THE FARM TENANCY AGREEMENT From the outset, the following key terms are anticipated. The landlord may be agreeable to negotiating some of the terms in order to accommodate the most suitable tenant. PROPOSED TENANCY The landlord is offering the Farm to let as a whole for an initial term of 3 years under the provisions of the Agricultural Tenancies Act 1995, and is anticipated to commence on 24th June 2013. The tenancy will roll on from year to year thereafter, unless terminated by Notice by either party. A copy of a sample tenancy agreement is available to view on viewing days. RENT AND RENT REVIEWS Offers to rent the farm should be tendered as a fixed sum and should be in excess of 3,500 per calendar month (or equivalent). There will be no rent review within the first 3 years of the tenancy. The successful tenant will have the choice of paying the rent monthly or quarterly in advance. USE OF THE HOLDING The permanent pasture on the holding must be grazed for agricultural purposes, and may be restricted to cattle or sheep grazing only. This is due to the high ecological value of the land. BOUNDARIES AND FENCING Subject to any requirements of the landlord or any Environmental Stewardship Scheme, the responsibility for maintaining the field boundaries lies with the tenant. The tenant will be expected to put and keep the boundaries, including any fencing or hedging, in good heart and condition. DEPOSIT A deposit equivalent to two months rent will be retained by the landlord s agent (Batcheller Monkhouse). RATES/OUTGOINGS All rates, taxes and outgoings, including Council Tax, electricity, and water charges will be payable by the tenant. REPAIRS AND INSURANCE These will be detailed in the Tenancy Agreement. In general the landlord will be responsible for all major repairs (unless caused by the tenant) and for insuring the buildings, and the tenant will be responsible for insuring their contents, equipment, livestock/animals and for any third party liability insurances.
