios, stereos, etc. and "engine revving." As a general rule, if the people in another apartment; can hear the sound you are making (whatever the source) you are too loud. If you are bothered by noise you must phone the Village of Seneca Falls Police Department, 315-568-4850, to file a complaint. Repeated violations shall result in evictions. CHILDREN PLAYING: Children are not permitted to play in the parking areas or driveway areas. This is a safety hazard and dangerous to the wellbeing of children. Skateboarding, skating, cycling are not allowed in these areas and certainly not in the hallways or stairways of the building. Parents and guardians are reminded that they are legally responsible for the behavior of their children and guests, and that they must be aware of their children's behavior at all times. TRASH RECEPTACLES: Absolutely no furniture is to be place or disposed of in or near the trash receptacles. The cost of disposal of such large items will be charged to the owner of the items. Please place all trash in tied plastic bags and place in the trash receptacles. Flatten all boxes before putting them in the trash receptacles.pets: Absolutely no pets of any kind are permitted on the premises or in the apartments unless approved by landlord in writing.
SNOW: When we get a significant snow fall and the parking lot needs to be plowed, the snow plow person will clear the driveway opening and a main path through the parking lot early in the morning. He will return between the hours of 3:00 PM and 5:00 PM to plow entire parking lot. You have to get your own vehicle cleared of snow and moved so the parking lot can be cleared of snow. SATELLITE DISHES: We do not allow any television dishes on our buildings or on the property. TENANT PARKING: We request that any vehicles in Rivermist parking lot must be operational at all times. Vehicles must be able to be driven on roads legal at all times, no dead vehicles. Vehicles in violation may be towed without notice at owner expense. VEHICLE REPAIR: Please do not perform mechanical work on your vehicle in the parking lot or around the premises of the apartments. VANDALISM: Anyone who vandalizes any apartment or part of the buildings or grounds is liable for criminal prosecution and eviction. Persons vandalizing property will be held personally liable for all costs of repair or replacement. Parents and Guardians are responsible for the actions of their children. All tenants are responsible for the actions of their guests. WINDOW TREATMENTS: Please use only materials that are intended for inter window treatment. Do not hang up a sheet, blanket, flag or some other material not intended for windows. SMOKING: Our apartments are nonsmoking apartments. Please do not smoke or allow visitors to smoke in the apartment or building. Most people object to the smell of tobacco smoke. Smoke from tobacco creates an odor and a brown film which creates a cleaning and deodorizing problem in the apartment. Do not smoke adjacent to someone else s apartment window or door. Please be considerate and do not annoy someone else with your smoke. STORAGE LOCKER: You have been given the use of a storage unit in the lower level. You are responsible for keeping it secure. We are not responsible for any of your possessions in the storage unit. The cooperation of all tenants in maintaining these Rules and Regulations is requested and appreciated for a successful tenancy at Rivermist Apartments.

When monthly installment of rent payment is not received on or before the 5th day of the month due, tenants will be charged and agree to pay a $30.00 late fee. Under any circumstances shall the monthly installment of rent be paid any later than the 1Oth day of each month? Any back rent of 15 days or more will be assessed a 2% per month interest charge in addition to the initial late fee. Checks that are not valid and or bounce will be charged a bad check penalty of $40.00 plus any late rent payment fees that apply. 2. No other person or persons may occupy this dwelling with the tenants or without the tenants unless they are listed and signed on this lease agreement. This is a residential apartment dwelling and is not to be used for any other purpose. 3. Tenants are not to paint or alter their apartment without landlord s written permission. If the owner gives the tenants written permission to paint the apartment, it is at tenant's expense. Tenants, at their own expense, will have to repaint apartment with the original paint color and type before vacating apartment 4. Tenants are never to put nails, screws, tape, or adhesive fasteners in or on apartment walls. If pictures or other decorative materials are hung on wells, only specifically designed fasteners or hangers (example drawing on side) are to be used to hold materials up. Any picture posters are to be held up by small staples or thumbtacks. If not followed, tenants will be charged for wall repair and painting. The use of TV Dishes on the property of the landlord is not allowed.
5. Tenants are to pay for any repairs of damages, including drain stoppages, clogged toilets, plumbing fixtures, walls, ceilings, light fixtures, appliances, windows, and doors which tenants or their guests have caused by misuse, neglect or accidental behavior. Tenants are responsible to unclog their own drains and toilet unless clog is in the main lines. Tenants will pay landlord or his agents to make necessary repairs caused by tenants or their guest. Landlord will send itemized bill to tenants for those repairs and bill has to be paid within ten days. Any bill not paid in 30 days will be assessed 2% per month interest for late fee. Tenants must notified landlord or agent of any repairs needed. Any running water such as toilet or faucets must be reported to landlord immediately or water usage will be charged to tenant. 6. All motor vehicles of the tenants must be listed on this lease rental agreement, be operative, current license, current registration, current inspection, and used in normal every day use. Any motor vehicles not meeting the above description will be towed away by the landlord's authority and at the vehicle owner s expense. 7. Tenants are to keep from making loud noises and disturbances, and playing music and broadcast programs too loudly and at times that disturb other tenant's right to peace and quiet. If you are being disturbed by a tenant s noise you must phone the village police and file a report. 8. Tenants are to allow owner s agent and repairman to perform repairs in apartment during the day or evening. Owner will give tenant 24 hours notice to enter tenant s apartment unless emergency demands otherwise. Tenants will allow the landlord or his agents to inspect the apartment at reasonable times, with 24 hour notice. When tenant has given notice to vacate their apartment, tenants are to allow the landlord to show the apartment to prospective tenants at any and all reasonable times of the day and evening. Your co-operation in re-renting your apartment to new tenants is agreeably given. 9. Absolutely No DOGS are allowed to live, stay, or visit at the apartment of the tenants or on the property of the landlord. Cats are accepted with an additional $300.00 security deposit and with written approval from owner or agent. Pets that are contained such as fish may be acceptable, ask for approval. If unapproved pet or pets are found to be staying in the apartment or on the premises, eviction of the tenants may result. 10. Tenants are to keep apartment clean and in a healthy condition and to keep entryway, porches, and balconies clean and clear of materials. Balconies are not to be used for storage of tenant possessions. Tenants are to put all trash in plastic trash bags, seal them, and put trash bags in proper receptacle outside of building. If required by county, tenants will follow correct recycling procedures. Deposit cans and bottles should be returned in a timely manner. 11. This is a non-smoking apartment. Tenants and their guest are not allowed to smoke inside of the apartment or any of the common areas where other tenants may be, such as common hallways, laundry room, etc. If tenants or their guest do smoke in the apartment, tenants will have to wash all walls and surfaces before vacating apartment. It takes a lot of extra cleaning to get rid of the yellow covering smoking leaves on all surfaces and on the flooring. This extra cleaning will be charged to tenant. Be careful when and if you use candles. Some candles will give off a lot of smoke and cause soot damage to walls and ceilings. This soot damage is very hard to get rid of and will cost you extra in cleaning. 12. The security / cleaning / damage deposit will be mailed to tenants within 15 days of the last day of the rental obligations, if there are no discrepancies. Any charges that are deducted from the deposit will be itemized and deducted from the security deposit. The tenants must perform the following at the end of their tenancy. The apartment and appliances completely cleaned apartment damage-free, carpets vacuumed and cleaned, light bulbs in and working, electric bill paid and current, all keys returned and rent current, in order to receive full deposit returned. If carpet is not clean, landlord will hire professional carpet cleaner and charge tenant what the service cost. We are extremely happy when we can return full deposit plus interest please follows the lease. A copy of our move out will be provided to you when you give 30 day notice prior to the first of a month of moving. 13. A full 30 days written notice from the tenants to the landlord, prior to the anniversary date of this lease, is REQUIRED to surrender this apartment on the anniversary date. If tenants do not give 30 days written notice to landlord to vacate on the anniversary date of the year s lease, tenants will automatically on a month to month tenancy. Once on a month to month tenancy (13 month and forward) full 30 days written notice of rental termination is required to be given by the tenants to the landlord prior to the last calendar day of the last month of tenancy. Termination of rental tenancy can only happen on the last day of a month. Tenants will pay
rent for the duration to the last day of the last month of tenancy. The tenants must give Landlord or his agent 30 days advance written notice prior to the last day of the month of vacating. (Example: written notice to agent on or before Sept. 1 for vacating on Sept. 30. Once tenancy continues into a new month, tenants must pay for that full month s rent). 14. If tenants break any part of this lease and or are evicted by Small Claims Court, tenants agree and understand they will be responsible for three months rent past last day of occupancy or to the end of the lease term. The three months rent is for the balance of the Lease Rental Agreement term of annual rent. If the landlord agrees to allow tenants to terminate their one-year lease before the term is completed, the tenant will pay a fee equal to one month s rental amount for release fee to the landlord. The terms of breaking the lease are agreed to by tenant and landlord. The security deposit of this lease is not to be used for rent and is only for used for cleaning and damages if needed. 15. Verbal agreements between owner and the tenant are not accepted, only written agreements that are signed by both tenant and owner. The Rental Application is part of this lease and if false information is provided on it or in this lease, the landlord may terminate the lease rental agreement.
