ORDINANCE NO. 2012- ORDINANCE OF THE TOWNSHIP OF BUCKINGHAM, BUCKS COUNTY, PENNSYLVANIA, AMENDING THE BOUNDARIES OF HISTORIC DISTRICTS ESTABLISHED IN THE BUCKINGHAM TOWNSHIP HISTORIC PRESERVATION ORDINANCE, ORDINANCE NO. 8-81, AS AMENDED WHEREAS, Buckingham Township has a long and rich architectural and historical heritage, and contains buildings and architectural styles of significance to the Township, the County of Bucks, and the Commonwealth of Pennsylvania; WHEREAS, on December 12, 1981, Buckingham Township enacted Ordinance No. 8-81, known as the Buckingham Township Historic Preservation Ordinance, to protect historic buildings in the Township and to promote the general welfare, education and culture of the Township by encouraging an interest in its historical heritage; WHEREAS, on December 22, 1982, Buckingham Township enacted Ordinance No. 82-14, which amended Ordinance No. 8-81 by limiting Historic Districts in the Township to only the Spring Valley Village area, as described in Exhibit B-1 attached to Ordinance No. 82-14; and WHEREAS, the Board of Supervisors of Buckingham Township find that it is in the best interests of the public welfare and the promotion of the historic and architectural resources of the Township to include other areas of the Township within the definition of Historic Districts; NOW, THEREFORE, be it ORDAINED and ENACTED as follows: 1. Under Section 2 General Provisions of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, there is hereby inserted a new subsection b) Definitions as follows. The original subsections: b) through d) are hereby redesignated subsections c) through e) respectively. The original subsections e) Repealer, f) Severability, and g) Effective Date are hereby deleted. Page 1 of 19

SECTION 2. GENERAL PROVISIONS b) Definitions The following words, terms, and phrases, when used in this ordinance, unless the context clearly indicates otherwise, shall have the following meanings ascribed to them: Buckingham Township Board of Supervisors, Board of Supervisors of Buckingham Township, or Board of Supervisors - The Buckingham Township Board of Supervisors as more fully defined in Article VI of the Pennsylvania Second Class Township Code. Building - A structure under roof, used for the shelter or enclosure of persons, animals, or property. The word "building" shall include the curtilage appurtenant to the building, including fences and signs therein, created to shelter or support any form of human activity. Curtilage - the land immediately surrounding a house, dwelling or building including any closely associated buildings and structures, but excluding any associated open fields beyond. Fence - A freestanding assembly of materials designed to define, restrict, or prevent movement across a boundary exceeding four (4) feet in height above the natural grade. HARB Board or Board The Buckingham Township Board of Historic Architectural Review, as herein provided. Page 2 of 19

Person Any individual, public or private corporation for profit or not for profit, association, partnership, firm, trust, estate, department, board, bureau or agency of the Commonwealth or the Federal Government, political subdivision, municipality, district, authority, or any other legal entity whatsoever which is recognized by law as the subject of rights and duties. Sign - any billboard, signboard, lettering, or other advertising device with the purpose in mind of drawing attention to the product, service, premises, business, residence, location, event, organization or notice described thereon. A sign includes, but is not limited to: 1. A separate structure consisting of a face or faces upon which information is portrayed and its supporting elements including foundation; or 2. A structure or device erected in the form of a symbol or trademark; or 3. A structure or device designed to carry visual information, either static or animated attached or fastened to another structure, such as on the wall or roof of a building; or 4. Electronic Graphic Signs that display electronic, static images, static graphics or static pictures, with or without text information, defined by a small number of matrix elements using different combinations of light emitting diodes (LED s), fiber optics, light bulbs or other illumination devices within the display area where the message change sequence is Page 3 of 19

accomplished immediately or by means of fade, re-pixalization or dissolve modes. Electronic Graphic Sign(s) include computer programmable, microprocessor controlled electronic or digital displays. Electronic Graphic Sign(s) include projected images or messages with these characteristics onto buildings or other objects. 5. Video Signs that change their message or background in a manner or method of display characterized by motion or pictorial imagery, which may or may not include text and depicts action or a special effect to imitate movement, the presentation of pictorials or graphics displayed in a progression of frames which present the illusion of motion, including but not limited to the illusion of moving objects, moving patters or bands of light, or expanding or contracting shapes. Video Sign(s) include projected images or messages with these characteristics onto buildings or other objects, and Electronic Graphic Signs. 6. A surface of a structure or device upon which lettered, pictorial or other visual information is displayed; or 7. Window signs, cloth banners, festoon lighting, pennants or other devices designed to attract attention by animation or direct or reflected lighting. For purposes of this Ordinance, sign does not include: Page 4 of 19

1. Merchandise, pictures or models of products or services incorporated in a window display; 2. Holiday decorations customarily displayed in a window or on or about the premises of residential structures, or in windows of business uses, without business advertising; or 3. Works of art or physical constructs that do not promote a product, service, premises, business, location, event, organization or activity. 4. Directional, informational or public service signs such as signs advertising the availability of restrooms, telephone or similar facilities of public convenience, and signs advertising meeting times and places of non-profit service or charitable clubs and organizations, provided that such signs do not advertise any commercial establishment, activity, organization, product, goods or services. 5. Temporary signs where such sign is in place for a period not to exceed ninety (90) days in any one calendar year for any one premises advertising: (i) the sale of agricultural or horticultural products; (ii) political parties or candidates for election; (iii) the sale or rental of premises upon which said sign has been erected, or signs indicating that said premises has been sold or rented; and (iv) commercial sales when located on the site where such use is conducted; and (v) signs of a temporary nature, not otherwise described herein, such as those Page 5 of 19

advertising civic, social or political gatherings or causes and fundraising activities. 6. Trespassing signs or signs indicating the private nature of a road, driveway, or premises, and signs prohibiting or otherwise controlling the fishing and hunting upon a particular premises. 7. Flags that are decorative and contain designs marking seasons or holidays. 8. Such signs or Plaques as may be customarily used to identify the historic nature of a property, events of historic significance that occurred on a property, the date of construction of any structures on the property, or any conservation easement applicable to the property. Any regulation by this Ordinance of a sign or signs, shall not be deemed to apply to he removal of any sign or signs. Structure - A combination of materials assembled, constructed, or erected at a fixed location, including a building or a manufactured home, the use of which requires location on the ground or attachment to something having location on the ground. Any manmade object having an ascertainable stationary location on or in land or water, whether or not affixed to the land. 2. The definition of Historic District, as originally appears in Section 2.b) (now Section 2. c)) of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: Page 6 of 19

SECTION 2. GENERAL PROVISIONS c) Definition of Historic District The boundaries of the Historic Districts shall be as shown collectively on the map attached hereto as Exhibit A and individually as shown on Exhibits: Spring Valley Village Mechanicsville Village Holicong Village Forest Grove Village Exhibit A-1 Exhibit A-2 Exhibit A-3 Exhibit A-4 and made a part of this ordinance. Exhibit A shall be known as the Historic Preservation Map of Buckingham Township. The following Historic Districts shown on the Historic Preservation Map of Buckingham Township are subject to this Historic Preservation Ordinance, and shall have the legal boundaries shown in the descriptions attached hereto and made a part hereof as Exhibit B-1 through B-4: Spring Valley Village Mechanicsville Village Holicong Village Forest Grove Village Exhibit B-1 Exhibit B-2 Exhibit B-3 Exhibit B-4 3. Section 2.d) Compliance (now Section 2. e)) as originally appears in Section 2.d. of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: Page 7 of 19

SECTION 2. GENERAL PROVISIONS e) Compliance If a building located within an Historic District shall be proposed to be erected, reconstructed, altered, restored, demolished or razed, in whole or in part, and such proposed erection, reconstruction, alteration, restoration, demolition or razing can be seen from a public street or way and requires a building permit from the Director of Building and Codes, then such building shall not be erected, reconstructed, altered, restored, demolished or razed, in whole or in part unless and until a Certificate of Appropriateness as hereinafter provided has been issued by the Buckingham Township Board of Supervisors. 4. Section 5 of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: SECTION 5. DUTIES OF THE DIRECTOR OF BUILDING AND CODES UPON RECEIPT OF APPLICATION FOR BUILDING PERMIT FOR EXTERIOR WORK Upon receipt of an application for a building permit for the erection, reconstruction, alteration, restoration, demolition or razing of all or a part of a building within an Historic District, the Director of Building and Codes shall act in accordance with the procedures then being required under the Building Code Ordinance Buckingham Township Ordinance 2004-03), as amended, except as those procedures are necessarily modified by the following requirements: a) The Director of Building and Codes shall forward to the HARB Board two copies of the application for a building Page 8 of 19

permit, one for the HARB Board's file and one to circulate among members of the Board. The application shall also include a copy of the plot plan showing: 1. location of the building; 2. building floor plans and elevations showing the owner s intent; 3. photographs of the existing building (if applicable) The Director of Building and Codes shall forward this material to the HARB Board within five (5) business days of receipt of the application. The HARB Board and the Director of Building and Codes may request additional information if necessary for proper review of the application and shall inform the applicant that additional information may be requested if necessary for such proper review. b) The Director of Building and Codes shall maintain in his office a record of all such applications and of his handling and final disposition of the same. c) The Director of Building and Codes shall require applicants and any applicant shall submit a sufficient number of additional copies of material required to be attached to an application for a building permit to comply with the foregoing. 5. Section 6 of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: Page 9 of 19

SECTION 6. MEETING OF THE BOARD OF HISTORICAL ARCHITECTURAL REVIEW a) Meeting Upon receipt by the HARB Board of notice that an application for a building permit for the erection, reconstruction, alteration, restoration, demolition or razing of all or a part of a building located within an Historic District has been filed in the office of the Director of Building and Codes of Buckingham Township, the HARB Board shall schedule a meeting within thirty (30) days of receipt of the application to consider the counsel which the HARB Board will give to the Board of Supervisors of Buckingham Township. To ensure consideration at a particular Board of Supervisors meeting, applications must be submitted at least three weeks prior to said meeting. The person applying for the permit shall be given not less than five days written notice of the time and place of the meeting of the HARB Board and that he may appear to explain his reasons therefore; provided however, that the applicant may execute and file a written waiver of the five day notice requirement if he elects to do so in order that the meeting may be scheduled at an earlier date. The HARB Board or the applicant may invite such other persons as it desires to attend its meeting b) Consideration in determination of counsel to be given In determining the counsel to be presented to the Buckingham Township Board of Supervisors concerning the issuing of a Certificate of Appropriateness for a permit for the erection, reconstruction; alteration, restoration, demolition or razing of all or a part of a building within an Page 10 of 19

Historic District, the HARB Board shall consider the following: 1. The exact location of the area in which the work is to be done and whether it can be seen from a public street or way; 2. The exterior changes proposed to be made and their appropriateness to the exterior architectural features and character of the building; 3. A list or photographs of the surrounding structures describing or showing their general characteristics; 4. The effect the proposed change will have on the general historic and architectural nature of the historic district; 5. The effect of the proposed change upon the specific architectural and period features; 6. The appropriateness of the general design, arrangement, texture, and material proposed for the building and the relation of such factors to similar features of buildings or structures in the historic district. The HARB Board shall not consider any matters not pertinent to the historical aspect and nature of the District. c) Procedure in counseling against grant of Certificate of Appropriateness If the HARB Board, on the basis of the information received at the meeting and from its general background and knowledge, decides to counsel against the granting of a Page 11 of 19

Certificate of Appropriateness, it shall indicate to the applicant for a building permit via a registered written response within five (5) working days of the meeting, what changes in plans and specifications would meet the conditions for protecting the distinctive historical character of the historic district. Following its decision, the HARB Board shall withhold its report to the Board of Supervisors until the applicant gives written notification to the HARB Board whether or not he will abide by the suggested changes in his plans and specifications or until the expiration of ten (10) working days, whichever first occurs. If the applicant determines that he will make the suggested changes, he shall so advise the HARB Board which shall counsel the Board of Supervisors accordingly. Should the HARB Board not receive, within ten (10) working days of the mailing date of initial notification, a letter by the applicant, the HARB Board shall advise the Board of Supervisors of its decision. d) Report of HARB Board concerning issuance of Certificate of Appropriateness The HARB Board, after the meeting provided for in Section 6(a) of this Ordinance and after the applicant s making of any changes in the plans and specifications as provided in Section 6(c) of this Ordinance, shall submit to the Buckingham Township Board of Supervisors, in writing, its counsel concerning the issuance of a Certificate of Appropriateness for the grant or refusal of a permit for the erection, reconstruction, alteration, restoration; demolition or razing of all or a part of any building within an Historic District. The written report shall set out the following matters. Page 12 of 19

1. The exact tax map location and street address of the property in which the work is proposed to be done; 2. A description of the exterior changes proposed to be made and their appropriateness to the exterior architectural features and character of the building proposed to be erected, reconstructed, altered, restored, demolished or razed; 3. A list or Photographs of the surrounding structures describing or showing their general characteristics; 4. The effect the proposed change will have on the general historic and architectural nature of the historic district; 5. The effect of the proposed change upon the specific architectural and period features; 6. The appropriateness of the general design, arrangement, texture, and material proposed for the building and the relation of such factors to similar features of buildings or structures in the historic district; 7. The opinion of the HARB Board (including any dissent) as to the appropriateness of the work proposed to the general historic and architectural nature of the historic district; 8. The specific counsel of the HARB Board to issue or to refuse a Certificate of Appropriateness. Page 13 of 19

6. Section 7 of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: SECTION 7. HEARING BEFORE THE BOARD OF SUPERVISORS OF BUCKINGHAM TOWNSHIP Upon receipt of the written, counsel of the HARB Board, the Board of Supervisors shall consider at their next scheduled meeting or the one thereafter if the next would make ten (10) working days notice to the applicant impossible, the question of issuing to the Director of Building and Codes a Certificate of Appropriateness authorizing a permit for the work covered by the application. The applicant shall be given ten (10) working days notice by the Township Secretary of the time and place of the hearing at which his or her application will be considered and shall have the right to attend and be heard regarding his or her application. Within the ten (10) working days the applicant has the right to request a change of hearing date if it is impossible for him or her to attend the meeting proposed by the Board of Supervisors. In determining whether or not to issue a Certificate of Appropriateness, the Board of Supervisors shall consider, among others, the same factors considered by the HARB Board under Section 6 of this Ordinance and shall consider the report of the HARB Board. If the Board of Supervisors approves the application, they shall issue a Certificate of Appropriateness, authorizing the Director of Building and Codes to issue a permit for the work covered. If the Board of Supervisors disapproves, they shall do so in writing and copies shall be given to the applicant, the Director of Building and Codes, the HARB Board and to the Pennsylvania Historical and Museum Commission. disapproval shall indicate what changes in plans and specifications would meet the conditions for protecting the distinctive historical character of the historic district. The Board of Supervisors of Buckingham Township shall render its written decision within forty-five (45) days of the hearing. If the Board of Supervisors does not render its written decision within the said forty-five (45) days after the hearing, it shall be deemed that the Board of Supervisors has decided in favor of the applicant and a Certificate of Appropriateness shall thereupon be issued without charge or fee for the Certificate of Appropriateness to the applicant. 7. Section 8 of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: SECTION 8. DISAPPROVAL OF APPLICATION Upon receipt of the written disapproval of the Board of Supervisors of Buckingham Township, the Director of Building and Codes shall disapprove the application for a building permit. 8. Section 9 of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: SECTION 9. AUTOMATIC APPROVAL OF APPLICATION Anything herein to the contrary notwithstanding, if all procedures required hereunder, including rendering by the Board of Supervisors of its written decision, have not been completed within seventy-five (75) days of the date the applicant for a building permit submits application to the Director of Building and Codes, it shall be deemed that the Board of Supervisors has decided in favor of the applicant Page 15 of 19

and a Certificate of Appropriateness shall thereupon be issued without charge or fee for the Certificate of Appropriateness to the applicant. 9. Section 11 of Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby deleted and replaced in its entirety as follows: SECTION 11. ENFORCEMENT a) Director of Building and Codes The Director of Building and Codes (or such other person or agency charged by the Board of Supervisors with the enforcement of the provisions of this ordinance) shall review the progress and status of the proposed changes and render such reports thereon to the Board of Supervisors and to the HARB Board as may be necessary to assure compliance with the provisions of this ordinance and the conditions of the Certificate of Appropriateness. The Director of Building and Codes (or such other person or agency charged by the Board of Supervisors with the enforcement of the provisions of this ordinance) shall make the initial determination whether there has been a violation of this Ordinance and shall be responsible for the service of notice of a violation. b) Criminal Penalties Any person, partnership, or corporation who shall violate any of the provisions of this Ordinance shall be guilty of a summary offense, and upon conviction thereof, such person, or the members of such partnership, or the officers of such corporation, or the agent of any of them responsible for such violation, shall be sentenced to pay a fine of up to $1,000.00 for each offense, or undergo imprisonment for up Page 16 of 19

to thirty (30) days. Each day for which a person is found to be in violation of this Ordinance shall constitute a separate offence. Enforcement shall be by action brought before a district justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. The municipal solicitor may assume charge of the prosecution without the consent of the District Attorney as required under Pa.R.Crim.P. No. 83(c) (relating to trial in summary cases). All fines collected for violations shall be paid over to the treasurer of Buckingham Township. c) Civil Penalties In addition to proceeding under any other remedy available at law or in equity for a violation of this Ordinance, Buckingham Township may impose a fine of not more than Six Hundred ($600.00) dollars for each violation of this Ordinance. A separate offense shall arise for each day or portion thereof in which a violation is found to exist or for each section of the Ordinance that is found to have been violated. All fines and penalties collected for the violation of this Ordinance shall be paid to the township treasurer. In the event the fine is not voluntarily paid to the township within ten (10) days of imposition of the fine, the township shall initiate a civil enforcement proceeding before a district justice. The civil enforcement proceeding shall be initiated by complaint or by such other means as may be provided by the Pennsylvania Rules of Civil Procedure. In any case where a penalty for a violation of this ordinance has not been voluntarily paid to the township within ten (10) days of imposition of the fine and the person upon whom the penalty was imposed is found to have been Page 17 of 19

liable therefor in civil proceedings, the violator shall be liable for the penalty imposed, including additional daily penalties for continuing violations, plus court costs and reasonable attorney fees incurred by the township in the enforcement proceedings. d) Enforcement in Equity In addition to proceeding under any other remedy available for a violation of this Ordinance, the Ordinances may be enforced by Buckingham Township through an action in equity brought in the Court of Common Pleas of Bucks County. 10. Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby to add a new SECTION 12 as follows: REPEALER. All Ordinances or parts of Ordinances inconsistent herewith and unable to be read in pari materia herewith, are hereby repealed, but only to the extent necessary to remedy such inconsistency and such repeal shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of the inconsistent Ordinance. 11. Ordinance No. 8-81, and as amended by Ordinance No. 82-14, is hereby to add a new SECTION 13 as follows: SEVERABILITY. If any sentence, clause, section, or part of this Ordinance is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this Ordinance. It is hereby declared as the intent of the Buckingham Board of Supervisors that this Ordinance would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein Page 18 of 19

12. Effective Date. Immediately upon the adoption of this Ordinance, the Township Manager shall forward a copy hereof to the Pennsylvania Historical and Museum Commission. This Ordinance shall not take effect until the said Commission has certified, by resolution, to the historical significance of the newly designated historic districts included herein.
