PLAN COMMISSION MEETING June 25, 2018 Plan Commissioner Brett Engelking acted as Chair in the absence of Chairman Leair. Also present were Planners Lightfoot, Toole, Christiansen, Turzynski and Houston. Also present were Planner Herrmann and Barb Whitmore. Adjourned Public Hearing Conditional Use request of Joe Senglaub, S29 W31247 Sunset Drive, Waukesha, Wisconsin, to operate a Commercial Horse Boarding Operation. The property is described as Lot 1 Certified Survey Map No. 4764, being a part of the SE ¼ of Section 9, T6N R18E, in the Town of Genesee, Waukesha County, Wisconsin. More specifically, the property is located on south side of C.T.H. DE (Sunset Drive). (Tax Key GNT 1476.999.003). Engelking read the hearing notice, noting this is an adjourned hearing. Herrmann read the proposed conditions of approval for Mr. Senglaub. After the conditions were read and explained, Mr. Senglaub had several questions. Number 19 regarding the number of 4 horse trailers on the property at one time. After discussion it was felt the number of trailers could be one time to 8. Discussion of the lighting overlooking the paddock, there have been no complaints of lighting, it was agreed there will be no change to the lighting. Engelking opened the floor to those present for any further comments, there were no comments, so discussion was brought back to the table. Engelking closed the hearing at 6:14 p.m. This will be on the July agenda for approval of the final conditions. NOTICE IS HEREBY GIVEN that a Public Hearing will be conducted by the Town of Genesee Plan Commission on Monday June 25 th, 2018, beginning at 6:00 p.m. at the Town of Genesee Town Hall, S43 W31391 Hwy 83, Genesee Depot, Wisconsin, to consider the Conditional Use Amendment request of Michael Ettner, Badger Materials Recycling, LLC, 612 N. Sawyer Road, Oconomowoc, Wisconsin to amend his Conditional Use per Section 40 (B)(28) of the Town of Genesee Zoning Code to include the Recycling of Tires as part of his Construction Materials Recycling Facility at Wolf Paving, Inc. The property is located at W329 S1755 Jones Road. The property is part of the part of the E1/2 of the NW1/4 of Section 6; part of the W1/2 of the NW1/4 of Section 6; part of the NE1/4 of Section 6 and part of the NE1/4 and NW1/4 of Section 5, T6N R18E, in the Town of Genesee, Waukesha County, Wisconsin. More specifically, the property is located on the south side of USH 18 at W329 S1755 Jones Road. (Tax Key GNT 1561.996, 1462.987, 1464.999) This request is to amend the C/U to include recycling of tires. Mr. Ettner gave a slide presentation of what is being proposed, including the background of Badger Materials and his work in this field. There is only one other facility in the state of Wisconsin that recycles tires. After going through the shredder, the pieces of tire are 2 inches. The uses for the recycled tires are crumb rubber, fuel, mulch, traffic control and playground base. He also presented drawing of the facility and where they would do the tire recycling. The number of tires they can have in one area are regulated with a 100-foot set back from property lines and 40 feet between tire stockpiles, with a limit of 10-foot height. They will have concrete blocks dividing the stockpile areas that will be 40 feet apart. Ettner will also be posting an assurance bond for $34,000 for the clean-up of the 1 st of three stockpiles they will have. They are planning on only using one stockpile area to start. Engelking opened the table for discussion. Houston questioned if there was a place for employees to warm up in the winter hours. Ettner said there is an employee trailer. Lightfoot questioned the fire safety if the shredded tires are less vulnerable. Ettner stated they will follow the International fire code and could not say if there was a difference in vulnerability. He plans to get the material off the property quickly. They are working with a company that may use the shreds to cover landfills.

PLAN COMMISSION MEETING JUNE 25, 2018 PAGE 2 Christiansen questioned the number of trucks that would be coming in and out. Discussion, fewer trucks would be going out as the shreds do not take up the space tires would. Engelking opened the floor to the public for comment. John Bolger, WS4485 Woods Rd. Questioned the noise and ground water issues. Ettner stated the machine is quiet, you can talk at a normal range. The machine makes a squeegee sound. Wolf has a surface water plan in place on site. There were no further questions, Engelking brought the discussion back to the table. Lightfoot made motion to adjourn the public hearing to July 23 rd at 6 p.m. for action on the conditions for the amendment to the C/U. Houston seconded, motion carried unanimously. Immediately following the above Public Hearing: a Public Hearing will be conducted by the Town of Genesee Plan Commission to consider the Conditional Use Amendment request of the Waukesha County Land Resources Division, 515 W. Moreland Boulevard, Room AC260, Waukesha, Wisconsin and Johnson Sand & Gravel Inc., 20685 W. National Avenue, New Berlin, Wisconsin to extend the duration of the mining operation on the site from December 31, 2018 to December 31, 2021 and extend the Site Reclamation until June 30, 2022. The property is part of the NW1/4 of Section 6. More specifically, the property is located on the east side of C.T.H. C with the entrance to the pit approximately ½ mile south of the intersection of C.T.H. C and U.S.H. 18. (Tax Key GNT 1463.998) Jim Rose from Waukesha County requested the mining operation be extended from the current finish date of 12-31-18 for three more years to 12-31-21 and the reclamation to 6-30-22. The timing and sale of products has slowed. The composting is no longer done there, but some is still stored there to be used for the reclamation. Herrmann agreed it was not a good idea to finish right now, there is more to be mined and eventually this will be a business park. Engelking opened the floor for comments, there were none, the discussion was brought back to the table. The hearing was closed at 7:08 p.m. Immediately following the above Public Hearing: a Public Hearing will be conducted by the Town of Genesee Plan Commission to consider the Conditional Use request of the Jeremy Kane, 623 Arcadian Avenue, Waukesha, Wisconsin for an In-Law Unit per Section 40 (B)(19) of the Town of Genesee Zoning Code. The property is Lot 18 Strawberry Fields, being a part of the NW1/4 of Section 9. More specifically, the property is located on the southeast corner of Brandybrook Road and Cregennan Bae. (Tax Key GNT 1473.018) Andrea Kane explained they have preliminary plans with PEA Builders for the home. They want to build in two phases with a goal of having everything completed by 2021. She has notified neighbors that had received the public hearing notice and received back eight letters of support, reading some of the responses. They would like to build the smaller residence around 1,000 square feet with two bedrooms first. They will live there for several years and build the larger roughly 2,000 sq. foot home with a mud-room attaching both houses. One of the smaller home bedrooms would become part of the garage and be reduced to about an 800 sq. foot in-law unit. Discussion of the zoning and covenants for Strawberry Fields. The original covenant was for 25 years and was filed in 1987. Herrmann stated he will have to check to see if any amendments were made to the covenants extending the criteria. Herrmann asked why they cannot meet the 1,500 sq. foot minimum. Kane replied Town ordinance stated the in-law unit is be no larger than 800 sq. feet, and it would easier to downsize from the 1,000 ft.

PLAN COMMISSION MEETING JUNE 25, 2018 PAGE 3 Herrmann stated his concern approving an in-law unit that may or may not happen for three years, discussion. Steve Homa, W95S7548 Woodland Pl. Muskego, who will build these homes stated the lots are really not adjoined to the subdivision and will not affect the other homes down the road. Engelking opened the floor for comment. A letter was received from Richard Labott, W314S2561 Penny Lane which was read into the record. Mr. Labott was not opposed the in-law unit but did have concerns. There were no comments, Engelking brought discussion back to the table. Lightfoot questioned if Genesee had duplex zoning, the answer was no. Was the septic system large enough for both houses? Kane stated the septic will be sized for the entire development. Houston asked if the smaller phase was strictly financial? Kane replied yes, they felt they could get the project done faster this way saving money selling their current home and living the smaller while the larger is being built. Turzynski stated he was not comfortable with the in-law unit being built before the larger home. Houston stated he agreed with the concerns stated in the letter that was read, Turzynski agreed. Engelking asked if it would make a difference building the 1,500, by increasing that size you don t need permission, you can just get your building permit. Houston agreed this would meet the zoning, then convert later. Lightfoot stated he can t support the way this was presented. Christiansen agreed with everything that was voiced tonight, we would be setting a precedent if this was allowed before the primary residence. Toole also agreed, saying he was uncomfortable with the in-law use, further discussion. Lightfoot made motion to adjourn the public hearing to July 23 rd at 6 p.m. Houston seconded, motion carried unanimously. Discussion/Action - Conditional Use request of Joe Senglaub, S29 W31247 Sunset Drive, Waukesha, Wisconsin, to operate a Commercial Horse Boarding Operation. Discussion. Houston made motion to approve the presented conditions with two amendments, condition 19 be changed to 10 trailers at one time and the lighting as described is ok. Lightfoot agreed, motion carried unanimously. Town Planner recommendations
